Construct a 5' wide concrete sidewalk across entire property line. The street width from centerline must be established before a sidewalk can be built. Additional civil engineering will be required. The owner doesn't want to provide the first sidewalk w/o assurance that it will dovetail into future sidewalks and civil engineering. In response to neighborhood consensus, the city abandoned earlier plans for sidewalk development. The owner agrees to contribute a fair share to an 'in lieu of sidewalk' fund specifically dedicated to future a sidewalk improvement along his property. He understands that if sidewalk improvement is not completed within a five years, his contribution shall be reimbursed. 2. Pave driveway a minimum of 20'from the property line. Right of way construction permit required. We understand that city code requires a paved driveway to extend at least 20' from the existing street or property line, whichever is greater. All utilities and services run directly under the existing driveway. A paved driveway is a permanent surface that would have to be cut to accommodate changes in utilities or service. It is a permanent surface that offers only temporary improvement. Runoff, debris and gravel flow naturally away from the street and towards the property. The existing driveway does not impact the street in a way that would require a paved driveway. The owners enjoy the rustic approach and prefer to keep its original charm. The existing driveway has been adequate and does not adversely impact the street. A new 20' paved driveway would be unsightly, temporary in nature and require additional maintenance. The owner agrees to provide the required 20' driveway as per city engineering standards. 3. Dedicate 10' of right of way to the public. During the 1990 addition, the property abutted a street right of way which had not been dedicated for public use. An existing structure within the area of right of way made acquisition financially unfeasible.The project did not introduce additional lots, buildings or occupancy. Development impact on street and transportation systems was negligible. Given the negligible impact, any dedication requirement would have been excessive. The Dedication Presumption and Requirement (18.50.020) was waived by the city engineer. An existing structure within the right of way would also make an acquisition of right of way financially unfeasible. We are proposing a single car garage addition (315 SF) to an existing single car garage.The project does not introduce additional lots, buildings or occupancy. The impact on the street and transportation systems would be negligible. A dedication requirement would exceed that required to mitigate actual development impact, which is negligible. No construction is being planned at this time. I talked to the City Attorney on March 26 and he recommended that we do not require a ROW dedication at this time. I have informed Mr. Castagno (phone: 771-3628) that for the sole purpose. of squaring off his lot, no ROW dedication is required. Lot line adjustment is defined in the ECDC as a minor action resulting in no additional lots. This decision is consistent with the ECDC which relates , fZOW dedication to impact. If, however, at a future time there is a major development permit -- a brand new house, for example -- the City reserves the right to revisit this issue.
