Of Public wurks The regular meeting of the Edmonds Board of Adjustment was called to order by Chairman Paul Roy at 7:35 p.m. in the Council Chambers of the Edmonds Civic -Center. City Planner Jack Byrd Ann Derleth Larry Martin, City Attorney Bill Leraas Harold Hatzenbuhler Wayne Tanaka, City Attorney Anne McGee Jackie Parrett, Deputy City Clerk Chairman Roy welcomed the audience and explained the functions of the Board, the procedure for handling of the hearings, and the method of appealing decisions of the Board. APPROVAL OF MINUTES MR. LERAAS MOVED, SECONDED BY MR. BYRD, TO APPROVE THE MINUTES OF OCTOBER 17, 1979. MOTION CARRIED. REPORT FROM STAFF Mr. Pearson advised that three items on this evening's a enda should be continued to the next meeting. With regard to V-72-79 (BILL LeCLAIRE}, he said he had heard nothing from Mr. LeClaire since the last meeting but the Engineering Division had been meeting with him on the issue of the driveway slope and they recommended the item be continued. The adjacent property owner, Mr. Johnston, who was working with Mr. LeClaire on a joint driveway, was present but he said he did not represent Mr. LeClaire inasmuch as he hadn't been able to contact him recently. MR. BYRD MOVED, SECONDED BY MR. LERAAS, TO CONTINUE V-72-79, CU-56-79, AND CU-61-79 TO THE DECEMBER MEETING. MOTION CARRIED. CONTINUED AGENDA CU-66-79 JAMES LYMAN - Conditional Use Permit for day care in the home at 23727 78th Pl. W. S 8) This item was continued from the previous month. However, Anne McGee was new to the Board this month and had not been present for the public hearing on this matter and had not listened to the tape recording of the hearing. She was therefore disqualified from participating in this decision and without her the Board lacked a quorum. MR. BYRD THEREFORE MOVED, SECONDED BY MR. LERAAS, TO CONTINUE CU-66-79 TO THE DECEMBER MEETING. MOTION CARRIED. Before taking this action the Board waited until it was apparent another member would not be arriving, and the situation was explained to the applicant. V-75-79 ,,CARL-MUNSON__-_Var-iance-from,required lot, easement, and pavement width at 9 9Olympic View Dr. (RS-1;2) P The proposal was to provide access to two lots on a 15' easement with the pavement 15' wide, where normally a 20' easement is required with 18' wide 11 pavement. Mr. Pearson recommended approval because it was a minimum variance and because a variance would not be required if another driveway were installed on the other side of the lot. There did not appear to be any reason to have two driveways, however, if one could be shared. The public portion of the hearing was opened. Howard Olds represented the applicant and said this was a two -lot subdivision with an easement to a landlocked lot. He said they would like to see a driveway with only 12' wide paving but would accept 15' if that was required. No one else wished to speak, and the public portion of the hearing was closed. Mr. Leraas felt this appeared to be practical and a better solution than two driveways and it _provided access to a landlocked piece of property. Mr. Byrd agreed that this was practical under the circumstances and Mrs. McGee saw no other reasonable way to do it. MR. LERAAS MOVED, SECONDED BY MR. BYRD, TO APPROVE V-75-79 AS IT APPEARED TO BE A PRACTICAL SOLUTION FOR A LANDLOCKED PIECE OF PROPERTY AND WOULD NOT BE DETRIMENTAL TO THE HEALTH AND SAFETY OF THE NEIGHBORHOOD. MOTION CARRIED. AGENDA CU-70-79 HAN Z. PARK-- Conditfonal.`Clse:PenQit for grading in excess of 500 cu. yds. at p,8 , ympic VieWV`. SA(RS-12) This proposal was to excavate approximately 2,000 cu. yds. of earth from the applicant's property. Grading would be in the southeast corner of his lot which abuts Olympic View Dr. The result would be to move a fairly steep slope back on the property so he would have a large flat area. The Engineering Division saw no problems which could not be handled and Mr. Pearson said this proposal would not endanger the health and safety of the neighborhood and would not be injurious to abutting property. However, Mr. Pearson could not recommend approval because the policies of the Comprehensive Plan allow grading on steep slopes only for necessary roads and building pads, both of which already exist on the applicant's lot. The public portion of the hearing was opened. The applicant said that when he built the house three years ago he carved out the area and moved the soil to the nearby ravine. He did not feel his present proposal would be detrimental to the adjoining lot, which he also owns. He said when he graded it the first time he seeded the hillside which had been effective, and he planned to do that again and also install some rockery. He had experienced no drainage problems, even during the last bad storm, so he did not anticipate any such problem. No trees would be involved, and he planned to construct a tennis court in the cleared area, along with landscaping it. The public portion of the hearing was closed. MR. BYRD MOVED, SECONDED BY MR. LERAAS, TO APPROVE CU-70-79 BECAUSE IT DID NOT APPEAR TO BE DETRIMENTAL TO THE HEALTH, SAFETY, AND WELFARE OF OTHERS IN THE VICINITY AND BECAUSE THE TYPE OF USE TO BE MADE SUBSEQUENT TO THE CHANGE IS PERMITTED IN THIS ZONE AND IT WILL NOT BE SIGNIFICANTLY DETRIMENTAL TO THE ADJOINING PROPERTY. MOTION CARRIED. V-77=79 GLEN E. BARRETT -Variance for lot width to length ratio at MO.,175th,'St., .(RS-12) _ This application was in conjunction with a 4-lot subdivision. The Zoning Code requirement for lot width to length ratio is .4 and the proposal was to reduce that to approximately .25. The applicant indicated this lot would not be built upon by itself but would be incorporated into the property west of lot 4 which is also owned by the applicant. Mr. Pearson recommended approval on the condition that a covenant be placed on Lot 4 requiring that it not be a building site unless combined with the applicant's adjoining property to the west. The public portion of the hearing was opened. Jurgen Sauerland of Lovell-Sauerland and Associates, representing the applicant, said there would be no objection to the recommended covenant. The public portion of the hearing was closed. MR. BYRD MOVED, ,SECONDED BY MR. LERAAS, TO APPROVE V-77-79, SUBJECT TO A COVENANT'S BEING PLACED ON LOT 4 IN FAVOR OF THE CITY OF EDMONDS THAT LOT 4 NOT BE MADE A BUILDING SITE EXCEPT IN COMBINATION WITH PROPERTY TO THE WEST, THE ESSENSE OF GRANTING THIS VARIANCE BEING TO TREAT THE PROPERTY AS HAVING A CHANGE IN LOT LINE. THE REASON FOR APPROVING THIS IS BECAUSE OF THE SPECIAL'CONDITIONS OF SIZE AND SHAPE OF THE PROPERTY NOT GENERALLY APPLICABLE TO OTHER PROPERTY IN THE AREA, AND ENFORCEMENT OF THE ZONING CODE FOR DEVELOPMENT IN THE NORMAL MANNER WOULD DEPRIVE THE APPLICANT OF RIGHTS COMMONLY ENJOYED BY OTHER PROPERTIES IN THE DISTRICT.
