ALLEGATIONS OF APPLICANT
POINT 1. The following are the 5pecial circumstances which apply to my property
which deprive me of rights and privileges which are enjoyed by other properties in
the vicinity under the identical zone classification.
My property which comprises 14 acres was originally subdivided with only 16' of access
to serve the entire parcel. It is now my intent to divide my property into two lots.
The required 201 of access and 181 of pavement to serve two lots cannot be obtained
because of the existing land use in the area. So I am asking for a variance to relax
the minimum access requirements to serve two lots. Directly north of my property
there are three lots being served i�y_a easement and a denial of this variance
would deprive me of rights and privileges which are enjoyed by other properties in
the vicinity under the identical zone classification.
POINT 2. The variance I am requesting will not be detrimental to the public wel-
fare or injurious to the properties or improvements in the vicinity of a zone in
which my*property is located because:
The area in which I am requesting the variance will not adversely affect the sur-
rounding properties or the public welfare. We merely want to utilize our existing.
16' of paved access to serve another parcel of property.
POINT 3. If this variance is not granted, an unnecessary hardship will continue
to the owner of this property, the cause of which is beyond his control because:
If this variance is not granted, we will have a 14-acre tract of land in an area
zoned KS IZ,UUU-. When our parcel was created only it! of acc -W93—P7Wtft!rd for.
Now that the area has become developed, there exists both to the north and the
south easements which serve adjoinTng lots, so it is impossible to obtain any addT-
tional footage in order to make the proposed means of access conform to the standards
adopted by the City of Ed . Our hardship would be that we could not develop
our property as others have done using the same amount of access.
POINT 4. So as not to grant a special privilege to me by the granting of this
variance I submit the following conditions to be imposed so as not to cause in-
consistencies with the limitations upon other properties in the vicinity and zone
in which I am located.

on the obtaining of a access road -variance, we find that the
existing 16-foot strip under the Applicants ownership is.sand-
wiched between two.other similar access roads. Having three'.
roads duplicates.paving-and access-reqpirem'ents beyond a reason-
able amount, yet each road by itself provides less than desir-
able'acc'ess. The City,Siandards for 'access have been based on.
a vehicle being able to by-pass.a stalled or parked. vehicle
on the access road. This criteria cannot be met within the
existing 16 feet.
It is recommended that the applicants work with the neighbors
for joint -use of the various existing�access- roads to provide
the minimums as specified in the City Code.

Mrs. Block displayed a vicinity sketch and slides of the easement in
question. The application was in conjunction with a subdivision. Mrs.
Block reviewed the variance criteria, noting that the Code requires 20'
of access easement to serve two or more lots, and this is only 16'. She
said it was the applicant's choice to secure the subdivision and he did have
the potential option of a joint access with the neighbor to the north. She
noted in the slides the present configuration of three driveways which
presents a potentially hazardous situation in the case of emergencies
because of the concrete barrier between the driveways and she con ented
that by adding another lot to this the problem is increased. She read
memora nda from the Fire and Engineering Departments, the Fire Department
feeling the driveways should not be separated, and the Engineering Depart-
ment finding that the 161 strip is sandwiched between two similar access
roads. City standards for access have been based on being able to pass
a stalled vehicle on the road. Mrs. Block recommended that the applicant
work with the neighboring property owners for joint access of the front
portion of the access where no trees would havo to be taken out. The
public portion of the hearing wasthen opened.
Joan Ostolaza stated that as yougo towards the back of the access ease-
ments the Hammersla road drops, so the road cannot be shared. Dr. B. G.
Ostolaza added that the conent divider is only 6" - 8" high and.wide and
would not obstruct vehicles as much as the trees at the back. The public
portion was then closed. fir. Hovde commented that use of narrower
lanes will become inore common as fewer people drive big cars. He noted
that the lanes do afford privacy, and he felt the aesthetics outweighed
-the danger in this matter. He said good lots in this area are scarce
and he would be in favor of the application just on the feasibility of it.

building in question being off the alley. She showed the location on a
vicinity sketch and also showed slides of the site. She said there is
a slope to the site which is causing the problem with the height. She
noted that the zoning code requirement for an accessory building in an
RS-6 zone is for. a 15' height maximum, and the applicant was requesting
a 119" variance from this requirement. He wished to build a garage on
the northwest corner of a sloping site off the alley, the site sloping
from east to west. Mrs. Block indicated that strict enforcement of the
Code would prohibit the owner from constructing the garage which was
proposed to be 14' high on the alley side, and the location proposed was
the most reasonable for access. If recreational vehicles were to be
