Please remember that only clean water is to be released into the city storm system. Any
work completed on your cars must be done in a manner to ensure that in time of a spill or
rain event that hazardous materials are not released into any streams, creeks, lakes, and
the Puget Sound via the city storm system. Some methods you can take are:
Place waste in sealed containers until proper disposal
Store containers in areas that are covered, dry, and secure
Have a secondary containment area in case of a spill
Use dry floor cleaners such as kitty litter or vermiculite (disposal of floor
cleaners need to be put in a sealed container / bags prior to placing in garbage
cans)
You may rinse your cars off, but only use water (no soap)
DO NOT use liquid degreasers (if they are drained to the storm system they can
be harmful)
DO NOT wash cars on paved surfaces — wash in an area that absorbs water (this
can filter water before the water enters the storm drains)

On January 20, 2010 we received a check for $50.00 from Ben Silver that included a letter requesting a
reconsideration on the $500.00 fine. Since you were previously notified about concerns we had in regards
to illicit discharge on your property, we are unable to grant the request.
We can however deduct the amount that was spent on cleaning supplies if you provide the city with
receipts for these items. Until the receipts are provided you still currently owe $450.00 This may either
be paid in one lump sum or you may pay in increments such that your balance is paid off by June 30,
2010. If you would like to pay in installments please provide a letter stating the method in which you are
paying. Please provide the full amount or your first installment (and letter if needed) to the city by
February 25, 2009.
Please note that you, as property owner, are the responsible party for this violation regardless of who
caused the violation.
If the fine has not been paid in full or a commitment for installment payments has not been submitted
from you by 4: 00 pin on February 25, 2010 the issue will be handled by our Code Enforcement Officer,

An illegal discharge concern was brought to the City of Edmonds attention on November 19, 2009.
During an inspection at a neighboring home we observed an oily substance leaving a container from your
property traveling down your driveway, down the street, and consequently into the city storm system. The
storm runoff receives no treatment downstream, which means that fish and wildlife habitat are impacted
by any pollutant discharges.
The discharge of untreated wastes to the City's storm water collection system constitutes a violation of
Edmonds City Code Chapter 7.200 and is subject to enforcement actions. Payment of a fine to cover
administrative and remediation costs associated with this violation is authorized in accordance with
Edmonds City Code 7.200.150.
The City's policy is to assign a fine up to $500 for first-time violators. Due to a letter sent from the City
of Edmonds to your address on September 16, 2009, stating that vehicle fluids are not permitted to enter

The City received a complaint regarding junk vehicles, auto parts and possible illicit discharges at the subject property.
The subject property was viewed on September 15, 2009.
The cuff ent Junk vehicle criteria (effective 1/10/09) is as follows:
"Junk vehicles" are defined in ECDC 620.020.E as a vehicle meeting any two of thefollowing requirements:
"Junk vehicle" means a vehicle meeting any two ofthefollowing criteria:
1. Is extensively damaged, including but not limited to any of thefollowing conditions: a broken or
missing windshield or missing wheels, tires, motor or transmission;
Z Is apparently inoperable;
3. Is without valid current registration plates.
4. Has an approximate fair market value equal only to the approximate value of the scrap in it.
F. "Inoperable " with respect to a vehicle means that the vehicle is incapable of being legally operated on a
public roadway due to the condition of the vehicle or the status of the ownership, registration, or license of the
vehicla
According to current code, vehicles outside a legal structure are required to be currently licensed or are considered a
junk vehicle. A vehicle is not considered junk if it is currently licensed although it may not "run". However, it is
noncompliant to work on a car in the public right-of-way as follows:
17.60.040 Vehicles in residential zones
C Exceptfor property specifically zonedfor and licensed by the City ofEdmondsfor vehicle use, vehicle storage,
repair, or sales, the operating of a vehicle -oriented business is prohibited
D. An intact, appropriately licensed and operable vehicle may be parked or stored outside a structure in the manner
provided below:
1. In afrontyard;
2. In a side yard or rear yard; provided:
a. All vehicle parts and accessories, including but not limited to containers of oils andfluids, shall be stored
in an approved structure and in compliance with all health regulations and provisions of state andfederal law.
b. Servicing, repairing, assembling, wrecking, modijying, restoring or otherwise working on vehicles outside
an enclosed structure on a property is prohibited unless meeting the following criteria:
i. The maintenance or repair shall not exceed thirty days in any twelve-month period and shall
be of a vehicle registered to a resident of the property orfamily member.
ii. Such work shall be conducted on no more than one vehicle at any one time.

iii. Such work shall not be done in thepublic right-of-way.
iv. Storage ofparts, equipment, or other supplies neededfor the repair of the vehicle on the
premises must be kept within an enclosed structure or in an area which is screenedfrom public view.
vii. The repair is conducted in a manner to not allow any vehiclefluids to enter the ground or
enter any drainage 5ystem or body of water.
viii. Disposal of all waste products shall be done in accordance with Chapter 19.114 RCW.
ix Upon completion of any work allowed by this section, the property shall be cleaned of all
debris, oil, grease, gasoline, cloths, rags, and equipment or material used in the work, and shall be left in such a
condition that no hazard to persons, storm drain system orproperty shall remain. All hazardous waste shall be
appropriately handled and disposed
E. No vehicle shall be left unattended on blocks, jacks, ramps or otherwise elevated above the ground in an unstable
manner.
Nuisances are defined as follows:
Edmonds City Code 620.041 The following nuisances are aesthetic in nature and can negatively impact neighborhood
property values andfoster blight. The following actions andlor conditions shall be a public nuisance when located in
anyfront, side or rear yard or vacant lot.
D. Anyjunk vehicle, vehicle parts or other articles ofpersonal property which are stored, discarded or left in a
state ofpartial construction or repair. .
Illicit Discharges (petroleum products, etc.) are regulated per State mandate to prevent contaminants from entering the
City storm drainage system. The storm runoff enters into the City's creeks and receives no treatment downstream,
which means that fish and wildlife habitat are impacted by any pollutant discharges.
Corrective actions required:
• Please contact me at 425-771-0220 x 1716 at your earl iest convenience by September 23, 2009 to respond and
outline your intended correction plan. An Order to Correct is issued if no contact is made.
• Remove the inoperable vehicle from the right-of-way by September 25, 2009. (Please note that Police
Parking Enforcement can/may require that the vehicle be removed immediately) As long as the vehicle is
currently licensed it can be repaired in the driveway according to the criteria noted above. If unlicensed, it
would need to be in the garage or in the back yard (if screened by a 5 foot fence or hedge) or removed.
• Remove or en�lose all vehicles that are not currently licensed (please note that a tarp, cover or pliable
tent/canopy is not considered enclosed) by September 30, 2009 or;
• Demonstrate operability of the vehicles with the City through an inspection or contact the City once the
vehicles are currently licensed by September 30, 2009. The City can verify the license on-line.
• Enclose or remove all auto parts and repair materials by September 25, 2009 according to the requirements
outlined above.
• Properly dispose (dig and bag) any pollutants on the gravel right-of-way so that no discharges are able to
enter into the storin drain system by September 25, 2009. The City's Stormwater Engineer may inspect the
premises and can issue fines if it is evident that discharges have occurred on the driveway or right-of-way due
to the vehicle repairs.
