Thank you very much for calling to our attention your concern about the $822
billing on water meter work on your project located at 18704 94th Ave. W. We
acknowledge. receipt of your April 26th phone message to me, your April 26th
phone conversation with Mayor Fahey, and your April 29th letter to the Mayor.
As I understand it, here are the facts on this case:
1. A building permit application , along with plans for your project at 18704 94th
Ave. W., was submitted to the City on March 30, 1995. Upon review of the
plumbing plans on April 3, 1995, staff indicated that the existing 3/4" water
service line was adequate for the project. Per city policy, Ron Holland noted
"no charge" on the review form since the existing line was not to be upgraded.
2. A Utility Service Order was completed on November 14, 1995. It was signed
by Marjorie Martin as the person requesting the upgrade from a 3/4" water meter
to a 1" water meter. A notation "no charge per Ron Holland" was entered.
There is no indication who made this notation.
3. At approximately the same time that the Utility Service Order was filled out ,
last November, the City received a verbal request from your contractor, Lakeside
Seawood Building Company, to upgrade your then -existing 3/4" water meter to a
1"watermeter. The City verbally informed your contractor that such an upgrade
would cost the owner a not -to -exceed amount of $822. The contractor verbally
agreed that these costs would be paid.
4. On November 30, 1995, the City completed the upgrade resulting in a 1"
water meter at 18704 94th Ave. W. The cost for providing this upgrade was
$876.94.
In reviewing the above facts and my investigation into this matter, I find the
following:

a. It is common practice for the City to charge property owners upgrading water
service on a property that already has a water meter. As of April 3, 1995, staffs
review indicated no upgrade was planned and thus no charge was assessed. .
b. The Utility Service Order was not properly filled out by staff.' The wording
"no charge" should not have been written in. Instead, the wording "$822"
should have been entered into the space next to "Meter Charge" once it was
ascertained that there would be a meter upgrade.
c. Your project at 18704 94th Ave. W. did indeed receive a value-added service
from the City for some $875 in the form of a water meter upgrade to 1 " from 3/4".
Based on the facts and findings, I have made the following decisions on behalf
of the City of Edmonds:
1. You will not be charged for the water meter upgrade, not because such
service is free to you, but because the City made an honest mistake in its
paperwork process.
2. The City has refined its procedures for providing this type of service upgrade
so that it will NOT implement such an improvement until the owner pays for, or
signs a legal promissory note to pay for, the cost of the requested service
upgrade PRIOR to the city providing this service. This procedural refinement
will assure both you, as a property owner, and the City of what your request will
cost, and your obligation to pay for such an upgrade.

Because of a recent phone conversation with Raymond Martin on April 16, 1996, 1 have
taken the time to gather information concerning their meter upgrade and who requested
this.
This home was a pre-existing home that was demolished. In the review process, I stated
there would be no charge for water service as it already had an existing meter.
On November 16, 1995, 1 received a request from the Superintendent of Lakeside
Seawood Building Company, Tom Zeller, who constructed this new home. He stated that
after discussing the situation with the plumber and owners, they decided to upgrade the
water meter from the existing 3/4" size to a new l' size meter.
I stated that there would be a charge for time and materials used but not to exceed the cost
of a new I" meter which is $822. If the cost exceeds $822, the City would not charge for
the additional costs. I have enclosed a statement dated December 5, 1995 that was
forwarded to the project coordinator to this affect
I have contacted Bob Gradwall with Lakeside Seawood Building Company, and he has
confirmed this request on this home. His phone number is 672-4702 should this need to
be confirmed.
Based on the information collected, I feel payment for this upgrade in the amount of $822
is due to the City.

On January 26, 1996, your building contractor, Seawood/Lakeside, was informed that the spreader
trench they constructed had collapsed, exposing the pipe. They were asked to correct the problem
immediately. I was assured this would be done, but on a follow-up inspection on February 8, 1996,
the condition of the spreader trench remained the same. The on -site foreman for Seawood was
informed of the situation and was told again to correct the problem.
As you recall, we discussed the problem and the concerns of your neighbor to the southwest because he
felt that his yard was being inundated with water from your detention system. I stated that your
geotech needed to determine if your system was, indeed, draining to your neighbor and to provide the
City with a written report of his results and recommendations. After our lengthy discussion, I was
assured the situation would be corrected. Two weeks after our discussion, Bob Gradwohl talked to me
about the subject problem and I was told it would be taken care of. Last Thursday, I stopped by your
residence to see if the spreader trench had been repaired to the City's standards and no work had been
done.
The spreader trench is not constructed correctly and, as far as we know, the presence of ground water
on your neighbor's property is coming from your site. This situation is unacceptable and must be
corrected immediately.� Please take the necessary steps to correct the problem by March 11, 1996.

Dear Mr. Martin,
Thank you for reviewing your site development last Friday with Paul Mar, Don Fiene and me: It
appears that the only item requiring immediate correction is the spreader trench system. Please
complete the repair as soon as practical. Placement of the gravel material you have on site to fill
the void will be acceptable. The discharge line from the detention system to the spreader trench
.should be buried as shown in the details on your drainage plan. However, since the risk of
freezing water in the detention outlet line is minimal until next winter, that work can be delayed.
Erosion control measures require periodic maintenance, but it did not appear that any immediate
correction was required at your site. It also appeared that site grading to collect all storm runoff
onsite into the storm system is not necessary at this time.

to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).

This fellow was -in this morning and went throuqh 6 street
address files looking for information concerninig a water
problem. He found one memo in which he p4jId 25� for a copy.
He also recieved i'nformation from the Bldg. Dept. which indicated
that a ' Private water line was broken somewhere in late Dec.,
1979 or maybe Jan., 1980 at 18708 - 94th Ave. W. (Holland was
the resident). At the same time he had erosion or undermining
on his property for which he has had to pay increased insurance
rates. He is of the opinion that his -problem contributed to
this water problem and wants to provide info to his 'insurance
company to lessen his rates. He wants City records (in duplicate)
which indicate the Water Dept. crew received word of this
broken line and any information as to what the city did (i.e.,
truck report, special assistance or other).
Please call him if you cannot meet the suspense date and
if you have the info available. He will pay for the photocopies .

which has expired.
2. Seaview Tank Contractor -.-has filled ± 700 yards
at subject property to date.
3. owner request additional 1500 yards.
4. Main reason for fill is to stablize ground
because owner's house is settling. .
5. Storm run off ran thru his property in the
area of the fill prior to City Forces placing
asphalt berm on west shoulder of 94th Avenue
water now drains north to a city system.
6. Neighbors - Mr. Bartol & Captain Sheilds
both are in favor of the fill.
I would recommend that property owner apply for
new fill permit attach a plot plan and after the
staff review the permit be issued to allow the
fill.

applicant should also submit a vicinity map

and identify the subject parcel(s). In
addition, the applicant shall include
other pertinent information (e.g. site
plan, topography map, etc.) or studies in

staff in completing their preliminary
