Description of Subject Property and Surrounding Area The subject property is an irregularly shaped parcel of land located east of Olympic View Drive. ,Access is by way of an easement road. This road divides the property in two. (see Exhibit 5). The topography on the lot is steep, approximately a 20% grade. The lot area on the north side of the road is a series of €' stepped rockeries. A small house is located on the south side r of the easement road. Surrounding development is all single family residential:' C B. Related History The subject property was created by Edmonds Short Subdivision #S-26-66. A vraiance, File #V-257, was obtained on the subject lot for minimum lot area. This was due to the fact that the easement road must be subtracted from the lot area (13,649 square feet lot - 2,142.5 square feet access easement=11,506.5square foot lot). The house on the property just west of the subject lot received s a variance for a sixteen foot rear setback (File #V-281). Special Circumstances Special Circumstances exist in this case due to the topography and location of the easement road on the subject property. The proposed location of the new home is the most reasonable location. 2. Special Privilege The grant of the proposed variances should not result in the grant of special privilege. The home to the west faced similar constraints, though not as severe as the subject lot. 3. Comprehensive Plan The Comprehensive Policy Plan map designates the subject property as low density residential. Should the property be developed as shown on Exhibit 3, there will be no conflicts with the Comprehensive Plan. 4. Zoning Ordinance The subject property, as well as the surrounding area, is zoned RS-12. The circumstances involved with this lot are unique. The approval of the requested variances will be in conformance with the purposes of the zoning ordinance. 5. Not Detrimental The approval of the requested variances should not result in any significantly detrimental impact on any neighboring property. Care has been taken to not block the view of the house located up the hill to the east. 6. Minimum Variance The variances, should they be approved, appear the minimum to allow the owner the rights enjoyed by other properties in the vicinity. It further deprives us of a territorial view, and we understand it could detract from the value of our property. We have tried to work out solution to those problems without � success. Two changes which we had tentatively agreed on to alter the peak of the southern mall and eliminate e hot tub at that loca- tion are unacceptable to the proposed builders because they mould � detract from the architectural symmetry of the building. These requirements include a showing of: 1~ That special circumstances exist necessitating the need for variance. 2. That the proposed variance request is consistent i with the comprehensive policy plan of the City of Edmonds. i 4. That the variance is consistent with the zoning ordinances of theCityof Edmonds. 5. That the variances are the minimum necessary to i allow the owner rights enjoyed by other properties within the vicinity. j f i 11. The severity of the topography at the subject property and the location of the easement road on the subject property indicate that special circumstances exsist on the subject property. The road creates a limitation as to where property may be developed and the topography limits development to a limited section of the property. i 12. Property to the west has similar constraints as the subject 4 property and a variance was granted for that property. 13. The proposed variance will not be in conflict with the t: comprehensive plans if conditions are applied. 14. The proposed variance appears to be in conformance with the zoning ordinances of the CityofEdmonds and in particular RS-12 zones. 15. The requested variance would not be significantly detrimental to any of the neighboring properties. 16. The proposed variance appears ,to, be the minimum needed to allow the owner the rights enjoyed by other properties. 17. The Planning Department of the City of Edmonds recommended that the request for the variance be granted subject to the following conditions: 1. The house to be located as shown on Exhibit 3. 2. The height of the house should not exceed elevation 187 feet. 18. The Applicant testified to be in agreement with the. recommendation of the city planning department. 19. The Applicant submitted that it was his intention to develop the new residence so that it would be approximately 2100 square feet. This would include an enclosed carport with a loft above it and an open space deck. 20. The Applicant testified that it was his intention to put a hot tub on the proposed deck within the variance area. The Planning Department submitted that no variance was necessary for the installation of the hot tub but the fact that it would be located in the area of the variance made it relavent to the application. 21. The Applicant submitted that the major problem with the CITY OF EDMONDS - 3 i r^ development of the proposed project was the concern of the neighbors to the southofthe site. Their major concern was the volume of the wall that would be exposed to them. 22. The Applicant submitted that he would be willing to plant five maple trees to screen the wall and to add texture to the wall in order to mitigate the impact to the neighbors to the south. 23, A witness, Jack Dublin, testified that he was the neighbor to the south. According towitnessDublin the improvements on the subject property could impact the enjoyment of his property. This could occur during the months in which the witness Dublin uses his backyard. 24. Witness Dublin testified to agree to the improvements with certain conditions. These conditions include that the Applicant be restricted to building the structure according to the plan as submitted to the Planning Department; and to a; the Applicant and the witness Dublin to mutually plan the landscaping so that it does not have a negative impact upon the Dublin's property. In addition, witness Dublin i recommended that no occupancy permit be granted until the landscaping plan is approved. No other testimony was received in this matter. 1. The application is for the approval of variances from the required side setbacks, street setbacks and rear setbacks for property located at 18903 Olympic View Drive, Edmonds, t` Washington, and more particularly described as set forth ,in the Introduction. 1 2. The specific variance request is to allow a side yard setback of 4.61 feet, a rear setback of 7 feet and a street setback of '3 feet on the property; described. The normal setbacks for the property, which is located in an RS-12 zone, are 25 feet for the ,street setback, 10 feet for the side setback, and 25 feet for the rear setback. �r 3. Special circumstances do exist necissitating the granting of the variance in that the subject property has an irregular shape and has steep topography which limits the area in which development can; occur. The limitation is partially the result of an easement road which was put on the property before it was short subdivided. 4. The granting of the variance requests will not result in the s' granting of a special privilege in that the property to the west has been granted a variance for similar reasons. 5', The variance will not conflict with the comprehensive policy plan of the City of .
