SUBJECT TRACT. This easement shall run with, touch and concern a tract of land previously known as Tract 10 of East Edmonds Acres, Division II, as recorded in Vol. 12, Page 66, of the records of Snohomish County, and subdivided into lots 1 and 2 according to a short plat thereof, City of Edmonds Record No. S-5-86 and . recorded at Vol. 2-2-, Page C4.1, of the records of Snohomish County [hereinafter "subject tract"]. 2. EASEMENT. purposes: The easement created shall be for the following a. Ingress and egress, as well as the maintenance of a private road as hereinafter described, surface and subsurface public and private utilities duly franchised or operated by the City of Edmonds, as well as additional public utility structures including but not limited to a storm water drainage and/or retention/detention system with connecting catch basins and other attendant facilities. 3. DESCRIPTION OF EASEMENT AREA. The above described easement shall exist over, under and along the north 25 feet of the east 236.1 feet of tract 10, of East Edmonds Acres, Division II, as recorded at Vol. 12, Page 66, of the records of Snohomish County, and further subdivided by short plat S-5-86 and the lots 1 and 2 thereof (the subject tract) . 4. JOINT MAINTENANCE AGREEMENT. It is the understanding and intent of the parties that a public road and drive be constructed in accordance with the standards of the City of Edmonds and maintained in accordance with such standards. as Said drive shall be maintained by the present and future owners, heirs, devisees or assigns of lots 1 and 2 of short plat S-5-86 in accordance with the rules herein set forth. b. The storm water run-off.system shall be constructed and maintained in accordance with the standards established by the City of Edmonds and at a minimum, shall be kept clean and clear of debris and in a condition such as to permit its uses for the purposes for which it was designed. C.. All maintenance, repair, improvements and/or the rebuilding of facilities constructed in said easement shall be the obligation of and at the cost of the EASEMENT/JOINT USE MAINTENANCE AGREEMENT - 2 owners of said lots 1 and 2 of S-5-86 and all Costs Of maintenance, repair, improvement or rebuilding shall be born by said owners unless or until accepted for dedication to public use by the City of Edmonds. The costs thereof shall be apportioned equally between the owners of lots 1 and 2. d. Either party, or the City of Edmonds for whose benefit this Agreement has been executed, may trigger the conditions hereof by forwarding written notice to the other owner or owners of the lot, charging them with maintenance, repair, improvement and/or rebuilding in accordance with the terms -of this Agreement. In the event that the other party fails to respond by providing its share of costs in advance and/or by contracting to bring about said maintenance, repair, improv ement and/or rebuilding, the other party and/or the City at its sole option, may proceed to effectuate said repairs. Upon completion of such an improvement, .the reasonable costs thereof may be filed in the form of an affidavit with the Auditor of Snohomish County, and upon filing, shall constitute a lien against the tract or tracts who have not participated in thecosts of said maintenance, repair, improvement and/or rebuilding. e. It is the stated intention of the parties that this Agreement shall touch and concern the land and EASEMENT/JOINT USE MAINTENANCE AGREEMENT - 3 shall run with it to the benefit and detriment of future owners of the subject tract. 5. EXTINGUISHMENT OF EASEMENT. It is the intent of the parties that the Easement and Joint Use Maintenance Agreement herein created shall run perpetually with the land and may not be extinguished by the action of the owners hereof without the express written consent of the City of Edmonds.
