preparing a Development Permit
Application for the City of Edmonds prior
to his/her submival of a development
permit to the City.
1lie purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. Ile
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or hisl4pr representative,
must fill out the checklist, sign and date it,

I ' am a concerned neighbor of a construction pr*oj'e'ct undertaken.in the 204 - - bloo6k of 88th AV. West. It
ismy belief,, the front house being constructe . d . by Cascade Homes (Tim Collins) from Puyllup, encroaches
into the front setback by several feet. My observation is strengthened by the City records of my property
line location, my own survey knowledge, and the neighbor's front property line to the North of the
construction.
I contacted Jerry Saterly of the City's Building Dept. who,asked the builder to prove his property comers
with a letter from his surveyor. Mr. Saterly's first request to verify property comers caused someone to
move the NW. comer stake approximately 5 feet West of its former (original) location. I explained that
observation to the inspector when I saw the new flag. I believe the result of the inquiry will render the
house too close to the street. My question now is, what action the city can take to correct this situation?
. Mr. Collins, and his out of town crew have violated several ordinances to date. The city has record- His
cavalier attitude towards the neighbors and City is again being displayed with the stake movement issue.
He has told us he intends to rent these houses. He has allowed work to take place both before and after
work hours on weekdays and weekends. He had his crews use my water for dust control because he
otherwise would have had to stop work The month long period of dirt work caused us all kinds of out of
the ordinary clean up. Then when presented with a bill, he employed his lawyer to confound the issue.
He paid little or no attention to our requests to produce something more suited to the property (and
neighborhood). The fact that his front house is too close to the street cannot be allowed. This is a clear
violation of design law!
We have been very active and. involved with the city to ensure our neighborhood development is to a
quality.it deserves. We have attended and'testified at numerous Council meetings and were active in
helping design the L.I.D. for the 88th St. imprioviemeitt.'We live'here and want the neighborhood to

remain attractive. I brought this issue to the city's attention at once when I made my observation. I hoped
that work could stop until a correction was made (removing the encroachment). I am now getung
uncomfortable with the feeling that if left until the time for occupancy, this clear violation will be "swept
under the rug" as an unfortunate error. The Hearing Examiner will grant a variance and the builder will
get away with it.
The reason I am writing at this time is to notify the City' inspection and enforcement divisions to prevent
that cure from happening. It is my hope that the City will flex all of its jurisdictional muscle to demand a
correction to this violation that puts this builder back within his legal building envelope.
Our street has a close neighborhood feel. It incorporates homes of various sizes and ages. All of them,
until now, have complied with the zoning and setback guidelines. More builders are entering into
construction activity on 88th- Hopefully, their product will enhance our street and help create the kind of
block we all can enjoy living on. I know the City cannot restrict what the contractors produce. It can,
however, assure that its construction rules are followed. This one house protruding beyond the envelope is
a mark down for the entire neighborhood.
