FINDINGS OF FACT 1. The Applicant has requested a Home Occupation permit for a cosmetic car care business at 19310 76th Avenue West , Edmonds, WA. 2. Zoning on the property is RS-8 as established in the Edmonds Community Development Code. 3. The Comprehensive Policy Plan map designation for the above described property is low density residential. File #CU-44-82 2 4. 5. 6. 7. The subject property is developed with a single family residence and a large garage. A large laurel hedge is locatedalong the north property line. A six foot wall is located along 76th Avenue West where automobiles enter the subject property. The Appl i cant testi f i ed that he i ntends to operate a cosmeti c car care business on the subject property. The Applicant testified that the business will be by appointment only, four to six cars a day. The Applicant testified that all work will be done in the garage, with the doors closed. B. The Applicant testified that no mechanical work will be done on the carss only washing, waxing and cleaning the interior of the cars. 9. The Applicant testified that there will be no outdoor storage. 10. The Applicant testified that the hours of operation would be from nine a.m . to five p.m., possibly later to seven p.m., Tuesday to Friday. 11. The Applicant testified that the equipment used in the business will be a vacuum cleaner and possibly a power buffer. 12. The Applicant testified that only family members residing at the home will work for the business. There will be no outside employees. 13. The, Applicant testified that no sales of products will occur at the home. There will be no signs or public advertisement. it will be advertised by 11word of mouth". 14. The Applicant testified that the type of cars cared for are newer cars. NO car dealer business will be accepted. 15. Witness Hanson testified that residential neighborhoods should be kept that way. The business may expand which would be detrimental to the area. 16. Witness Hanson asked if the applicant was currently running a business and was the owner aware of this application. The Applicant testified that he is not presently running a business at the site.and that the owner is aware of this application. testified against the proposed use. The former property owner 17. Witness Chase his large trucks. It is his feeling that constructed the huge garage to store the house was built for commercial use. He further testified that the proposed home occupation does not appear to meet the criteria for a home occupation. Witness Chase testified that businesses are intended to grow and expand. If the Applicant maintained the proposed business exactly as stated above, Witness Chase would not object. However, he stated that this will not occur because the City will not enforce its rules. 19. The Applicant testified that the two home daycare businesses, located directly east of the subject property across 76th Avenue West in the City of Lynnwood, generate more traffic than his proposed business. Further, past problems should not set a precedent for his application. 20. Witness Fischer -Gibbons testified in support of the application. She stated that the Applicant has maintained the home in a clean, appropriate manner. She further testified that the Applicant should not be penalized for any past actions. 21. The Applicant testified that if he received any complaints he would close the business down. Further, if he chose to expand, he would reapply for a Home Occupation permit. 22. Witness Painter testified in support of the application. The traffic s would be negligible -as 76th Avenue West is an arterial street. He impact further testified that the neighborhood will not be substantially impacted, there will be no noise problem and that because of the poor economy cottage industries are becoming more popular and necessary. 23. Witness Williams testified against the proposal. He stated that his property would decrease in value if the application is approved. He felt that there iles due to the six foot will be a potential conflict with children and automob high wall. He further testified that this would establish a precedent for other businesses to encroach into the area. 24. Subsequent to the hearing, on November 24, 1982, Witness Williams telephoned the Planning Department and withdrew his objections to the application. 25. Witness Painter testified that mirrors could be installed at the entrance, to eliminate the potential pedestrian/automobile conflicts. 26. Witness Chase testified that the proximity of businesses at 76th Avenue West and 196th Street S.W. coupled with other home occupations could change the character of the residential neighborhood. 26. Witness Warhol testified that he is neither for or against the application. As a builder, he would not like to bUil'd a home next to any commercial business, home occupation or not. CONCLUSIONS 1. The request is for a Home Occupation permit for a cosmetic car care business at 19310 76th Avenue West, Edmonds, WA. I File #CU-44-82 Page 4 - December 2, 1982 2. The zoning on the subject property is RS-8 and is designated by the Comprehensive Plan as low density residential. 3. All Home Occupations must conform to the criteria of Chapter 20.20.020 of the Edmonds Community Development Code, as listed below. A. Area Used. The home occupation shall be carried on entirely within a.,compl tely enclosed bui.lding. . . B. Employment No one other than a member of the immediate family residing on the premises may be employed on the premises. Persons in building trades and similar fields, using their home or apartment as an office for business activities carried on off the premises may have other employees provided they are not employed on the premises, they do not park on or near the residential dwelling site and they do not visit the residence during the course of business. C. Equipment Use. Mechanical equipment can be used if it is compatible with a denTial environment. D. Traffic. The home occupation shall not generate any more traffic than,is normal for a single residence in the neighborhood. E. General Regulations. No goods shall be sold or rented on the premises except instructional materials pertinent to the home occupation (e.g., music books),. The display or storage of goods outside the premises or in a window is prohibited. Customers may not visit the site to view the merchandise. No unreasonable amount of dust, odor, smoke or noise shall be permitted. F. Signs. A sign is permitted if it does not exceed three square feet in size. It shall contain only the name and address of the residents. 4. Testimony was given supporting the application as set forth above. 5. Testimony was given in opposition to the application as set forth above. 6. The proposed Home Occupation appears to comply with the criteria that the business $hall be carried on entirely within a completely enclosed building as the cars will be cleaned in the garage with the door closed. 7. The proposed Home Occupation appears to meet the criteria of no outside employees. 8. The proposed Home Occupation appears to meet criteria for equipment use as only a vacuum cleaner and power buffer will be used. 9. The proposed Home Occupation should not generate any more traffic than what would-be normal for a single family residence. Based on the fact that 76th Avenue West is a major arterial and access to the site will be by way of that street, there will be no disruption of the residential neighborhood. The proposed Home Occupation, as conditioned, appears consistent with the Comprehensive Plan, and the purposes of the Zoning Code. DECISION Using the above findings and conclusions as the basis of the decision, the Planning staff hereby grants the Home Occupation permit request of John Studioso, 19310 76th Avenue West, Edmonds, WA subject to the following conditions: 1. The maximum number of cars per day shall be limited to five. 2. The hours of operation shall be from nine a.m. to five p.m.,, Monday through Friday. .3. The cars must be cleaned within the garage with the doors -closed. 4. The Applicant shall install draperies over all windows in the garage. 5. The Applicant shall install mirrors on each side of the driveway entrance. 6. There shall be no on -site signs advertising the business. 7. No more than one.customer car is to be at residence at any given time. 8. No goods shall be sold on the premises. 9. There shall be no outside employees. 10. The Applicant shall obtain a business license from the City Clerk. 11. The Home Occupation permit shall not be transferable to any other person; it is personal to the applicant. It also may not be transferred to any site other than the site described in the application. 12. Business shall be by appointment only; no drop -in business is allowed. 13. This application will be reviewed in six months to insure that the above conditions are being met. It it is demonstrated that they are not being complied with, the Home Occupation permit shall be revoked. 14.
