RE: NOTICE OF CORRECTION — FENCE PERMIT #2002-0186
The City of Edmonds Engineering Division has performed a final Engineering inspection
at 19125 Ocean Ave with regard to the fence constructed under permit #2002-0186.
However, in order for the City to grant final Engineering project approval, corrections
must be made. Per the approved plan, two gates were to be placed over the sewer line for
maintenance purposes. Upon inspection of the fence, it has been found that only one gate
is located within the 15,-foot casement area while the other gate (on the north side) is
located approximately 10 feet outside the easement.
The location of the north gate will not be approved as it has been constructed. In order
for the City of Edmonds to access the sewer easement, the access gate must be located
within the easement area. Immediate action must be taken to relocate the gate and bring
it into compliance. Relocation of the gate must be completed by December 16, 2002 to
prevent Code Enforcement action.

AGREEMENTAND
DEED OF DEDICATION
V�THEREAS, the undersigned property owners, Mike and Candi Dedonker, of 19125
Ocean Avenue, Edmonds, Washington, have petitioned the City to permit the Dedonkers to
improve the right-of-way of Ocean Avenue in order to improve access to their home; and
ViTHEREAS, such improvement is not currently listed on the City's Transportation
Improvement Plan and has not been assigned a priority for improvement by the City; and
Y-THEREAS, the City deems it appropriate to permit such improvement subject to the
terms and conditions set forth herein and to accept dedication of the improvement upon its
completion in accordance with City standard, NOW, THEREFORE,
MIKE AND CANDI DEDONKER (herein "Dedicators") and the City of Edmonds,
Washington, a municipal corporation (hereinafter "City") have entered into this agreement
pursuant to the terms and conditions set forth herein:
I . Improvement of Right-of-Wa . The City will process at its cost with the
assistance of the property owner, a construction permit application and right-of-way use permit
along with any and all required approvals necessary to authorize construction of street
improvements within the right-of-way of Ocean Avenue within the area shown on the attached
Exhibit A.
2. Street Standards to be Observed. All construction undertaken by the property
owners shall conform to the City of Edmonds' street standards. Such street standards are shown
on the attached Exhibit B. In the event that any aspect of the improvement is not covered by the
attached standards, the Dedicator shall consult with the City Engineer and conform such
additional improvements to such reasonable standards as the City Engineer shall establish. No
improvement shall be undertaken which is not covered by the street standards, or by the City
Engineer's approved supplemental standard.
3. All Improvements at the Cost of the Dedicators. All such improvements shall be
undertaken at the cost of the Dedicator. In addition to the indemnity agreement set forth below,
the Dedicator promises to hold harmless and indemnify the City of Edmonds, its officers, agents
and employees from any and all liability to contractors, subcontractors, materialmen, suppliers or
any other party participating in the aforementioned construction activities.
4. Dedication Process. Upon completion of the improvements, the Dedicators shall
notify the City Engineer who shall cause the improvements to be inspected. The City Engineer
shall report to the City Council making a recommendation regarding the acceptance of such
improvements. In the event that the improvements fail to meet City standards or are deficient in
any way' the Dedicators promise to, on behalf of themselves, their successor and assigns, correct
such deficiencies with reasonable dispatch. Upon acceptance of the dedication, all obligations of
the Dedicator shall lapse and be at an end except as set forth in paragraph 7.
5. Burdened Propert . The terms of this agreement shall be deemed to burden and
attach to land located at 19125 Ocean Avenue and described on the attached Exhibit C. The
benefits of the agreement shall be deemed to touch and concern the land and shall run with the
land to all successors in interest in said burdened estate. As noted above, upon acceptance of the
improvements by the City Council, such obligations shall lapse and be at an end, except as
expressly provided below.
6. Indemnity and Hold Harmless. The Dedicators, their successors and assigns,
including all future owners of the burdened tract, promise to hold harmless and indemnify the
City of Edmonds, its officers, agents, and employees from any liability of any kind or nature,
arising from or out of the construction of the improvements dedicated herein, including but not
limited to claims by the traveling public, provided, however, that nothing herein shall be
interpreted to require the Dedicators or their successors in interest, to indemnify and hold
harmless the City from any loss, claims or liability arising from the City's negligence, including
but not limited to negligence in the establishment of the design standards incorporated herein.
7. Survival of Paragralis 3 and 6. Upon acceptance of the dedication of the herein
described improvements, the provisions of this agreement shall lapse and be at an end, provided,
however, the indemnification provision of Paragraphs 3 and 6 shall survive to the extent
necessary go ensure that the City of Edmonds, its officers, agents and employees are held
harmless and indemnified from loss, claim or liability arising from the construction of the Ocean
Avenue improvements.
8. No Third -Party Rights Created. Nothing herein shall be interpreted to create a
third -party right of action against the Dedicators or the City, nor to impair any defense which
either of the parties may have.
9. Entire Agreemen . This is the entire agreement between the parties. Any prior
understanding, written or oral, shall be deemed merged with its provisions. This agreement shall
not be amended except in writing, with the express written consent of the parties hereto.
