VARIANCE REQUESTED: To allow construction of a 2 bedroom addition to the rear south
section of home. Addition would be parallell to existing south end of home, _
proceed west 15' thence north 29' 6" and tie back into home. The existing home is
approx 181 from south line of roperty and current setbacks are 25 feet. I would not be

ZONING ORDINANCE REQUIREMENT:
Release/Hold Harmless Agreement
The undersigned applicant, his heirs and assigns, in consideration for
the City processing the application agrees to release, indemnify, defend and
hold the City of Edmonds harmless from any and all damages and/or claims for
damages, including reasonable attornevs' fees, arising from any action
or inaction is based in whole or in part upon false, misleading or incomplete
information furnished by the applicant, his agents or employees.

DECLARATIONS OF APPLICANT
Below are answers to all questions on your standard form.
A. Special circumstances. I have special circumstances which consists of
a 60' right of way directly to the south of my property which is unimproved
and has been since its platting and development in early 1950. The
development of this right of way is not very probable since the area is fully
developed and would not benefit anyone. In fact in 1981, 1 moved to have the
property vacated of which all people I contacted were in favor. Enclosed is
plat map of which property owners are darkened who supported vacation of
this property and appose development of this right of way.
The strict enforcement of this zoning ordinance would deprive me of
rights and privileges which have been granted to Mr. Miller to the south of
me and the 60' right of way. In 1977 he was allowed to construct an outbuilding
within 11 feet from this right of way under a variance granted by the City of
Edmonds. Also in 1979, Salley Johnson was allowed to add to their home exactly
the way I wish to under a permit through Cascade Construction. This addition
is within 15 feet of said right of way. She lives at 19001 84th West, which
is behind Mr. Miller and also abutts this same right of way.
B. Special privilege. Two other people adjoining same 60' undeveloped
right of way have been granted permission to build within the 25' corner lot
setback rule. Granting this variance would not be special privilege, and
would be consistent with other privileges in the same area.
C. & D. Approval of this variance would be consistent with previous zoning
and comprehensive plan of this area when this home was built in 1954. It also
is consistent with the current comprehensive plan and zoning in all other respects.
E. If this variance were granted it would not be detrimental to public health,
safety, and welfare or injurious to the other property or improvements in the
vicinity or same zone. In fact, if this variance were granted it would be
beneficial to the City of Edmonds and other property owners in this area.
It would be beneficial because the variance would allow an addition that would
be consistent with current building codes and the buildings original design.
To complete this 2 bedroom addition any other way would not be consistent and
would not be in the communities best interest.
F. If this variance is approved, it is the minimum variance that is necessary
to allow the addition to be built as to keep an original design of the house.
Enclosed is a layout of the home which is a rambler style and indicates no other
possibility of adding the bedrooms and keeping an appearance that would improve
the community or be consistent with the rambler design.
I am not applying for this variance because other people in the area have
been granted this same variance privilege. I am applying because we have
two children and my wife is pregnant with our third child. In order for our
growing family to live comfortably we need more bedrooms, and space. My father
built this home in 1954, of which I have lived here all of my life. I wish to
raise my family in this home as my parents have done. I love this area and

and hope my children can have this same opportunity to be raised in a nice
community as this is. I would not like to move because we do not have
enough space. The only way to add these bedrooms and keep the addition
consistent with its original design is to have it built in this manner.
I hope that you will grant this variance as we need this additional
space soon with my wife being on a time frame in her pregnancy. I would
like my wife and family to be comfortable.

IV. STAFF FINDINGS AND CONCLUSIONS:
A. Description of the Subject Property and Surroundinq Area
The subject property is located the northwest corner of the
intersection of 83rd Ave. W. and 190th St. S.W. The
right-of-way for 190th St. S.W. is presently undeveloped.
The Applicant has obtained a street use permit to utilize a
portion of that right-of-way. He has erected a fence along
the portion that is adjacent to his property . A public
walkway is located south of the fence, in the street
right-of-way.
There is an existing single story residence on the
property. The Applicant is seeking a variance to construct
a two bedroom addition onto the southwest corner of the
house, in line with the present south wall.
Surrounding development is entirely single family
residential.

INTRODUCTION
Rod Addicott, 18926 - 83rd Avenue Westr Edmonds, Washington,
98020, (hereinafter referred to as Applicant) has requested
approval of a variance for a reduction of the street setback from
25 feet to 16 feet for the allowance of an addition to the
residence at 18926 - 83rd Avenue West, Edmonds, Washington.
A hearing on the request was held before the Hearing Examiner of
the City of Edmonds, Washington, on December 17, 1987.

After due consideration of the evidence presented by the Appli-
cant, and evidence elicited during the public hearing the
following Findings of Fact and Conclusions constitute the basis
of the decision of the Hearing Examiner.

FINDINGS OF FACT
1. The Applicant has requested approval of a variance for a
reduction of the street setback at 18926 - 83rd Avenue West,
Edmonds, Washington. The requested variance is for a
reduction of the required 25-foot street setback to one of
16 feet to allow an addition to the residence located on
site. (Staff report.)
2. The subject property is zoned RS-12. The Edmonds Community
Development Code (ECDC) 16.20.030 establishes the minimum
street setback for RS-12 zoned property as 25 feet. It is
from this standard that the Applicant seeks a variance.
3. In order for a variance to be granted within the City Of
Edmonds the criteria as set forth in ECDC 20.85.010 must
be satisfied. These criteria include:
A. Because of special circumstances relating to the pro-
perty, the strict enforcement of the zoning ordinance
would deprive the owner of use rights and privileges
permitted to other properties in the vicinity with the
same zoning.
B. The approval of the variance would not be a grant of
special privilege to the property in comparison with the
limitations upon other properties in the vicinity with
the same zoning.
C. The approval of the variance will be consistent with the
Comprehensive Plan of the City of Edmonds.
D. The approval of the variance will be consistent with the
purposes of the zoning ordinance and the zone district
in which the property is located.
E. The variance as approved or conditionally approved will
not be significantly detrimental to the public health,
safety and welfare or injurious to the property or
improvements in the vicinity and same zone.
F. The requested variance is the minimum necessary to allow
the owner the rights enjoyed by other properties in the
vicinity with the same zoning.

4. The subject property is located on the northwest corner of
the intersection of 83rd Avenue West and 190th Street S.W.
Because the subject property is a corner lot there are two
street setbacks, 83rd Avenue West and 190th Street S.W.

5. The right-of-way of 190th Street S.W. is undeveloped. The
City indicated that there is no intent to vacate this right-
of-way at the present time although the City does not have
plans to use it in the immediate future. (Bowman
testimony.)
6. The Applicant has obtained a street use permit for use of a
portion of the unused right-of-way. In the unused right-of-
way he has constructed a fence south of his residence on the
subject property. (Staff report and Bowman testimony.)
7. it is the intent of the Applicant to construct a two -bedroom
addition onto the existing house. The addition would be
located on the west end of the house and would not result in
further encroachment into the established 16-foot setback
from 190th Street S.W. The existing residence, a noncon-
forming use, extends into this setback. (Bowman testimony.)
8. The area surrounding the subject property has been platted
and developed. other properties in the area have con-
structed buildings within the 25-foot setback standards of
190th Street S.W. These were constructed with building
permits issued by the City of Edmonds. The City of Edmonds
did not require variances for these buildings. (Exhibits
7r 8 and Addicott testimony.)
9. The Comprehensive Policy Plan Map of the City of Edmonds
designates the subject property as Low Density Residential.
The adjoining properties have the same designation. (staff
report.)
10. The requested setback variance does not pose any significant
impact to the public, nor to any nearby private property or
improvement. (Staff report.)
11. The Planning Department of the City of Edmonds did not make
a recommendation on the request. (Staff report.)
12. No adverse testimony was received in this matter.
CONCLUSIONS
1. The application is for the approval of a variance to reduce
the required 25-foot street setback to 16 feet to allow an
addition to a residence at 18926 - 83rd Avenue West,
Edmonds, Washington.
2. In order for a variance to be granted within the City Of
Edmonds the criteria as set forth in ECDC 20.85.010 must be
satisfied. This application satisfies these criteria.
3. Special circumstances exist for the granting of a variance.
The property is a corner lot that is located next to an

unused right-of-way. other properties in the area have
encroached within the right-of-way and the City has allowed
building permits to be issued for such activity.
4. The granting of a variance is not the grant of a special
privilege. As noted, other properties in the area have
similar setbacks that have been allowed by the City of
Edmonds.
5. The Comprehensive Policy Plan map of the City of Edmonds
designates the subject property as Low Density Residential.
The requested variance does not conflict with the Comprehen-
sive Plan in that it satisfies the provisions of ECDC
15.20.005. In particular it satisfies the goals of ECDC
15.20.005(B).
6. The requested variance is consistent with the purposes of
the RS single-family residential zoning as set forth in ECDC
16.20.000. It will reserve areas primarily for family
living in a single-family dwelling and be compatible with
other property uses in the area.
7. The requested variance will not result in any detrimental
impact to the public, nor to nearby private properties or
improvements.
8. The requested variance is the minimum necessary for the
Applicant to develop his property in a reasonable manner.

Based upon the preceding Findings of Fact and Conclusions, and
the testimony and evidence submitted at the public hearing, it is
hereby ordered that the requested variance for a reduction of the
street setback from 25 feet to 16 feet on property located at
18926 - 83rd Avenue West, Edmonds, Washington, is granted
subject to the following conditions:
1. This variance is for the reduced setback standards off 190th
Street S.W., adjacent to the subject property.
2. The variance shall be recorded with the Snohomish County
Auditor.
3. The Applicant shall secure all building permits prior to any
construction of the addition.
