Because the request involved closing a public alley, a public hearing was held on August 29, 1983, to take public testimony. Mr. Bennett testified that the Applicant has experienced a lot of vandalism and he wishes to fence his property to the South along with the alley to reduce the amount of exposure to the rear of his building. 4. Mr. Lovell testified that the alley was quit claimed to the City a number of years ago. The specific alley was . claimed on February 8, 1905. The request i s si m ply to beePult applicant's security. 5. Mr. Shepherd testified in opposition to the request. He felt that the reports of vandalism were only recent occurrences and that the instigator has since moved from the neighborhood. Further, closing the alley would deprive the public to use of dedicated right-of-way. He indicated that he uses the subject alley daily. 6. Mr. Shepherd testified that the Applicant could fence his property in a manner which would not necessitate closing alley. 7. Research of Police records indicates a malicious mischief offense occurred on June 12, 1983. An earlier offense occurred in May, but was not reported to the Police. 8. Mr. Robertson testified that he was concerned about fire -safety and wondered if the requested action would limit the Fire Department's access. 9. The request was reviewed by the Fire Department and a recommendation to deny the request was made because of the potential problem of access to the rear of the building. This recommendation even considered a gate across the alley. CONCLUSIONS 1. It would appear that closing the alley with a fence could hinder the Fire Department's access to the rear of the Applicant's building. 2. The alley is presently used by the public. To close the alley would not be in the public interest. 3. Other alternatives exist to secure the subject property. 4. I strongly oppose the proposed vacation for many reasons, among which are: 1. A municipal corporation has no proprietary'rights in public* grounds within its territorial limits; whatever rights it has in them are held merely in trust for the -public.' It - has also been held that a municipal corporation is, as to property acquired by it in its proprietary-capacity,'a trustee for the inhabitants of the territory embraced within -its limits. Under constitutional and statutory provision that'all public improvements and municipally owned utilities are public property with title vested not in the municipality as a corpo- rate entity, but in the public, it follows that the municipal- ity in its corporate capacity strictly speaking does not own such improvements and utilities, and has no title to them. They are owned by the public. . 2. There would be no benefit to the public and in par- ticular to the nearby property owners. 3. It appears that there is 1,920 square feet of land which, if valued at a minimum of $20.00 per square foot, means that the proposal would benefit the petitioner to the extent of some $38,000. 4. 1 do not know of any public safety reports or approval or disapproval on the proposal. I can foresee that from a fire department position vacating the property should not be recommended. We have had one total destruction fire on the same alley approximately two years ago. It appears from my observation not only the abutting property owners use the alley but also the owners in the nearby alley who use the al -ley for through traffic between Second and Third Avenues. This includes trucks, deliverymen, garbage disposal equipment, etc. 6. This alley was dedicated as a *part of the original plat of Edmonds and should be maintained as such. My feelings are strong on this point and will be followed with legal action to maintain it if it' is required. The two most important items to be accomplished are the following: 1. Installation of a Sprinkler System --Both have bids from sprinkler companies and have indi- cated that they intend to comply with our requirements as soon as it is financially p o s s i b I e . 2. Proper Storage of Peroxides --The peroxides are being separated from items that they can react wi.th at both businesses by providing separate approved storage lockers. We have contacted the Department of Labor and Industries about compliance with WISHA at these two businesses. Both businesses have been inspected and the only infraction was an excessive amount of airborne particle matter at Marvel Marble.
