Whenever any portion thereof has been damaged by fire, earthquake, wind flood or by any other cause, to such an extent that the structural strength or stability thereof is materially less than it was before such catastrophe and is less than the minimum requirements of the Building Code for new buildings of similar structure, purpose or location. 12. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a harbor for vagrants, criminals or immoral persons; or (iii) enable persons to resort thereto for the purpose of committing unlawful or immoral acts. e Incorporated August 11, 1890 0 Sister Cities International — Hekinan, Japan Mr. & Mrs. Odell Mr. & Mrs. Barger Page Two August 1, 1994 The specific violations existing on the above property is: A fire occurred at 20422 79th Avenue West on May 22, 1994, which damaged the structure thereon to the following extent: roof area collapsed and/or exposed by fire. As a result, the life, health, property and safety of the public is endangered. The structure is uninhabitable and otherwise meets the definition above of a dangerous building. An inspection of the premises by Jeannine L. Graf, acting building official on May 24, 1994 revealed the following specific conditions: Salvage of personal possessions from the structure had begun. A demolition permit has not been obtained, nor has any repair of the structure been initiated. A trailer was placed on site for security purposes until demolition work was complete. The building official has determined that the fire damaged structure on the above premises must remain vacated, that all necessary demolition permits must be obtained by September 2, 1994 and that the fire damaged structure must be demolished by October 3, 1994. Failure to initiate the above action by October 3, 1994 will subject you, as the property owners, to prosecution by the City as provided in the Uniform Code for the Abatement of Dangerous Buildings, which may include: 1. the building official may proceed to cause the work to be done and charge the costs thereof against the property or the property owners; and/or, 2. the building official may impose civil monetary penalties in an amount of $ 100.00 per day until compliance is achieved, pursuant to Edmonds Community Development Code Section 20.110.040. The cumulative civil penalty shall not accrue during the pendency of the appeal. If you do not appeal this notice of violations and order, your failure to do so will constitute a waiver of all right to an administrative hearing and determination on the matter. A reinspection of the property has been scheduled for September 2, 1994 and if the corrective action described in this Notice of Violation and Order has not been taken by that time, the City will proceed to take the action as described above.
