Of Pubhc ;vu!— SUBJECT: HEARING ON FIVE LOT SUBDIVISION AT ,'-1-9804 MAPLEWOOD DRIVE (BESELIN/PHELPS) FILE #P-2-80 This item was reviewed by the Planning Commission at the July 9, 1980 meeting. Attached is a copy of the minutes from that meeting. The Planning Division recommends approval of the proposed subdivision with the following conditions: 1) No cutting or clearing of any vegetation from elevation 290 downward on Lot 4 and from elevation 345 down on Lot 1. A tree cutting plan be submitted and approved by the Planning Division before any trees, 8" in diameter or over, are cut, on the remainder of the site. 2) A temporary siltation/drainage plan to be submitted and approved by the Engineering Division prior to any filling and grading. 3) Lot 4 is a flag lot with the front designated as the southeast line, the rear as the northwest line, and the sides as the northeast and southwest lines. The applicant was asked if the walkway is being used as such. and he responded that it is used by the neighborhood children to oet to the woods but those.going to.school use other access. No one else wished to speak, and the public portion of the hearing was closed. Mr. Bowman further explained that the Public Works Director could grant a right-of-way use permit to allow Mr. Hilgers to landscape the property. He said that when he originally discussed the situation with Mr. Hilgers, Mr. Hilgers had expressed some interest in being able to obtain the property, so Mr. Bowman had instructed him that the way to do that was to get the Official Street Map amended and that portion vacated. He said he would not have advised Mr. Hilgers to pursue that particular action if he had known that when the building permit was taken out there was some discussion as to having the builder improve the walkway area. Mr. Bowman did not think that the temporary situation of getting a right-of-way permit and landscaping the walkway would adversely affect Mr. Hilgers, but he thought it would be premature to give the walkway property away as it was very possible that there may be a need for it at some time. Commissioner McGibbon observed that the applicant apparently was willing to landscape the walkway area, but the Planning Division had indicated there may be a need of a walkway there in the future. THEREFORE, COMMISSIONER McGIBBON MOVED, SECONHD BY COMMISSIONER SMITH, THAT ST-8-80 BE DENIED. MOTION CARRIED. P-2-80 BESELIN-PHELPS - Five -lot subdivision at 19804 Maplewood Dr. (RS-12) Access to this proposed subdivison would be by 12th Ave. N. and a cul-de- sac extension of 12th Ave. N. Lot 1 has an existing house and garage on it and is served by a 15' wide private easement for access and utilities. The area of Lot 1 would allow it to be further subdivided into four lots, and Lot 4 could be further subdivided into two lots. Lot 4 is a flag lot --the southeast being designated the front, the northwest the rear, and the northeast and southwest the sides. Although it has 27.200 sq. ft. of area, the Planning Division felt it should be considered as one large lot because of the severe slope on the northwest corner and that a covenant should be required restricting further subdivision of that lot. Lots 2, 3, and 5 are located on steep slopes, but no steeper than in some other developed areas in the vicinity. Before getting into any construction, a grading plan, temporary drainage plan, and -a siltation plan should be submitted. It was recommended that no vegetation be cleared from elevation 290 downward on Lot 4 for protection of the bank, and from elevation 345 downward on Lot 1. The alignment of 12th Ave. N. is not the best alignment but it is the most feasible because the adjacent property already is developed and has a large Tudor house on the eastern portion. 199th St. S.W. borders Lot 5 on the south and has only 10' of right-of-way, with a 15' wide easement adjacent to the north, and It appears that the entire area has access rights via' that 15' easement. Mr. Bowman recommended approval of the subdivision, subject to the following requirements: (1) No clearing of any vegetation from elevation 290 downward on Lot 4 and from elevation 345 downward on Lot 1; (2) All healthy trees 8" in diameter and larger to be retained in the setback areas east of Lots 2 and 5, north of Lots 2 and 3, west of Lot 3, and in the rear/side yards of Lot 4; (3) A temporary siltation/drainage plan to be submitted and approved by the Engineering Division prior to any filling and grading; (4) Lot 4 is a flag lot with the front designated as the southeast line, the rear as the northwest line, and the sides as the northeast and southwest lines; and (5) A covenant will be required restricting further subdivision of Lot 4 because of the terrain. Jerry Saterlie from the Engineering Division reviewed all of the engineering requirements and made the following additional comments: (1) The proposed north/south cul- de-sac will cut into a 30'4' east to west slope; (2) A cliff -like situation occurs on or near the property line of the R. D. Ballard property and the proposed Lot 4. Much of the storm water runoff will find its way to this point during construction. (5) Water pressure in this plat will be less than 50 p.s.i. (6) Future development plan for Lot I should be required, plus plans for obtaining 14% slope or access road to Lot 1. Following Mr. Saterlie's comments. the public portion of the hearing was opened. Jerry Lovell of Lovell-Sauerland and Associates, Inc., representing the developers, said he had no concerns with the Engineering or Planning Division's recommendations. However, regarding future subdivision of Lot 4, he said the applicants wished to maintain a potential for future subdivision of Lot 4. He said he would like to have the plat approved without the restric- tion against future development of Lot 4. He noted that any subdivision is still subject to approval by the City and that it will be a difficult site to develop because of the topography. But he said this is in an area of expensive homes and, as such, can be developed economically. He said someday someone may want to subdivide and should have the right to do so if it can be done in a safe and sane manner. He added that Mr. Beselin presently plans to build his home on Lot 4. Al Bowes, 1031 12th Ave. N., said he had no objection to their subdividing the property but he was interested in the private street that extends east from 12th Ave. as he presently gets a deluge of water from it and the water carries mud and deposits it at the end of 12th Ave. He asked that consideration be given in the planning so all the mud is not deposited on their private road as they have to take care of it. Mr. Saterlie agreed that the private road is a problem, and he said the drainage will not be totally resolved with this development because the road extends from 12th N. to Maplewood Dr. and some work will have to be done in there. He noted that the Official Street Map requires a dedica- tion and with the dedication some ki6d of improvement would be required at the intersection. Because there are people who have access on the road the City could not require that it be barricaded. Mr. Saterlie noted that the poblic right-of-way is only 10' wide and the City has a sewer line and water main in there so it would not be vacated. He said the problem of the road will be partially resolved but not totally as far as drainage and gravel running out to the right-of-way. Mr. Bowes said he felt the City should accept more responsibility for that road as it has right-of-way on both sides of the road. Mr. Saterlie responded that it is not City property, the City only has the 10' to the south of the road, and they have to clean up the gravel around the manhole periodically. With this dedication he said sorne improvement will be made there and there was a good possibility that the major part of the problem will be corrected. Terry Donnelly of 19810 Maplewood Dr. supported the recommendation that Lot 4 remain one lot, and proposed that Lot 1 be divided into only two lots rather than three because of the grade and the questionable easement rights. Johnnie Fosmo of 19824 Maplewood Dr. said she did not think anyone should be able to use the easement road. She said that for eight years motorcyclists have given them problems on the road and it is only 15' from her door. She felt none of the neighbors would object to the road's being barricaded. Bill Meyrino, 1101 12th Ave. N., said it took him years to get an easement from Maplewooa Dr. to his property and he still had an easement which he did not want to give up as it had cost him a lot of money. He said the 10' easement to the City was not only for utilities but for a road and he thought there should be a public access on 199th and the traffic should not be funneled down to 12th N. He said this was some marvelous property and it could be.developed into some nice homes but he thought the property owners and their easemen*s should be given consideration. Dick Beselin, 1027 Cascade Lane, said he expressly intended to build on Lot 4 and the property had been purchased with the sole purpose of building a residence. He said they were interested in maintaining the character of the property, and that it is prime view property. He did not propose dividing Lot 4 at this time or Lot 1. He had not decided what kind of home to put on Lot 4 but the possibility of furt�er subdividing in the future could influence the decision on the kind of home he built. He objected to the proposed covenant which would restrict him from further subdivision. Jim Phelps, 1014 12th Ave. N.. discussed the tree -cutting restriction and said they were willing to go througb the property and selectively trim or remove whatever trees necessary, but because it is prime view property and they were buying it for the view, he EDMONDS PLANNING COMMISSION Page 3 - July 9. 19SO objected to the tree -cutting restrictions. Regarding Lot I he said there is ample room for three lots but they were not asking for anything to be done on it at this time. However, he did not think a restriction to two lots should be considered. He felt if Mr. Meyring wanted to keep the 10' strip open between 12th and Maplewood then he should maintain it and should have been maintaining it in the past years. He said the only people he was aware of using the road was Mrs. Domenici who seldom uses it and Mr. Meyring's son who goes down the road 40-50 mph and sprays the rocks. He said the other property owners would like to see the road closed because there is' access elsewhere. He said Mr. Meyring no longer needed it for access because 12th is developed, and the other owner at the top of the hill has access to Maplewood Dr. He suggested that a compromise be worked out to suit the neighbors regarding the road. Mrs.,Johr. McAdam, 19902 Maplewood Dr.. said she would like to see the traffic curtailed on the road. At this time Commissioner Walker advised the audience that the Commission could not. act on their suggestions but only on the specific issues presented in the application, and those had little to do with the closure of 199th. City Attorney Wayne Tanaka stated that that -is a private easement and the City cannot block it, and the issue for the Planning Commission was whether there was likely to be more traffic generated from this subdivision and what impact that will have on the neighborhood. He said it could be blocke� off by the owners but not to the detriment of any of them. The public portion of the hearing was closed. Mr. Bowman said that Mr. Lovell had a point when he said any future subdivision of Lot 4 would have to be approved by the City, so Mr. Bowman withdrew his recommendation for a covenant to preclude further subdivision of that lot. He agreed that if a number of trees were removed that would be very good view property. But he said if vegetation is removed too close to the bank a problem will be created for the property owner located below. He noted that tree cutting restrictions can be imposed on the subdivision, but once it is recorded the tree cutting cannot be restricted. He said if they were willing to go through and selectively choose clusters of trees to be retained, that probably would be acceptable, but because of the steep nature of the terrain he felt the vegetation should be retained. Commissioner McGibbon suggested that approval be contingent upon an agreement between the Planning Division and the applicant regarding tree cutting. Mr. Lovell said the tree cutting restrictions are imposed only during the course of development and construction anyway, and once that becomes private property there can be no restriction. He said they were concerned with carefully removing trees so as not to cause any slide problems. Mr. Saterlie noted that the Ronald Ballard house was in a serious situation. He said there has been some vegetation grown along the cliff -like bank but some of it has been trampled down by children and some erosion is beginning. He felt that with construction taking place on top there was a potential for problems. He said this was a pre-existing difficult situation which had the potential of a hazard and needed to be taken care of in a responsible way by the developers. He expected some attention given it in respect to a preconstruc- tion drainage plan and at.this point he felt that whatever trees were there were necessary to hold the bank in place, but if some other way of holding the bank could be proven the Engineering Division would accept that. Commissioner Hall asked him if he did not see any problem with a 14% grade road. Mr. Bowman responded that they could apply to the City Engineer for a variance of up to 20% grade, but that would be subject to the City Engineer's approval. Commissioner Hall asked about emergency vehicles. Mr. Bowman responded that as yet there was no exact development plan for the entrance ,Irade, but it should not exceed 14%.
