Dear Jeanine;
At the request of my attorney, Karen Willie, I called you to
inquire whether the installation of temporary, reinforced
wood frame panels inside three of the large windows in our
living room and lower floor recreation room would require a
building permit.
These panels have been constructed so as not to harm or mar
the existing window frames. They are intended to provide
temporary shear wall strength to mitigate potential serious
damage to our residence in the event of a code level
earthquake.
Based on my telephone conversation with you on the afternoon
of January 26th, 1994, it is my understanding that no
building permit is required for these mitigation panels.
Please contact me if there are any questions or changes in

Application for the City of Edmonds prior
to his/her submittal of a development permit
to the City.
The purpose of the Checklist is to enable
City staff to determine whether any potential
Critical Arens are or may be present on the
subject property. The information needed to
complete the Checklist should be easily
available from observations of the site or
data available at City Hall (Critical Areas
inventories, maps, or soil surveys).

scheduled for September 11, 1995 has been cancelled. We are currently in the process of
drafting and finalizing the settlement documents.
This was an extremely emotional case for us all. However, we believe we were able
to secure the best possible settlement for the Dericksons under the circumstances. After
many days of mediation and legal maneuverings, we were faced with threats of bankruptcy,
lack of insurance coverage if we prevailed, a two year wait during the inevitable appeal and
the very real costs of a four week trial.
It has been a long haul but the end is finally in sight.. On behalf of the Dericksons,
I would like to thank you for the time, expertise and support you provided during this
litigation. It has been a pleasure working with such a fine group of professionals. We will
endeavor to keep your names on file for future reference.

to you of March 27, we had three summary judgments scheduled to be heard March 31,
1995. As it happens many times in law, we did not receive the Judge's decision until May 2,
1995. We are still alive and well. One of the important decisions was adverse, but we

not available for trial on Monday and I expect we will all need a little time to re-evaluate
things after the motions are decided.
Judge Krese or a King County judge are possibly available May 15 for a four -week
bench trial. Judge Krese's availability is dependent on another case settling. In the event
that the other case does not settle, Judge Kreses is not available until early
August/September of this year. We will keep you posted as to trial developments.
Finally, there is a possibility that if Windermere loses the summary judgments, they
may be more willing to settle this case. I want to thank you all for your continued support
in this case and I am sorry for any inconvenience that the vagaries of the judicial system
