RE: FOLLOW-UP ON DISCUSSION OF TREE CUTTING
REQUIREMENTS
Dear Mr. Ross:
After our discussion at the counter last week, I took a another look at the code
regarding tree cutting with respect to your situation. As you had thought, a tree
cutting permit itself is not required for removing trees on the vacant parcel behind
19508 8 8th . Although that parcel is subdividable, it can only be split into one
additional lot based on the zoning (RS- 12) and the size of the parcel (29,500 sf).
The Critical Areas portion of the City code is also pertinent to your proposal.

ECDC 23.90.040 defines a number of development standards for specific habitats.
In your case, subsection 23.90.040.0 applies:
Retention of Vegetation on Subdividable, Undeveloped Parcels. As a
provision of this title, the director shall require retention of a minimum of 30
percent of native vegetation on undeveloped (or redeveloped), subdividable
lands zoned as RS- 12 or RS-20 per Chapter 16. 10 ECDC. This standard for
development shall apply to all undeveloped (or redeveloped), subdividable
lands zoned RS-12 or RS-20 regardless of the potential for designation as a
fish and wildlife habitat conservation area or other critical area. The goal of
30 percent native vegetation can be met through maintaining existing native
vegetation, establishing native vegetation, or a combination of both. A
vegetation management plan, subject to the approval of the director, is
required for approval of the proposed development. This provision for native
vegetation retention will provide increased protection of fish and wildlife
habitat throughout the Edmonds jurisdiction.
As the code indicates, 30% of the native vegetation on your parcel must be retained
when you consider removing trees on the vacant parcel.
Your initial tree report indicated there were four trees that were diseased or dying
but you had mentioned removing a number of other trees as well. To ensure you
satisfy the 30% retention requirement, please have your arborist do a tree inventory
on the entire vacant parcel. Have him identify all the existing trees, the species and
size, their health, and exactly which are desired to be removed, keeping in mind
that 30% of the trees must be kept to satisfy the code requirements. When the
report is complete, you can either mail it in or drop it off at the counter and we can
take a look at it.

trees as possible problems. Hear are the
detales.
Tree #1 is a Hemlock that has lost
it's top and should be removed.
Tree #2 and 3 a Fir and Hemlock
have decay at the base and possible root
rot, they should be removed or futher in-
vestigated.
Tree # 4 is a Cedar with a weak fork
and multiple tops. Options are to thin and cable,
to top and keep maintained or remove.
None of the trees were cored or inspected
for root rot, they should be reinspected after any

The City's sewer cleaning records show that the home at this address is
experiencing problems with the venting of some of your plumbing fixtures
when the City crew is conducting cleaning operations of the City sewer line
in front of this address.
The City's cleaning operation is essential for both you and your
neighbors. It cleans debris in lines to prevent plugs, prevents corrosion
and potential future collapse, and achieves a better flow characteristic in
the public sewer lines. We need to do this often -- perhaps even 3 times a
year -- in some critical areas. The City's cleaning operation typically
involves the utilization of a high pressure water jet.
The problem which occurs at the home is the result of a high pressure surge
through your internal plumbing system. A properly constructed plumbing
system is designed to easily vent this additional pressure without any
visible impact at your residence. An undersized venting pipe (or not
having enough vents) cannot handle the pressure surge, and the only release
that's available is then through your toilet (or another fixture). The
Uniform Plumbing Code typically requires a 211 vent, and further requires a
separate vent for each plumbing fixture which is connected to the sewer (a
toilet, a sink, a shower). Your home clearly does not have an adequate
venting system (you either have a 1-1/411 vent, or not enough of them), and
you therefore may continue to experience the pressure surges.
The City does not have a choice as far as discharging its responsibility in
cleaning the public sewer line. It is therefore up to you to take
corrective measures as to how to properly vent your own plumbing system.
The City has come up with two options that will remedy your problem:
Option 1: Upgrade stack vents for toilets and other fixtures which
are experiencing problems to required sizes.

Option 2: Install a clean -out outside of house per attached
specifications. Enclose box so it can vent properly when
excess pressure is put on house lines. This option would be
the cheapest and simplest way of correcting this problem.
At the same time, it would allow access to sanitary sewer
lines if stoppage should occur. This vent clean -out would
allow a place for backup in lines to go before entering your
house and causing costly damage.
The City would appreciate your expeditious cooperation in this matter. The
City must continue proper maintenance of its sewer lines, but we obviously
do not wish to see continued problems occurring on your property because of
poorly designed vents. It is your responsibility to correct these
deficiencies.
We cannot keep notifying you each time we come out to clean the line. It's
up to you to have a plumbing system that conforms to code. Option 2 is a
relatively simple one to construct.

has been investigated by the City Engineering Department, and a conclusion
has been formulated.
