Mills Acting Supt. of Public Works SUBJECT: CATHY RICKIE -,215-3RD AVE. N. IS% Cathy Rickie called me on approximately May 1 regarding payment of the $20.00,turn off/on notice she had received.* (When a water bill becomes delinquent, this fee is standard procedure as Jeff indicated per the City Code.) Cathy was going to move within a short time because a contractor was to start construction soon, but made no arrangements to extend the payment period until she moved. A delinquent notice wa's sent out and a promise was made by telephone that she would pay her past due account'by March 21, 1984. (Due date on delinquent notice was March 19, 1984.) Payment was not made and.another letter was mailed to her with no response. Due to this, her water was shut off on April 2, 1984, as we feel she had ample opportunity to pay her account and avoid turn off/on fees. We did not know that notice had been given her to move; we were only handling the account as delinquent and following the necessary steps. I under- stand her concern,.but feel Jeff did follow the necessary steps to clear the account. We always try to work with all customers when possible and will continue to do so. CATHY RICKIE 215-3RD AVENUE NORTH, EDMONDS, WA 98020 i According to our records, Ms. Rickie is the renter of a house located at 215-3rd Avenue North. Several notices were sent to the service address in an effort to collect for water and sewer services provided during the period of December 1, 1983 to February 1, 1984. On April 2, after receiving no payment and in accordance with City Code, Section 7.10.020, the City turned off water service and left a door hanger notifying tenant of action. Ms. Rickie presented payment of her water and sewer bill amounting to $36.26 on April 3. She refused to pay the $10.00 turn-off and $10.00 turn -on charges which are assessed to delinquent accounts acording to Section 7.10.070 of the City Code. After explaining to Ms. Rickie that she had been properly assessed and.is responsible for the turn on/off fees, Ms. Rickie refused to pay the fee. I explained that if she wished to protest the fee, she could present her case to Bobby Mills, Acting Public Works Director. It will be almost identical to Building #9, except it will be a foot higher due to the 100 year flood plain restrictions. He said the comments concerning the dumpster, electrical meter painting, and screening for any mechanical equipment would be taken care of. Natalie Shippen, 1022 Euclid, Edmonds, asked where the sign would be located on the building. Mr. Pederson stated that no information on signs had been provided, but all signs would have to be approved by the ADB. She said she wondered why sign locations were not asked for at the time building approval is granted, since they are a signifi- cant design factor. Mr. Pederson said that was not a requirement for building approval Mr. Hintz responded that very often tenants of buildings are unknown at the time build- ing approval is granted, therefore, the issue of signs must be separated from the issue of the building. Ms. Shippen said that the location of the sign might be known even though the detail of the sign was unknown. Mr. Pederson explained that each sign application is very individual and some people may ask for something that is not in the code. The ADB has the responsibility to review that and grant exceptions if warranted. Ms. Shippen asked if the Board didn't have the responsibility to ask for a coherent sign package in a development such as this. Mr. Pederson said the Board was guided by the sign code. Ms. Shippen said she considered the sign a major design factor, especially in a development of this size, not necessarily the design itself, but the location of the sign is a significant item, and wonders why the subject was not addressed when the buildings started coming before the Board. Mr. Pederson reminded Ms. Shippen that people have the option to ask for variances from the sign code regardless of what the code states or what the Board should say. Ms. Shippen said the lack of a Board approved sign package for the development has resulted in the question of a 14 foot height being adequate. Mr. Pederson pointed out the Board does not have a problem in handling signs. Suddenly, the Board is being told they have a big problem with signs, but that is not accurate. The Board has been given the authority to grant exceptions to the code according to the Board's judgement. The applicant also has the right, if their sign application'is denied, to appeal that decision. Any citizen has the opportunity to appeal any decision of the Board. Mr. Beselin stated that an overall sign plan for the project was submitted and was approved by the ADB. He added that it was stated at the time of the submission before the City Council and he said again that the sign code is not adequate. The Council agreed. The Code does not address specific issues or specific areas. Harbor Square has made every attempt to conform and stay within the sign code. Where there are exceptions or situations that the sign code does not address, their concern has been clear. Mr. Beselin added that he had asked to be made a part of the discussion on the 27th of February to give input from their perspective as to how the signs should.be in Harbor Square. The last thing Harbor Square wants is something that is obtrusive to the neighborhood and to the project. Mr. Beselin also concurred with the statement made by the Board, there is no way to know in advance where a sign will be on the building, whether it will be a single or multi -use building, what color the sign will be, what size or any other factor, since they do not know what business would be occupying the building. Mr. Pederson said, in answer to an earlier question from Ms. Shippen, there is a window requirement on all buildings, a minimum, must be placed where the building can be di- vided up for tenants. Mr. Pederson agreed with Ms. ShiPDen's request to insure there is adequate space provided for signage, so tenants cannot come*to the Board salving., there is not enough room for signs. Mr. Parsons said that in the landscaping, due to the minimum amount of space involved, we have normally required ground cover to be in the planting beds, therefore. he re- commended ground cover in these planting beds of ivy or what has been required in the other landscaping areas. These should be 4" pots, 18" on center to provide adequate coverage. Mr. Finke stated as part of the Master Landscaping Plan, one of the notes read "all beds shall receive English Ivy, 1 gallon, 24" on center unless otherwise noted." Mr. Pederson closed the hearing since there were no further comments from those present. MR. HERMAN MOVED, SECONDED BY MR. ADB-106-83 LA FAVE CONDOMINfUM (BESSIE AND JOHN MCGRAW) - Review of site plan, landscape plan, and elevations for 19-Unit condominium aFM ",07,215, and 221 3rd Ave. N. (RM-1.5) Mr. Finke showed overhead projections of the proposed development as he read the staff review. The site is flat and presently occupied by three single-family residences. Each of the residential sites has landscaping of various trees and shrubs. The site ARCHITECTURAL DESIGN BOARD Page 2 - January 4, 1984 measures about 120 feet by�240 feet or 28,800 square feet. Yehicular access to the building will be from the alley north of Bell St. and West of 3rd Avenue N. The alley is 16 feet wide, which does not meet the requirements of the Community Development Code for the width of a two-way access street or alley serving a 10-unit or larger multi- family dwelling. The alley must be changed to a one-way operation or widened to at least 22 feet to serve the subject development. Changing the alley to a one-way opera- tion will require the action of the City Council. There is also the possibility of application for a variance to have a smaller alley. There is a letter before the City Council at this time but no hearing date has been set. Pedestrian access to the site and building is from 3rd Avenue N. and the alley. The area of the building footprint is a little under 13,000 square feet. The height is 23.9 feet. except for mechanical equipment, which exceeds maximum allowable building height and must be revised to conform to code. There is a stucco exterior, with limited spots of cedar siding. Seven conservatories are provided on both 2nd and 3rd floors. Roofing will be tile or metal. Thirty-eitfttstall underground parking garage, including ten compact spaces and one handicapped space is provided. Thirty-eight spaces are required. Setbacks - seventeen feet on Bell Street; fifteen feet on 3rd Avenue N.: fifteen feet on alley; and 17.5 feet on north side. Lot coverage is almost 45%, the maximum allowable. Nineteen walk lights located at various places on walks. Trash dum.pster with 6 foot high wood screen fence located off of south end of alley. Electrical meter location not indicated on plan. Meter must be painted to match building. Roof -mounted mechani- cal equipment as indicated exceeds maximum allowable building height. It must be re- vised to conform to Code and be completely screened from view. The horizontal cross- section of the elevator penthouse, which is permitted to extend a maximum of three . feet above the maximum allowable building height, exceeds the Zoning Code area require- ments for such cross sections and must be revised to meet the Code. The requirement is that no more than 72 square :feet of horizontal cross-section can extend 3 feet above the maximum allowable height. Mr. Finke's calculations show 98 square feet. The landscaping is indicated on the plan before the Board. One V9" high by 4 foot long double-faced, sandblasted, wood freestanding sign, 2'6" height above finish grade. The word "La Fave" will be in dark blue raised letters on a gray background. The word "Condominiums" and the building address will be in black letters. This sign will be illuminated by two spot fixtures. It will be located near the southeast corner of the site. One V2" high by 2'8" long similar sign will be located near the southwest corner of the site. The lettering and colors will be the same as for the other sign. The Engineering report indicates the parking layout as proposed is acceptable. The maximum grade to be allowed into the garage is 14%. The alley must be paved to its maximum adjacent to the project. The questions of the directional flow in the alley will have t be settled prior to issuance of any permits. A development plan must be submitted and approved, and the appropriate bonds posted prior to issuance of any permits. The staff finds in relation to the question as to whether this project is consistent with the Comprehensive Plan and other adopted City policies, Section 15.20.005(C)(2) states that "stereotyped, boxy multiple -unit residential (RM) buildings are to be avoided." The staff believes that the proposed structure is very massive and bulky and that the stated policy might be better achieved with two smaller structures. The subject development meets the requirements of the Zoning Ordinance, except for rooftop mechanical equipment, and elevator penthouse which was previously mentioned. These items must be revised to meet the Code. There is no evidence that the subject develop- ment satisfies the criteria and purposes of Chapter 20.10.070(A)(4) of the City of Edmonds Community Development Code, which states that "long, massive, unbroken, or monotonous buildings shall be avoided in order to comply with the purposes of this chapter, to allow light and air to the occupants of the development, and to provide spacefor landscaping and recreational facilities." Again the staff feels that the building is long, massive and bulky. Any action by the ADB to approve -the subject development must be contingent on approval by the Hearing Examiner of a conditional use permit for grading; action by the City Council to make the alley one-way or dedi- cation and widening of the ally as required by the Engineering Department for two-way operation; or a variance of that from the Hearing Examiner; and. revision of all roof- top items to conform to the Community Development Code. Mr. Finke passed around a colored rendering of the project. Warren Otteson, the owner's representative, 7935 Lake Ballinger Way, Edmonds, intro- duced Mrs. Bessie McGraw and her son and wife, Mr. & Mrs. John McGraw. the applicants; and, the project architecti, Mr. Larry deMers. Mr. Otteson said there had been three meetings with the staff and complimented the staff for their cooperation. In examining 3-4 options on the property . the staff had.only recently indicated that the final design was a problem as outlined in the staff report. if one is looking at the repro- ductions of the elevations that were supplied with the drawings, one could hurriedly construe that the building is long and massive. However, we have built this building in keeping with sound environmental considerations, with the traffic situation con- sidered, -and in keeping with your ordinance. Mr. Otteson pointed to a portion of the building on the colored rendering as the portion which may have occasioned the objec- tion of the Planning Department. The building is 23 feet 9 inches high, the Harbor ARCHITECTURAL DESIGN BOARD Page 3 - January 4, 1984 Master is approximately one and a half feet higher, as is the apartment on the end of the block. Light and air circulation between the two structures is 17.6 as reported by Mr. Finke. but there is an additional 7 feet between the actual structure, giving an actual 24 to 25% open area between the existing building and the proposed building. The building has been articulated throughout. The word stereotype generaly has the connotation and definition of a structure containing little variation. We believe the building does meet the overall code of disigning a building in keeping with the sur- rounding structures as mentioned in the Code. Mr. Otteson read from the Code "design and construct homes with architectural lines which enable them to harmonize with their surroundings, adding to the community identity and desirability. Minimize en- croachment on view of existing homes by the new construction. Require the new resi- dential development be compatible with the natural constraints of slope. soil, geologi- cal,.vegetation and drainage." Mr. Otteson said they believe they have subscribed to those goals and purposes. Finally, the owners asked that a very contemporary, cement building or modern building not be designed, but one in which the owners can live. The property has been owned by them and they have been residents in the community since 1915. The owners are located on the site presently. The development has been a dream for some time and the owners hope to see the dream realized in 1984. Mr. Otteson indi- cated that the colors and finishes of the building were very closely depicted in the artists's conception. have been pre -selected; stucco color trimmed in soft blue -gray. The rust color was the artist's concept of drapes in the building, but drapes of this color are not planned. After the fourth review with the City staff. when Mr. Otteson became aware of the issue reported by the staff. the application was removed from the December agenda. A study of the request now before the Board to split the project into two buildings, proved that the cost of each unit would be raised approximately $11,000 or a total cost of an additional $175,000 for the development. Mr. Otteson could not advise the McGraw's to proceed because the economic impact on the project would almost preclude its success. Mr. Otteson asked the Board to consider the application for approval. Mr. Pederson asked why an application for final approval was before the Board, rather than for preliminary approva�. Mr. Finke replied that a suggestion had been made that a preliminary approval be requested, but the applicant had asked for a final. Mr. Otteson replied that they were told the first response by the City would be from the ADB. He also said a suggestion was made that the City Council be approached on the subject of the alley being made one-way. They believe there is support among those affected for making the alley one-way. There was some discussion as to whether the application should be preliminary or final approval. Mr. Otteson asked that the application be considered a final approval. Larry deMers. AIA, 1250 Bank of California Center, Seattle, stated that the elevator penthouse could conform to the required area. Lenore Collins, 200 2nd Avenue N., Edmonds, asked if this were high or low density? Mr. Finke replied that it was high density multiple, RMI.5 (1500 square feet per dwelling unit). Ms. Collins then asked what the square footage was for low density multiple? Mr. Finke replied it would be 3000 square feet/d.u. Ms. Collins said she does not consider the building bulky or stereotyped, but very attractive. To split the building would cost the developer extra and would leave a narrow, dead space, leading from 3rd Avenue to her parking space at the Harbor Master. There would be an area at night where people can gather; now, people are going up and down the alley and getting into the Harbor Master. The narrow space would not be a safe feature. She feels the safety factor would cancel out this idea. The size of lots are not ade- quate for two buildings and she objected to the space between two buildings. The direction of alley traffic is also of concern to Ms. Collins. At this time, there is a lot of traffic in the alley and the alley narrows at the North end which concerned Ms. Collins. Harley O'Neil, 21801 Nootke Road, Edmonds, stated that he is a partner in the building to the north of the projected building, which contains 20 units on a lot that is approx. imately one fourth the size of this project. The building was erected at a time when Codes allowed a higher structure and allowed more units per square foot. He said he believes that 19 units is less than would be allowed by Code at present. Upon first learning ofthe project, he said he was impressed by the attractiveness of,the desion and believes it will blend in with his building, which is stucco. He said the alley is very narrow, and traffic from both the north and south cannot be accommodated. A pro- posal of one-way traffic to the north will be supported by their partnership. He disa- greed with the findings that this would be a massive structure. He said as property owners to the north of the project. they are supporting it and hope the ADB will do the same. In response to a question from the Board, Mr. O'Neil said their garage entrance is from 3rd Ave. but they exit by way of the alley to save backing out unto 3rd Ave. Ron Johnson, 2360 N. W. 204th. Seattle, spoke in favor of the project. Mr. Johnson does not believe the proposal to split the project into two buildings would get away from the mass or bulk of the project. In addition, putting two buildings there would ARCHITECTURAL DESIGN BOARD Page 4 - January 4, 1984 place the buildings closer to the street on Bell and closer to the buildings on the north side, and would create an area 10-:15 feet wide and 24 feet high like a tunnel between them. Movtng the buildings closer to the street and other buildings would create a greater effect of bulk. The site plan now provides for an open area for ped- estrian use at the corner of 3rd and.Bell, Two buildings would make it necessary to take up a lot of that space, Space has been allowed in the rear to alleviate builki- ness by excavating for parking. He believes the design has taken into account the problem areas and provided a good solution. J. Ward Phillips, 522 Dayton. Edmonds, wanted to continue what two others have done, who have adjoin-ing property to the project. He pointed out that one building is a rectangle and the other is approximately a square, both built when 35 foot height was allowed. The block is high density and is almost entirely at the 35 foot height. There is no height problem with this building. there is no mass that will appear from the building, it will appear secondary to what is already built. The immediate silhouette of the building behind it, to the west. is taller and is the predominant building on the block. Whether you leave this building as one or cut it in two, it will not be seen. it is not the dominant feature of the block. If the property stood alone, it could start to sound heavy, but he said he does not see anything heavy about the building, considering it an outstanding job, an example of what.he likes to see going on in town. He said there are examples of buildings that have been divided in two like the one on Maple Street. and the division did not relieve anything. The build. ing is huge and overbears on a person when walking by, with the first 10-15 feet solid concrete, right up against the street. it is long and there are no movements in the building. The building was cut in half, but that did not serve a purpose. He expressed concern with the idea that is current that buildings must be cut in half. He said he believes this project fulfills the Code and the architect has done an out- standing job on the way they have designed the building, He said he had gone by the property on Maple Street for over 25 years and has watched the changes that have taken place. He said the McGraws will be owner -occupants, their family going back three generations on this property. They are not developers. He believes they are trying to create another asset for this town. He urged approval of the project. He added that the alley is a problem, but that is not caused by this design. Whether this development is approved or not, the alley is a problem. He said the alley needs help and it is a City problem since it is a legal alley. In going to the City Council, they are trying to relieve the problem. He thanked the McGraws for what they have done so far, and hopes the project will go forward. Mr. Otteson commented that they are proposing taking the overhead utilities and putting them underground. substantially cleaning up the alley. Dode Peterson, 325 Walnut, Edmonds, stated she had been a resident of Edmonds for 25 years and is interested in its progress and thanked the ADB for the care and consider- ation in what they have done for the City. She said people go from one extreme to the other in protecting the City, saying we do not want any more bulk, no more large cement buildings. etc., until a fault is reached and they start saying let's have a couple of smaller buildings here and let's cut this one up. To say that the proposed building is anything but a beautiful structure that will upgrade the downtown area would be a mistake. She expressed her hope the ADB would take into consideration all that had been done in carefully placing and planning the building. and cleaning up the alley. As a resident and neighbor of the building. she hoped the ADB would con- sider the building very carefully. Mr. deMers commented that the owners had committed to spend a great deal of money to put the parking spaces underground. As a result of that decision, there is 39.8% landscaped area. In Section 20, he quoted "to comply with the purposes of this Chapter, allow light and air to the occupants of the development, and provide space for landscaping and recreational facilities." He said the building project complies with this aspect, in his opinion, in that all parking is underground allowing more landscaping than if that had not been the case. Mr. Hintz asked the staff and legal counsel if the zoning ordinance allows primary access off alleys? Mr. Finke replied that the ordinance does allow for this. Mr. Parsons asked if the alley were a public right-of-way and what the right-of-way space was. Discussion followed among Board members regarding current use of.alleys for access by high density buildings, Mr, Tanaka, City Attorney. explained that there is no difference between streets and alleys used for access, The only difference lies in the width of the right-of-way and pavement width. An alley must meet the right-of-way and pavement width provided in the Code. he said, and this is what is going before the City Council. Mr. Hintz commented that he is, ordinarily. impressed with the acuity of the staff in interpreting the design aspects of the Code. How- ever, in this case, he finds the proposed building attractive and meeting the require- ments of the Code and would be concerned if the building were required to be split in two. He added that it is an articulated building, not boxy or stereotyped. ARCHITECTURAL DESIGN BOARD Paqe 5 - January 4, 1984 Mr. Herman asked, if the buildi'.n_o could,be built, should -the Cit ' v deny the development's request for a one-way street? In response, Mr. Otteson said there would be a problem if the alley must be widened to 22 feet. Mr. Parsons said the vehicular access can substantially change the lay -out of the site plan, since it could modify the actual ingress and egress, which in turn would modify the building and in turn could modify the landscaping. He stated he could review this as a perliminary plan, but felt reluctant to approve it as a final plan. Mr. Otteson said they do not like what they foresee happening if the alley request is not approved. The ramp of the parking garage would move forward, to gain adequate width -in the alley for two-way traffic, a section of the building would be moved for- ward (indicated on the colored rendering of the building). He also said there was too much traffice on 3rd Avenue to access the parking from ihat street. Bell street, he said, is another alternative; they are looking carefully at the aesthetics of the corner. Mr., Beck asked for the distance between the street and the leading edge of that portion of the building that would be moved if the alley were widened. Mr. Otteson said the building would have to be moved forward 6 feet, leaving 17 feet. Mr. Otteson asked for the approval of the application subject to the considerations that have been mentioned by the Board to enable them to appear before the City Council. Mr. LaFon said the entry is not in character with the building. Mr. Otteson said there would be double doors and slit windows on each side of the doors. Mr. Otteson, in response to inquiry from Mr. LaFon, said the triangular decks off the bedrooms were more ventilation decks rather than a functional deck. Mr. LaFon suggested that a request for a setback adjustment would allow the decks to stick out 2-3 feet giving better useage and would also break up the mass of the building. fir. LaFon also asked what the detail was between the stucco and windows. Mr. deMers replied it would be a thermo break aluminum window, an insulated glass and would probably be trimmed out with a.shadow strip of wood or a U-shaped aluminum to emphasize the strength of it. Mr. LaFon said he did not believe there was a problem with the elevators, since there are handicapped elevators that require I- Ik foot run and would only stick out the roof that much. 11r. Pederson asked if the green houses would be built one over the other? Mr. deMers said they would cantilever about 18" out from the building in the front, and pointed out the detail on plans before the Board. Ms. Collins said there are no 2-way alleys in Edmonds. If the approval for the project is dependent on whether the alley is one-way or not, you cannot withhold approval for that reason, that is the City's problem, and the alley cannot be made into a 2-way alley. Mr. Phillips said he was confused by the procedures the Board was sharing, in the sense that the Alley is a Code situation, does not understand what the design of the alley has to do with the ADB. In addition, he said, if the Board gave final approval, and something was changed in the building, would the applicant not have to come back to the ADB for approval of the change. If that is correct, Mr. Phillips said, the appli- cant is appropriately asking for final approval. If the Board prefers that a prelimi- nary approval be sought first, Mr. Phillips does not believe the community is aware that that procedure is in effect. Mr. Pederson replied that the Board does like to see a preliminary in order to comment on the project, in order that the applicant can appear before the City Council if necessary, and when that is all accomplished the applicant may appear before the ADB for final approval. Mr. Phillips said he thought it would be helpful if that procedure could go out through City Council resolution to clarify the general understanding. He added that he would encourage that procedure but did not think it was a mandatory requirement and asked the City Attorney if the applicant is allowed to be present for final approval. Mr. Tanaka replied that they could ask for final approval at this time; the Code provides for an option in that the applicant may ask for preliminary approval and receive comments and advice from the ADB to save spending -money for plans that may not be acceptable to the Board. He added, there is currently no requirement that a preliminary plan be submitted before final approval can be given. However, the Board does not have to give final approval Just.because an applicant asks for it. Mr. Pederson closed the Public Hearing. The areas needing repair have been marked in paint on the sidewalk adjoining your property. Reconstruction permits must be obtained from the Building Department at 501 Bell Street within 30 days upon receipt of this certified letter. The fee for the sidewalk repair has been waived by the City of Edmonds. In the event these improvements are not completed within ninety (90) days upon receipt of this certified letter, the City will employ a private contractor to perform the designated repairs and the City will bill the abutting property owner. This action is in response to many citizen requests and pedestrian falling accidents which have been increasing in recent years as a result of sidewalk deterioration and increased pedestrian traffic.
