I represent G & L Enterprise, partnership, with respeot to its
application for d building pe i rmit on the above referenced lot. As
-1 understand it, the City has tentatively taken the position that
the above referenced lot is not a legal building site and mmy not
be developed except in conjunction with the adjoining lot. While
this matter hat5 just been brought to. my �Lttention, and I have
therefore not had an opportunity to rully explore the Issue, it
would appear that this tentative conclusion is incorrect for at
least the following two reasons:
1. Section 17.40.030 B Of the Edmonds Land Use code unequivocally
states that an undersized lot may be developed consistent with
applicable site use and development standards.. That is precisely
the case with respect to the above referenced lot. The above
referenced lot is smaller than the 8,000 square feet normally
required in the zone in which it is located. However, the
building permits 'that have been submitted indicates that the
proposed dwelling unit will comply with all applicable site use and
development standards. As a result, the above referenced property
is a legal building site under the above cited provision. -
2. Even if paragraph B of §17.40.030 of the Edmonds Land Use Code
did not apply, it would appear that paragraph C of that same
section makes the above referenced lot a legal building site. A
review of the real property records of Snohomish County indicates
that for certain periods of time since this lot became non-
conforming as to nize (1982 as I tanderstand it) it has been in
different ownership from the adjoining lot. As I read paragraph C,
this therefore qualifies the'above referenced lot for status as a
legal building site. This conclusion regarding my reading of
paragraph C is strengthened by the recent amendments to that

section enacted by the Eftonds city Counoil which removes the words
"at any time" from the beginning of the paragraph. This removed
any ambiguity regarding the meaning of that section and made it
clear that the section granted legal building status if the subject
property and the adjoining property had been in different ownership
at anytime since the code changed to make the lot substandard in
terms of size,
We reserve the right to provide other or additional information and
basis to support our position once we have had an opportunity to
more fully explore the relevant 'facts and law.
My clients would like to gat this matter resolved as quickly as
possible. I encourage you to discuss this matter at the earliest
possibla time with the appropriate City officials and the City
Attorney and have someone got back to me da quickly as poasible.

preparing a Development Permit
Application for the City of Edmondsprior
to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or his/her representative,
must fill out the checklist, sign and date it,
and submit it to the City. The City will
review the checklist, make a precursory site
visit, and make a determination of the
subsequent steps necessary to complete a
development permit application.
With a signed copy of this form, the
applicant should also submit a vicinity map
or plot plan for individual lots of the parcel
with enough detail that City staff can find
and identify the subject parcel(s). In
addition, the applicant shall. include
other pertinent information (e.g. site
plan, topography map, etc.) or studies in
conjunction with this Checklist to assist
staff in completing their preliminary
assessment of the site.
