When we spoke this morning, you indicatcd that you wou)d be able to issue a letter today confirming the
exemption for the laurel hedge requested by the Marshes in their May 26 letter to you. Your preference
was to issue your own letter rather than �Igning the one submitted by the Marshes We will need
reasonable assurance that the unaffected complaining neighbor cannot repeat this exercise. As you know,
the ostensibly affected neighbor to the north has no problem arith the hedge from a visibility standpoint
and would prefer that the Marshes not be required to prune it back ftirthcr. Nonetheless, they have
volunteered to do more pruning in order to appease the City. They hope not to have to prune more that
approximatcly one foot at the comer where view arguably is Impacted.
If, for any reason, you are unable to completc this today, please send me a letter acknowledging that the
deadline of May.! 1 established in your May 13 1=cr to the Marshcs is suspended pending the resolution
of these issues, and that no action will be taken by the City in the interim.

We are writing in response to your letter of May 13, 1999. Your letter notified us of
certain concerns about a laurel hedge along the front of our property and some rocks that
we placed in the parking strip next to the paved surface of Maplewood Drive. As we
understand it, someone filed a complaint with your office about the hedge causing
possible view obstruction, and your staff then conducted an inspection before the notice
was sent to us.
Our attorney, Rick Gifford, spoke with you about these matters on Monday, May 17,
and on Tuesday, May 18, you met with us at our home to further review the situation.
You spoke again with Bob by telephone on May 19. We appreciate the time that you
have taken personally to evaluate these matters.
Our greatest concern is with the laurel hedge. It was planted in 1963, at
approximately the same time that other mature hedges along this segment of Maplewood
Drive were set. As you have seen, it is we] I-estabI i shed and is kept neatly trimmed. It
was a mature hedge when Vicki moved to this address 27 years ago, and we have
maintained it at our cost ever since. We are enclosing with this letter some photos taken
of the hedge showing its current condition for reference purposes. The hedge has not yet
been trimmed back this season. We will complete the trimming described below shortly
after this letter is finalized.
Your notice cited City of Edmonds Community Development Code provisions
prohibiting hedges "in excess of three feet in height across the frontage of property
unless an exemption is approved." We believe an exemption is more than justified in
this instance, and we are asking that such an exemption be expressly granted for our
hedge.
In making this request, we acknowledge that the hedge appears to be wholly or
partially located within the City's street right of way. Accordingly, should the City ever
need to make use of its right of way for sidewalks, street widening, utility projects, or

other street improvements, we recognize that the hedge might have to be removed or cut
back to the extent necessary. We do not dispute that issue.

In this instance, there is no current need on the City's part for the right of way
occupied by the hedge. Rather, the concern is with sight distance along Maplewood
Drive and related safety considerations. Your letter stated that the party who filed the
complaint is unaffected by the hedge, but that our neighbor to the north, C. V Jenkins,
who lives at 19905 Maplewood Drive, is adversely impacted by the hedge when he exits
his driveway. This surprised us, because he did not register a complaint with us, and
because we did not think that the hedge caused any significant view impairment.

After receiving your notice, we spoke with Mr. Jenkins. As we expected, he
informed us that the hedge is not a concem to him and that his sight distance is not
adversely affected by it. In fact, he prefers that we be allowed to maintain the hedge as
we have in the past and that we not be forced to drastically alter it.
The section of Maplewood Drive on which we reside is a dead-end stub street. We
estimate that 15-20 homes are served by this street, including the residences off a private
road that empties onto Maplewood Drive. It is a lightly traveled roadway limited largely
to local traffic, since there is no outlet. Mr. Jenkins lives near the end of the stub where
the traffic volume is lowest. As a practical matter, aside from his own statements, it is
difficult to see how the hedge could create a real problem for him, unless it were allowed
to grow beyond its present size. He is the only property owner along the stub who
arguably could claim view obstruction based on the location of our hedge.
After talking with Mr. Jenkins, we volunteered to trim the hedge back at least a foot
at the corner in order to improve the view up Maplewood Drive. We will continue to
carefully trim and prune this hedge at our sole cost to ensure that it does not become
overgrown or extend to the point that it legitimately impairs sight distance. We are
confidant that should a problem ever exist for Mr. Jenkins, he will advise us and together
we will take care of it. We hope the days of vindictive complaints are over.
As you know, many properties in the immediate vicinity of ours and throughout
Edmonds have tall hedges, trees, rockeries, landscaping, fences, walls, and other
improvements along the frontage, that appear to extend well into the City's rights of way
and to restrict sight distances. In some cases, such conditions exist at intersections or
along busy streets where the hazard is clear. By contrast, our situation is relatively minor
and merits the exemption we are requesting, since no one is harmed and no hazard is
created.
The offending rocks mentioned in your notice already have been moved out of the
four -foot "clear zone." We were unaware such a rule existed and are happy to comply.

In light of the facts and the information that we have provided, we ask that you issue
the requested exemption to allow our laurel hedge to remain in its present size and
configuration, subject to the trimming and pruning that we plan to do as described
above. We will maintain the hedge as reasonably necessary to keep it from encroaching
into the line of sight from Mr. Jenkins' driveway. Please verify the exemption on the
foregoing terms by signing the enclosed copy of this letter on behalf of the City of
Edmonds and returning it to us. Please keep the enclosed photos of the hedge for your
files.
We regret that you have had to spend the City's resources dealing with what really is
a non -issue. If you have any questions or need to discuss this further before proceeding,

According to the records of the Snohomish County Auditor, you are the owner of the
referenced property. The City received a complaint about a sight obstruction caused by
the laurel hedge along Maplewood Drive in front of your property. Afthough the hedge
does -not impact the party making the complaint, the hedge extends considerably into the
public,right-of-way and impacts sight distance for another neighbor at 19805 Maplewood
Drive when s/he backs out onto Maplewood Drive.
The Edmonds Community Development Code prohibits hedges in excess of three feet in
height across the frontage of property unless an exemption is approved. The City
discourages placement of any vegetation that could potentially obscure sight distance
within the public night -of -way. Please tri'm or remove vegetation to restore adequate sight
distance.
While investigating this complaint, the City staff noted that several large rocks have been
placed in the public right-of-way within the "clear zone" near the travel lane. These
rocks must be at least 4 feet from the edge of the pavement and must be relocated as soon
as possible because of the hazard that they create.
If you fall to trim the vegetation and relocate the rocks by May 31, 1999, the City's
Public Works crews will be instructed to correct the safety hazards. If you have any
