As yet I have not been given the opportunity to tell anyone what really occurred, except the "staff". If the staff,can transfer the "blame", one must be sure whose perspective it benefits. Therefore, I respectfully ask for a short time to address the City Council and protect my civil rights. The blame game is a diversion and solves nothing, especially when it is inappropriately accepted. I have reviewed your complaints with Community Services Director Paul Mar, City Engineer Jim Walker, and Construction Inspector Lyle Chrisman. Once again, after reviewing all information and talking with staff, it appears that staff has done as much as they are able to do. The City staff does not actually do construction work. We contract out for those services, just as was done with the area in front of your property. Because of the length of time since the work was done, the original contractor is no longer responsible for problems. At this point, I have no idea if we will ever be able to resolve this problem to your satisfaction. Staff tells me that corrections they feel would work are not acceptable to you and feel your recommendations are not feasible. However, as I indicated when we spoke, there is one final process that can followed which will involve an independent contractor. I recommend that you provide me: a writtencurrent estimate from a contractor for the cost to solve the problems you feel need to be corrected; and 2. the enclosed claim form completed by you. These two documents will be evaluated by the City's insurance provider to determine if you have a valid claim. If you do, the cost of the contract work wiH be covered. If they deny the claim, your only recourse would be a legal action against the City. I do not have the ability to authorize work that has not been approved through this process because of the length of time that has passed since the completion of the original project. I want to emphasize you should not have the work done to the drain in anticipation of a satisfactory outcome. If it is denied, you would not be reimbursed except as a result of a legal decision. U 1996 ICE OF YoR OFF Mr. Morrison asked if the City had an Ombudsman who could intervene on his behalf. I stated that I do not believe we have an official Ombudsman at this time, however, I could refer his concerns to the Mayor's Office. He has a concern about the reconstruction of the street in front of his home that took place about 2-1/2 . years ago. He particularly objects to the work performed by the contractor. He asked the question: "Can the City hire a contractor to do this work without telling me?" He mentioned several staff members that he has tried to work with,' however, he indicated he d oes not ever receive a response. (He has spoken with Lyle Chrisman., Jim Walker, Bill Stroud, and left messages for Paul Mar.) Mr. Morrison stated he receives messages that staff will get back to him, however, they never do. He did receive one call from Jim Walker at 7:00 a.m.; Mr., Morrison objected to this cal I because it was so early, he was not home, and Mr. Walker'spoke to Mrs. Morrison who is ill. Mr. Morrison would like someone to take a look at the work that was done by the contractor. He mentioned that three drainage basins were put in to do the job of one. His driveway drained perfectly before the work was done, however, this is no longer the case. Mr. Morrison was promised another basin would be put in, however, he feels this would be ridiculous as it would only be a few feet from a drainage basin that was not put in correctly. He would like to have someone from the City meet with'him and look at the work that was completed, so that he could demonstrate that the work was not done properly. He would like someone to come out who does not have a "vested interest" in this matter (i.e., not Jim Walker, Lyle Chrisman or Bill Stroud). Our last call was the first time Lyle or I have heard you state that you did not give the contractor permission to enter your property. Lyle stated that you had discussions about extending a thin overlay of asphalt all the way up the driveway to keep a consistent appearance and eliminate the possibility of ponding where the.new paving stopped. Lyle also noted that you allowed the contractor to modify the asphalt at the connection to your stairway to provide a smoother transition. City policy is to not allow contractor or City crews to work on private property without the permission of the property owner. Modifications to Divisions 3 through 9 The -following technical specifications shall be modified, clarified, or superseded as described below. 5-04 ASPHALT CONCRETE PAVEMENT 5-04.3(4) Rollers Pneumatic tire rollers shall not be used unless specified in the Special Provisions- 5-04.3(17) Paving Under Traffic Open -trenches within the traveled way or auxiliary lane shall have a steel -plate cover placed over them. A wedge of suitable materials, if required, shall be placed for a smooth transition between the pavement and the steel plate- Warning signs shall be used to alert motorists of the presence of -the steel plates. 5-04.5 Payment Payment shall include tack coat as being incidental to the bid items. Cold patch or temporary patch as directed by the Engineer shall be paid for a two (2) inch thickness per unit measure as stated in the proposal. 6-02 CONCRETE STRUCTURES 6-02.3(l) Classification of Structural Concrete Class 3000 concrete, minimum 5 112 sack (94 pound sacks) mix, shall be used for all concrete work, including extruded curbs, retaining walls, and small structures., 6-02-3(6)A Weather and Temperature Limitations Protection of Concrete A clear, not white, curing compound shall be brushed or sprayed on all exposed concrete immediately after the finishing work. Other protective measures against temperatures, including wind chill factor, below 40 degrees F, and against potential damage due to weather, are still required. 6-02.3(12-13) Construction, Trowel, and Expansion Joints M-1 June 5, 1992 the utility adjustment be left overnight without an -asphalt patch. All patching work shall be performed solely by the prime asphalt contractor responsible'for the overlay work. Patching work is subject to rejection and complete removal if it does not match the texture and smoothness of the new overlay pavement. 10) Adjusting Manholes, Cleanouts and Catch Basins to Grade All manhole and cleanout adjustment shall be accomplished after the final roadway pavement.operation is completed as expediently as possible (see Section 1-05.11a, Substantial Completion) but shall be raised prior to walkway paving. The existing castings and lids shall be brought flush with the surrounding finished pavement surface and an asphalt patch consisting of Class "G" ACP per Manhole Adjustment -Detail shall be constructed. 10a) Water Valve Boxes Existing water valve boxes consist -of cast iron, two-piece, slip -type boxes with covets. Adjustment*requires raising the upper section of the valve box to final grade. Additional riser sections ' may be required to perform the adjustment- Any loose pavement or other ' debris will be kept from dropping into valve box and interfering with the operation of said valve. The Contractor shall remove any and all debris from the adjusted valve boxes to ensure such operational condition. 10b) Adjust Survey Monument Case and Lid to Grade Survey monument cases shall be adjusted to the finished grade of the proposed asphalt overlay surface per the -standard details. 11) Pavement Grinding or Removal Grinding or removal of the existing asphalt concrete pavement thickened edge and other road surface is required as shown on the contract drawings. Grinding will also be required at each end of the project and at side street intersections. Grinding width for thickened edge is three (3) feet and depth shall be to existing road surface. Grinding depth of side streets shall be one and one half (1 1/4) inches. Asphalt grindings from this project may be used as part.of fill in lieu of crushed rock underneath the sidewalk. 12) Asphalt Concrete Pavement Materials The overlay shall be Class "B" "modified" asphalt concrete pavement (AR-4000) consistent with the material specifications identified in Sections.9-02 and 9-03 of the standards - "Modified" shall be interpreted that the aggregate size shall be on the finer end of the size range required for Class "B" asphalt concrete pavement. Minimum compacted thickness shall be-1-51, for each lift as noted in the plans. SP-4 Where indicated in the plans, or as directed by the Engineer, the Contractor shall feather and shim street surfaces, walks, or driveways within street improvement areas to an extent that provides a smooth -riding connection and expeditious drainage flow to -or from the newly paved surface. Shimming and feathering, as required in the plans, shall be accomplished by raking out the oversized aggregates from the modified Class "B" mix. Measurement shall be per ton of modified Class "B" asphalt concrete in place as determined from truck weight tickets deli"vered to inspector' on job site. Tickets for walkway shall be kept separate from all other tickets. 13) Reconstruct Vertical Curve: Sta 14+00 - 17+00 Includes all excavation, 'grading, compaction, haul and disposal of material for construction of vertical cuve and reconstruction of driveways as specified on the plans; also includes prelevel, of driveways. Contractor shall set new survey monument and case in concrete to grade at intersection of 83rd Pl. W. and 83rd Ave. W. with 200th St. S_W_ 14) Measurementand Payment Summar The following is a general summary of pay item descriptions listed in the bid proposal and defined in the contract document - All pay items shall include all costs of equipment, materials, and labor required to make the installation complete per the plans, details, and specifications. Imported materials shown on the details shall be considered incidental to the appropriate bid item. As I told you in our phone conversation several days later, I needed to speak with Noel Miller, Public Works Supervisor, regarding any work the City's Public Works Division would do.on the project and was just able to meet with him last Friday. A summary of the problems you perceived as needing to be resolved with the driveway when we met on August 3, 1994 were: 1. Inadequate drainage of water off the driveway. 2. Poor asphalt surface quality. 3. Unacceptable slope in walking, path between stairway and driveway area. The City does not see any problems with the asphalt surface quality or with the slope between the stairs and driveway. Public Works can -assist with the buildup of water off the edge of the driveway by installing a drainage inlet along the north edge of the driveway west of the sidewalk. If you believe the contractor caused you damage by his action in 1992, you can file a claim form with the City. Claim forms are available from the City Clerk. The Assistant City Engineer looked at the driveway and did not see any structural problems with the asphalt surface. The edge cracks previously noted are most likely the result of extra asphalt placed beyond your original driveway. In order to conclude the subject issue,* would you please send us a letter stating exactly what you think has yet to be resolved to your satisfaction . We would like to set up a meeting with you, Bill Stroud, who is the Supervisor of the Street Division, and Engineering to go over your concerns. The reason for the involvement of the Street Division is that any work to be done will be by the Street Division since the warranty period has expired and concurrence must come from the Street Division. * Be assured, Mr. Morrison, that all calls received by this office are returned within a day or two. Most of the specifications on asphalt pavement are found in the WSDOT 1991 Standard Specifications. You can review a copy of the standard specification in our office at 250 5th Avenue North. Copies of the 1994 Standard Specifications and possibly the 1991 edition are available for purchase at the WSDOT office at 15700 Dayton Avenue North in Seattle. Our last call was the first time Lyle or I have heard you state that you did not give the contractor permission to enter your property. Lyle stated that you had discussions about extending a thin overlay of asphalt all the way up the driveway to keep a consistent appearance and eliminate the possibility of ponding where the new paving stopped. Lyle also noted that you allowed the contractor to modify the asphalt at the connection to your stairway to provide a smoother transition. City policy is to not allow contractor or City crews to work on private property without the permission of the property owner. Any settlement for insurance claims shall be strictly an act restricted to the claimee, the Contractor, and his insurance company. 1-7 March 12, 1992 4 0 CITY OF EDMONDS Modifications to Divisions 3 through 9 The -following technical specifications shall be modified, clarified, or superseded as described below. 5-04 ASPHALT CONCRETE PAVEMENT 5-04.3(4) Rollers Pneumatic tire rollers shall not be used unless specified in the Special Provisions. 5-04.3(17) Paving Under Traffic Open trenches within the traveled way or auxiliary lane shall have a steel -plate cover placed over them. A wedge of suitable materials, if required, shall be placed for a smooth transition between the pavement and the steel plate. Warning signs shall be used to alert motorists of the presence of the steel plates. 5-04.5 Payment Payment shall include tack coat as being incidental to the bid items. Cold patch or temporary patch as directed by the Engineer shall be paid for a two (2) inch thickness per unit measure as stated in the proposal. 6-02 CONCRETE STRUCTURES 6-02.3(l) Classification of Structural Concrete' class 3000 concrete, minimum 5 112 sack (94 pound sacks) mix, shall be used for all concrete work, including extruded curbs, retaining walls, and small structures. 6-02.3(6)A Weather and Temperature Limitations Protection of Concrete A clear, not white, curing compound shall be brushed or sprayed on all exposed concrete immediately after the finishing work. Other protective measures against temperatures, including wind.chill factor, below 40 degrees F, and against potential damage due to weather, are still required. 6-02.302-13) Co nstruction, Trowel, and Expansion Joints M-1 June 5, 1992 the utility adjustment be left overnight without an asphalt patch. All patching work shall be performed solely by the prime asphalt contractor responsible for the overlay work. Patching work is subject to rejection and complete removal if it does not match the texture and smoothness of the new overlay pavement. 10) Adjusting Manholes, Cleanouts and Catch Basins to Grade All manhole and cleanout adjustment shall be accomplished after the final roadway pavement operation is completed as expediently as possible (see Section 1-05.11a, Substantial Completion) but shall be raised prior to walkway paving. The existing castings and lids shall be brought flush with the surrounding finished pavement surface and an asphalt patch consisting of Class uGII ACP per Manhole Adjustment -Detail shall be constructed. 10a) Water Valve Boxes Existing water valve boxes consist -of cast iron ' two-piece slip -type boxes with covers. Adjustment'requires raising ihe upper s - ection of the valve box to final grade. Additional riser sections may be required to perform the adjustment. Any loose pavement or other debris will be kept from dropping into valve box and interfering with the operation of said valve. The Contractor shall remove any and all debris from the . adjusted valve boxes to ensure such operational condition. 10b) Adjust Survey Monument Case and Lid to Grade Survey monument cases shall be adjusted to the finished grade of the proposed asphalt overlay surface per the standard details.' 11) Pavement Grinding or Removal Grinding or removal of the existing asphalt concrete pavement thickened edge and other road surface is required'as shown on the contract drawings. Grinding will also be required at each end of the project and at side street intersections. Grinding width for thickened edge is three (3) feet and depth shall be to existing road surface. Grinding depth of side streets shall be one and one half (1 112) inches. Asphalt grindings from this project may be used as part of fill in lieu of crushed rock underneath the sidewalk. 12) Asphalt Concrete Pavement Materials The overlay shall be Class "B" "modified" asphalt concrete pavement (AR-4000) consistent with the material specifications identified in Sections 9-02 and 9-03 of the standards. "Modified" shall be interpreted that the aggregate size shall be on the finer end of the size range required for Class "B" asphalt concrete pavement. Minimum compacted thickness shall be-1.51, for each lift as noted in the plans. SP-4 Where indicated in the plans, or as directed by the Engineer, the Contractor shall feather and shim street surfaces,, walks, or driveways within street improvement areas to an extent that provides a smooth -riding connection and expeditious drainage flow to -or from the newly pav'ed surface. Shimming and feathering, as required in the plans, shall be accomplished by raking out the - oversized aggregates from the modified Class "B" mix. Measurement shall be per ton of modified Class "B" asphalt concrete in place as determined from truck weight tickets delivered to inspector on job site. Tickets for walkway shall be kept separate from all other tickets. 13) Reconstruct Vertical Curve: Sta 14+00 - 17+00 Includes all excavation, -grading, compaction, haul and disposal of material for construction of vertical cuve and reconstruction of driveways as specified on the plans; also includes prelevel of driveways. Contractor shall set new survey monument and case in concrete to grade at intersection of 83rd Pl. W. and 83rd Ave. W. with 200th St. S.W. 14) Measurement.and Payment Summary The following is a general summary of pay item descriptions listed in the bid proposal and defined in the contract document. All pay items shall include all costs of equipment, materials, and labor required to make the installation complete per the plans, details, and specifications. Imported materials shown on the details shall be considered incidental to the appropriate bid item. .Measurement for storm pipeline on a unit cost basis shall be the actual footage from centerline of catch basin to centerline of catch basin. As I told you in our phone conversation several days later, I needed to speak with Noel Miller, Public Works Supervisor, regarding any work the City's Public Works Division would do on the project and was just able to meet with him last Friday. A summary of the problems you perceived as needing to be resolved with the driveway when we met on August 3, 1994 were: 1. Inadequate drainage of water off the driveway. 2. Poor asphalt surface quality. 3. Unacceptable slope in walking path between stairway and driveway area. The City does not see any problems with the asphalt surface quality or with the slope between the stairs and driveway. Public Works can assist with the buildup of water off the edge of the driveway by installing a drainage inlet along the north edge of the driveway west of the sidewalk. If you believe the contractor caused you damage by his action in 1992, you can file a claim form with the City. Claim forms are available from the City Clerk.
