I advised Scott, to make a visual inspection of the situation and call me back. At approximately 10:30, Scott called and said the manholes were backed Up in front of the residence and there was about 3 to 4 feet of sewer inside the lower apartment unit of 19614 80th Avenue West. At approximately 11:00 p.m, Scott Highland, Jim Jensen, and myself started hydraulically cleaning the 8" sewer line servicing 19614 D 80th Avenue West. At approximately 11:15 p.m. the blockage was cleared and normal flow was re-established at 11:45 p.m. We then used two pumps and removed the toilet bowl to try to empty the sewerage water in the lower unit apartment. The owner of the residence left at approximately 12:30 a.m. saying that he would contact his insurance agent and the City's insurance carrier to resolve the liability question. I informed the owner of the procedure required for filing a claim for damages and that he should contact a"commercial cleaning contractor to start clean up procedings at his residence, the following morning. At approximately 1:45 a.m. January 21, 1980, we left the residence and returned to the shop, There is a file folder on this address with recent documents showing the past problem with sewer back up, I therefore suggest that it be required that this resident install a back water valve to possibly eliminate this type of back up and also that the outside drains in the stairwells to be plugged or sealed as required per City code. The previous owners had been advised to install a back water valve. At approximately that same time, the emergency alarm for sewer lift station #9, located on 80th Avenue West and Sierra Drive, sounded and indicated a high wet well. I then notified Moose City Service, the outside contracting service which maintains the sewer lift stations within the City, of the emergency. He advised me that he would proceed to that location immediately. That sewer lift station serves the property at 19614 80th Avenue West, which is a short distance away. At 7:30 a.m. a crew was dispatched to the Hurst residence to make visual inspection of the situation and report back as to their findings. At 7:50 a.m. I'was notified by the crew that sewage was filling the lower unit of the house and that the wet well at the lift station was nearing the top of the manhole. At 8:00 a.m. I proceeded to the residence to confirm the crew's findings. At that'time, Moose City Service arrived at the lift station and began to make the necessary repairs to get the station back to normal pumping operations. My -visual inspection found about 6" to 8" of raw sewage covering the floor area of the lower unit. All furniture and some of the personal belongings were outside. The only thing that remained inside was a water bed. At 9:00 a.m. Moose City Service notified me that the lift station was operating and should return to normal within a half hour. I checked the manhole directly in front of the Hurst residence to seewhat the situation was with the 8" sewer main serving the Hurst property. Noticing that the manhole was still extremely high I became suspicious that the main line itself had become plugged. I then had the Sewer Division crew bring up Unit 40, the hydraulic cleaner, to rod the main line and break up the blockage. The blockage consisted of rocks, grease, and a rag like material which had accumulated due to the down time of the lift station. By 9:45 a.m., normal flow was re-established in the main line. Also, during this time I went inside the lower unit and removed the toilet bowl so that the sewage would drain when flow was again normal. During the whole occurrence, from 8:00 a.m. to approximately 11:15 a.m., numerous conversations were held as to who would bear the respon- sibility and liability with the parties involved. The people involved were Mr. and Mrs. Michael Hurst, owners of the residence, Jack Mitchell, Water/Sewer Division Superintendent, Leif Larson, Director of Public Works, the renter of the lower apartment unit, and myself, Leadman of Water/Sewer Division. It should be noted that the City Insurance Company was notified and a claims adjuster was requested to make immediate inspection of this situation (9:00 a.m.). At 1:00 p.m., Milton C. Gustafson, Claims Adjuster for C.N.A. Insurance Company met with Jack Mitchell and myself to discuss this situation. I advised Mr. Gustafson that he should make a visual inspection and then decide the course of action necessary and advise the City of his findings. At 2:00 p.m. -Mr-. Gustafson met with Mr. Mitchell and myself again and advised us that the liability and responsibility rested solely with the City of Edmonds. He also stated that he advised the owners Mr. and Mrs. Hurst to'go ahead with clean up operations and make repairs. Mr. Gustafson also advised the renter that the City would incur all costs and that he would be provided shelter until his apartment was livable again. Mr. Gustafson advised the City that he would.like copies of all correspondence regarding this claim. C ' ollias has referred the above problem to this office for the purpose of responding to investiga- tions made on your 1�ehalf,. After reviewing the pertinent facts and observing t�e conditions of flooding, we believe that your response to Mr. Co'llias' Claim for Damage has been summary and superficial. While we recognize that some flooding had occurred in prior years, as reported by you, our review of the facts has led us to conclude that the extent of damage on the above date was caused by the fact that the plugged culvert created a condition which had never before occurred on the property, i.e.,-excessive surface flooding. Prior to the above date, flooding of the residencd*at 19614 80th West, Edmonds, was caused by a rising water table, the result of which was minor seepage covering the basement floor area. The installation of a sump pump capable of caring for usual winter storms, adequately solves this problem. During the installation of sewers for the City of ,, Edmonds, Alton Phillips Co. covered the culvert which per--�,,.�, mits drainage of surface waters from Mr. Collias' property and, although notified, failed to correct the situation in time to prevent the damage. The plugged culvert caused an extraordinary amount of surface water to accumulate on Mr. City of Edmonds Page Two June 1. 1967 Collias' property, and eventually it poured over the raised basement stairway and dike surrounding the doors, flooding the entire basement with up to 40 inches of water. To respond that the damage was due to an existent con- dition, is to overlook three important'points. First, the flooding was by excessive surface waters accumulated because the escape culvert was plugged by dirt which Alton Phillips Co. had failed to remove and not by seepage which is, in fact, the existent condition in question. Second, during the winter of 1965-1966) no water seeped into the basement because the culvert was open and surface waters could es- cape. Third, the flooding was not nominal seepage flooding but excessive flooding in that it poured under and around the basement doors. No protection against previous flood- ings could have prevented the damage caused by the 40 inches of water. We believe you should re -investigate the claim which has been filed. We intend to look to the City of Edmonds for resolution of this claim, inasmuch as it is primarily responsible for the sewer construction and the acts of its contractors, and will proceed to adjudicate the filed1claim, if necessary. The city -feels we have a responsibility to the residents to aid them in whatever way possible; and although the city had no responsibility in this matter other than to bring any relief possible to the resident,, we proceeded to pump out the basement. You will note by.the date that this was some time prior to the heavy rains, and yet thebasement had water in it at that time. The previous owner also contacted the city several times regardin g. water.in the basement. On October 18, 1963, he bought 141 feet of tilet which (according to city policy) we installed in the ditch on the west side of 80th Avenue West in front of the residence in an effort to alleviate the', problem of water in the basement. This construction failed to solve the problem.
