I have reviewed your account and will allow a credit for the billing period of
August 11, 1994 thru October 14, 1994 in accordance with our City policy. The policy
states that the customer will be billed at the retail rate based upon the average water
consumption for the same period during the previous year. In addition, the excess water
lost from the leak will be billed to customer at the City's wholesale rate with a 15%
surcharge added for administrative cost. Only one leak credit will be granted in any three
year period.

CONTRACT TERMS
1. Disclaimer and Waiver
Customer understands and acknowledges that buried lines, pipes, and similar objects may not be subject to readycletection dueto
local soil conditions and other factors beyond the control of Underground Detection Services, Corp. Underground Detection
Services, Corp. agrees to exercise reasonable efforts to locate, lines, pipes, or similar objects beneath the surface of the ground,
but gives no assurance, warranty or guarantee, express or implied, that it can orwill locate any or all such lines, or similar objects.
Customer expressly waives, now and forever, any and all claims andcause of action thats/he has or may later have arising out of
Underground Detection Services, Corp.'s failure to locate lines, pipes, and similar objects beneath the surface of the ground.
Customer further understands, ' acknowledges and agrees that the agreement by Underground Detection Services, Corp. to
attempt to locate such lines, pipes, and similar objects is expressly conditioned upon Customer's waiver set forth herein.
UNDERGROUND DETECTION SERVICES, CORP. DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, THAT IT
CAN OR WILL LOCATE ANY OR ALL LINES, PIPES OR SIMILAR OBJECTS LOCATED BENEATH THE SURFACE OF THE
GROUND.
2. Limitation of Damages
In the event that customer suffers damage of any kind as a result of Underground Detection Services, Corp.'s failure to locate any
or all buried lines, pipes, or other objects, whether or not contracted for, whether by negligence or otherwise, then in that event the
parties hereby agree that damages recoverable from Underground Detection Services, Corp. shall be limited to customer's actual
damages incurred or the contract price set forth on the reverse side of this agreement whiche ' ver amount is less. The parties
further agree that such damages shall be deemed to be liquidated damages, and shall be Customer's sole and exclusive remedy.
3. Fees
Customer acknowledges and agrees that all charges set forth on the reverse side are fair and reasonable. Customer agrees to pay
all such charges not later than: (a) Thirty (30) days from the completion of service, or (b) the date of billing, whichever first occurs. A
service charge shall accrue on the unpaid balance from the date of billing at the rate of Eighteen (18%) percent per annum (1.5%
per month) or the maximum rate allowable by law, whichever amount is less, which shall be added to any balance remaining
unpaid thirty (30) days after the billing date.
4. Collection Costs
In the event Customer fails to pay all or part of the fees and service charges imposed herein, Underground Detection Services,
Corp. shall be entitled to recover from Customer all damages available at law or equity, along with all attorney's fees and cost of
collection and suit incurred by Underground Detection Services, Corp. in enforcing its rights herein.
5. Corporate Approval
Customer understands that this Agreement shall not become binding upon Underground Detection Services, Corp. until approved
by Underground Detection Services, Corp.
No salesperson, firm.or corporation is authorized to agree or assume for Underground Detection Services, Corp. any liability in
connection with the services to be provided hereunder that is different from the terms set forth herein.
6. Governing Law
This agreement shall be governed and construed in accordance with the laws of the State of Washington, and jurisdiction and
venue shall be King County, Washington.

Here is a copy of the invoice we received from the company
that detected the leak in our water pipe.
It was found underground, under asphalt. Water did not show
anywhere above ground. We were unaware of the leak until
September 14, 1994 when there was a hanger on our front door.
The meter reader stated that we were using an unusually high
amount of water and that there may be a leak.
We have repaired the leak.
