Based on this, I will not recommend payment of your claim. Generally speaking, unless the property owner protested at the time of adoption of the final assessment roll on the improvement installed or the costs, it is assumed the property owner is satisfied and thereby approves the project. This is true for all LID's, since a project using the LID process is being done directly for the property owners and the owners have a direct say in what is built. It would also be difficult to justify payment for a project done nearly 20 years ago, in which the LID bonds were paid off in 10 years and the LID and any quaranty funds no longer exist. Dear Mr. Alberts: Thank you for your letter of December 3, 1986. Somehow.we are lacking in communications, so let me try to clarify. A sewer LID is formed so that properties may be served. Your main line was 17 feet deep for that purpose but the service lines were raised to a depth of only 8 feet. This was insufficient to serve the buildings on our sloping lot. Therefore, we had to enter 80th Ave. West and pick up the side sewer at a point deep enough to serve our buildings. This is the expense we are trying to recover. If your service lines had been correctly installed, there would have been no need for corrections, therefore, we ask you to satisfy our claim promptly. Please feel free to call me if we need to discuss this problem in person. At this point, no design work has started on the project and there is no tentative schedule for project completion. The project was identified during the Council budget meetings as a project to be delayed if further funds were needed for the wastewater treatment incinerator repair. I am unaware of past commitments to you regarding this problem. The Engineering Division was first notified of the problem by Public Works in the fall of 1992. The street overlay project took place in 1990. Your letter listed only one (1) backup prior to the 1990 street overlay. Had the Engineering Division been aware of a utility project in the street prior to the street overlay project, the policy would have been to delay the street overlay until the utility project was complete. We still intend to make improvements to the sanitary sewer on 80th Ave. W. this year and expect the project to be under way in late summer or early fall. However, the placement of the project in the budget does not guarantee that it will be completed in the year scheduled. Until the treatment plant incinerator repair project has been bid, I will not be able to give you details on the schedule for the sewer project on 80th Ave. W. I have discussed the sewer back-up problem with the City of Edmonds over the last 5 years. Enclosed you will find a history outlining the sequence of events. I had been promised that the mainline sewer problem would be rectified before the road was repaved. The road has since been repaved and the problem has not been corrected. I have met with Everett on numerous occasions and have discussed the problem with Ron Holland. We had reached an agreement to pressure wash both cleanouts, the ones serving 19505 and 19512, twice a month. This was to be done to eliminate blockage caused by flow problems in the main line on 80th Ave. W. On December 24, 1994, the building at 19512 experienced a sewer backup. A large deposit of material was found to be causing the blockage at the stubb connection to the main line. Obviously, the jetting has not been done on both clean - outs as agreed. This problem has been expensive and damaging to myself and Bjorn. We have paid bills over the years in good faith, hoping this would be solved. We cannot wait any longer and hope that the city will support us in resolving this problem. I am asking the city to reimburse us for our expenses to date. The fact that development in 1987 is requiring a different alignment which was not anticipated 20 years ago is, I believe, irrelevant to the original LID. Your seeking of compensation from the City is, in my judgement, beyond the bounds of reasonable and legal expectations. The City fulfilled its contractural obligations as represented in the LID, and to our knowledge no protest took place. In fact, I am somewhat perplexed at the rationale you are' using to make the claim. To my knowledge no such protests were made for the property you now own. I do not believe that it would be reasonable to go back 20 years and undo the Final Assessment Roll for this LID. This would be both illegal and totally impractical.
