Mr. V. M. Behm architect of the building owned by Mr. and

Mrs. Nelson, w" present. Mr. Behm stated that the main
problem with their building plans was the stair doorexiting
to the property which is owned by James Paul Jones. Mr.. Behm
went on to say that at the beginning of the building plans,

he and the Nelsons spoke to Mr. Jones and were assured that
there would be no problem with something in the form of an
easement. Since that time, however, Mr. Jones has change d

his mind. Mr. Behm was in receipt of a letter from Jones

stating that he could not sign a formal document allowing the
placement of an easement, but would, however written

consent to an emergency exit. Mr. Albers co urred that there
was a problem concerning the legality of the easement.
Mr. Albers asked whether the Fire Department or Building De
partment might have an alternative plan. Fire Marshall Gary
McComas stated that he and Harry Whitcutt came up with an
alternate plan jointly with the architects. At that time,
it was believed that they would be able to obtain an ease-
ment without any problem. Mr. McComas further stated that

see no reason, from the way that the parking lot is constructed,

a problem where access is concerned. City Attorney Wayne

Mr. Whitcutt stated that the plan for the stairway from
the terrace area would be acceptable to the Building De-
partment and Fire Marshal McComas stated that it would
also be acceptable to the Fire Department. City Attorney
Wayne Tanaka stated that if they were to accept this alter-
nate plan, it would have to be resubmitted for approval in-
asmuch as the plan as it now stands has been rejected.
A MOTION WAS MADE BY MR. McCONNACHIE TO DENY THE APPEAL
WITH THE RECOMMENDATION THAT THE APPLICANT COME BACK WITH

Chairman Albers stated that the Building Department is

two-family dwellings. Mr. Whitcutt stated that the new

code requires that attic vents be located 3' away from win-

dows or doors. The difficulty in doing this is that if you

take the back elevation of most houses, you find that if you

have to be 3' away from windows, it eliminates room for vents
. i the soffits. Mr. Whitcutt stated that the ICBO is taking

steps to exempt single family residents from the requirements,

but it will not be effective until a new code is adopted.
Mr. Whitcutt asked the Board of Appeals to send a resolution
to the Council for a course of action in this matter.
