In accordance with your request, we have monitored the placement of forty
cast -in -place concrete piers at the subject site. An Engineering Geologist
from our firm was present during installation on July 20, 1978 to verify suf-
ficient penetration into bearing soils and that good construction procedures
were utilized.
All forty piers were placed in accordance with recommendations presented
in this firm's report dated May 22, 1978. We made recommendations;for two
sizes of piers - a 16-inch and a 24-inch minimum diameter.
For the 16-inch diameter pier, we recommended penetration for five feet or
at least seven feet below final grade to provide an axial capacity of 26 kips.
For the 24-inch diameter pier, we recommended penetration of 4 feet into glacial
till or to at lea.st seven feet below final grade for an axial capacity of 56
kips.
The pier locations are shown on the Pier Plan, Plate 1. Table A lists tile
pier and the total depth of penetration below final grade. It is ouropinion,
based on our visual observations during installation, that:
1) The piers have penetrated -the required depth into natural soils
2) The piers have been placed in satisfactory manner to obtain the
design pile capacities.

AN ORDINANCE OF THE . CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISION OF SECTION
7.20.050, ADOPTION OF STATE REGULATIONS
REGARDING CROSS -CONNECTION CONTROL DEVICE AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, Section 7.20.050 of the Edmonds City Code adopts
regulations of the State Department of Health concerning public
water supplies and cross -connection control devices, and
WHEREAS, the Washington Administrative Code provisions
adopted in such,section have changed and the ordinance needs to be
revised in order to authorize the staff to develop appropriate
regulations and mechanisms - to enforce - such requirements, NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds City Code Section 7.20.050
ADOPTION OF STATE REGULATIONS is hereby amended to read as follows:

7.20.050 ADOPTION OF STATE REGULATIONS.
The Community Services Director or his/her
designee is hereby authorized to develop rules
and regulations based upon and including the
requirements of the rules and regulations of
the State Board of Health regarding public
water supplies and the protection of such
supplies from contamination entitled "Cross -
Connection Control. Regulations in Washington
State", the provisions of Washington
Administrative Code Section 246-290-490, and
the American Waterworks Association, Pacific

Northwest Second Edition of "Accepted
Procedure and Practice in cross -Connection
Manual." The provisions of the Washington
Administrative Code, the rules and regulations
of the Department of Health set forth in' the
Cross -Connection Control Regulations in
Washington State and the previously referenced
Accepted Procedure and Practice in Cross -
Connection Manual are hereby adopted by this
reference as fully as if herein set forth in
full. Any additional rules and procedures
necessary to implement such regulations shall
be developed by the Community Services
Director or his/her designee as appropriate.
Such rules and regulations shall be kept on
file along with copies of the above referenced
regulations and manuals in the Office of the
City Engineer of the City of Edmonds.
Section 2. Effective Date. This ordinance, being an
administrative actiont is not subject to referendum and shall take
effect five (5) days after publication.

7.10.180 Unlawful acts.
It is unlawful for any person, corporation, or
association to break, damage, or injure in any
way any pipe, gate, meter or other water Sys-
tem appliance, or to interfere in any manner
with the proper operation of any part of the
water system of the city of Edmonds, or to
make connection to or alterations in any pipe
whereby water may be drawn from the city
mains or to take water from any fire hydrant,
bibb, pipe, or fixture of any kind, without first
having secured a permit from the water divi-
sion or proper city official. [Ord. 821, 1960;
Ord. 413 § 16, 1929].

7.20.010 Definitions.
A. "Backflow" means a flow, other than the
intended direction of flow, of any foreign liq-
ulds, gases, or substances into the distribution
system of a public water supply.
B. "Backflow prevention device" means a
device approved by the state of Washington,
Department of Social and Health Services or
such other state department as has jurisdiction
over the subject matter and by the American
Water Works Association, used to counteract
back pressure or prevent back siphonage into
the distribution system of a public water sup-
ply-
C. "Cross -connection" means any physical
arrangement whereby a public water supply is
connected, directly or indirectly, with any
other water supply system, sewer, drain, con-
duit, pool,. storage reservoir, plumbing fixture
or other device which contains or may contain
contaminated water, sewage or other wastes or
liquids of unknown or unsafe quality, which
may be capable of imparting contamination to
a public water supply as a result of backflow.

7.20.020 Cross -connections declared
unlawful.
The installation or maintenance of a cross-

connection, which, in the opinion of the direc-
tor of public works or his designee, will endan-
ger the water quality of the potable water
supply of the city, of Edmonds, is unlawful
[Ord. 1711 § 1, 19741.
7.20.030 Backflow prevention devices to
be installed.
Backflow prevention devices, when
required to be installed in the opinion of the
director of public works or his designated rep-
resentative, shall be installed and maintained
by the service customer on any service connec-
tion to the city of Edmonds water supply sys-
tem where the backflow prevention devices
are necessary for the protection of the city of
Edmonds' water supply. [Ord. 1711 § 1,
1974].
7.20.040 Private water supply systems.
Use or operation of a private water supply
system, contrary to the provisions of the ordi-
nances of the city of Edmonds, or the laws of
the state of Washington or the rules and regu-
lations of the State Board of Health regarding
public water supplies where the private system
is served by the city public water supply is
unlawful. [Ord. 1711 § 1, 19741.
7.20.050 Adoption of state regulations.

7.20.060 Abatement of unlawful cross -
connections and installation of
backflow prevention devices —
Procedures.
Cross -connections declared in this chapter
to be unlawful whether presently existing or
hereinafter installed and/or services requiring
backflow prevention devices and/or unlawful
use or operation of a private water supply sys-
tem.served by the city public -water supply are
public nuisances and, in addition to any other
provisions of this code or the ordinances of the
city of Edmonds on abatement of public nui-
sances, shall be subject to abatement in accor-
dance with the following procedure:
A. In the event that the director of public
works or his designee deten-nines that a nui-
sance as herein provided does exist, written
notice shall be sent to the person in whose
name the water service is established under the
records of the city of Edmonds water division,
or alternatively, a copy of such written notice
shall be posted on the premises served.
I B. The notice shall provide that the nui-
sance described herein shall be corrected
within 30 days of the date the notice is mailed
or posted on the premises.
C. In the event the nuisance is not abated
within the prescribed time, water service to the
premises shall be discontinued.
D. In the event that the nuisance, in the
opinion of the director of public works or his

designated representative, presents an immedi-
ate danger of contamination to the public water
supply, service from the city water supply sys-
tem to the premises may be terminated without
prior notice; provided, however, notice will be
posted on the premises in the manner hereto-
fore provided at the time the service is termi-

7.20.070 Penalties.
In addition to the remedies set forth herein,
any person found guilty of violating any of the
provisions of this chapter shall be subject to
the 'Penalties as set forth in ECC 5.50.020.

7.30.010 Definitions.
A. "Dwelling unit" rneans a building or
portion thereof providing complete house-
keeping facilities for one family.
B. "Single-farmly residence" means a
detached building containing one dwelling
unit only.
C. "Duplex7'means a building, occupying, a
lot, containing two dwelling units.
D. "Apartment houses" and other "multiple
units" (except hotels, tourist courts, trailer
parks, and motels) means a building or build-
ings used for and containing three or more
dwelling units occupied on a weekly or
monthly basis. Units rented on a weekly or
monthly basis shall not be deemed to be tourist
courts or motels.
E. "Hotels" means any place with individ-
ual rooms rented on a daily or weekly basis.
F. "Tourist courts" and "motels" means
detached multiple units, occupied and paid for
on a daily basis.
G. "Office buildings" includes all types of
professional, and business offices, including
but not limited to architects, engineers, law-
yers, doctors, dentists, real estate offices, etc.
H. "Commercial" and "retail buildings"
mean all types of retail and commercial busi-

(1) General.
(a) Purveyors have the responsibility to protect
public water systems from contamination due to
cross -connections. Cross -connections which can
be eliminated shall be elin-driated. The purveyor
shall work cooperatively with local authorities to
eliminate or control potential cross -connections.
The purveyor shall develop and , lenient a
imp
cross -connection control program acceptable to
the department. The scope and comple)dty of
the program shall be directly related to the size
of the system and the potential public health
risk. A department guideline titled 'Planning
Handbook' is available to assist the utility in
developing this program. The most -recently
published edition of the manual titled 'Accepted
Procedure and Practice in Cross Connection
Control - Pacific Northwest Section - American
Waterworks Association' shall be used as a
resource to establish:
(i) Minimum cross-co.nnection control
operating policies;
(ii) Backflow, prevention assembly installation
practices;
(iii) Backflow prevention assembly testing
procedures; and
(iv) Enforcement authority.
Purveyors and local authorities shall have the
option of establishing . more stringent
requirements.
(c) The purpose of a. cross -connection control
program is to protect the health of water
consumers and the potability of the public water
system by assuring:
(i) The inspection and regulation of plumbing
in existing and proposed piping networks;
and
(ii) The proper installation and surveillance of
backflow prevention assemblies whenactual
or potential cross -connections exist and
cannot be eliminated.
(d) The cross -connection control program shall be
included in the water system's plan under WAC
246-290-100 or small water system management
Program as. outlined under WAC 246-290-410,
whichever is appropriate.
(e) When an existing cross -connection -poses a
potential health or system hazard, the- purveyor
shall shut off water service to the premises until
the cross -connection has been eliminated or
controlled by the installation of a proper
backflow prevention assembly. The cross -
connection control program manager for the
department shall be notified when a service has
been shut off.
(2) Backflow prevention. assembly
installation and testing.
(a) If a cross -connection cannot be eliminated, then:
(i) An air -gap separation, reduced pressure
principle backflow prevention assembly
(RPBA) or a reduced pressure principle
detector backflow prevention assembly
(RPDA) shall be installed if the cross -
connection creates an actual or potential
health or system hazard.

(ii) An air -gap separation, PLPBA, RPDA, double-
check valve backflow prevention assembly
(DCVA), or double-check detector backflow
prevention assembly (DCDA) shall be
installed if the , cross -connection is
objectionable, but does not pose an
unreasonable risk to health.
(iii),A pressure vacuum breaker assembly
(PVBA) or an atmospheric vacuum may be
installed where the substance which could
backflow is objectionable but does not pose
an unreasonable risk to health and where
there is no possibility of backpressure in the
downstream piping.
(iv) Backflow prevention assemblies, appropriate
-for the degree of hazard or air gaps and in
some cases both, shall be installed at the
service connection or within the following
facilities, unless in the judgment of the
water purveyor and the department, no
hazard exists: Hospitals, mortuaries, clinics,
laboratories, piers and docks, sewage
treatment plants, food and beverage
processing plants, chen-dcal plants using
water process, metal plating industries,
petroleum processing or storage plants,
radioactive material processing plants or
nuclear reactors, car washes, facilities
having a nonpotable auxiliary water supply,
and others specified by the department.
(b) All installed RPBA!s, RPDA!s, DCVA!s, DCDA!s
and PVBA!s shall be models included on the
current iist of backflow assemblies, approved for
installation in Washington state, and maintained
and published by the department. Bdckflow
prevention assemblies in service, but not listed,
shall remain in service provided the backflow
prevention assemblies:
(i) Are listed on the current Washington state -
approved cross -connection control assembly
Est at the time of installation;
(ii) Are properly maintained;
(iii) Axe of a type appropriate for the degree of
hazard; and
Gv) Are tested and successfully pass the test
annually.
When unlisted assemblies are moved or require
more than minimum maintenance, the unlisted
assemblies shall be replaced by an assembly
listed on the current approved model list.
(c) All air gaps and backflow prevention assemblies
shall be installed in accordance with the cross -
connection control manual referenced under
WAC 246-290-490(i)(b) of this section.
(d) The purveyor may permit the substitution of �,
properly installed air gap in lieu 6T an approved
backflow prevention assembly. All such air gap
substitutions shall be inspected annually by I a
Washington state certified backflow asseniblv
tester.
(e) A Washington state certified backflow aSsemL,1%,
tester shall inspect and test all:
(i) RPBA's
(ii) RPDA's
(iii) DCVA's
(1v) DCDA's
(v) New PVBA installations, and
(vi) Existing PVBA's discovered through routine
inspections.
(f) Tests and/or inspections shall be conducted:
(i) At the time of initial installation;
(ii) Annually after initial installation, or more
frequently if tests indicate repeated failures;
and
(iii) After the assembly is repaired.
(g) The assemblies shall be repaired, overhauled, or
replaced whenever found to be defective. The
purveyor shall require that improperly installed
or altered air gaps be replumbed or replaced by
an approved RPBA at - their discretion.
Inspections, tests, and repairs shall be made
under the purveyor's supervision and records
thereof kept as required by the purveyor.
(h) The purveyor shaU deny or discontinue water
service to any customer failing to cooperate in
the installation, maintenance, testing, or
irispection of backflow prevention assemblies
required by the regulations of this chapter.
(3) Washington state certified
backflow assembly testers.
(a) A backflow assembly tester. shall become
certified and maintain certification per
department backflow assembly tester
certification program guidelines:

certified to test backflow prevention assemblies.

7.20.010 DEFINITIONS
A. "Backflow" means a flow, other than the intended direction of
flow, of any foreign liquids, gases, or subst'ances into the
distribution system of a public water supply.
B. "Backflow prevention device" means a device approved by the
State of Washington, Department of Social and Health Services
or such other state department as has jurisdiction over the
subject matter and by the American Water Works Association,
used to counteract back pressure or prevent back siphonage
into the distribution system of a public water supply.
C. 11 Cross -connection" means any physical arrangement whereby a
public water supply is connected, directly or indirectly, with
any other water supply system, sewer, drain, conduitf pool,
storage reservoir, plumbing fixture or other device which
contains or may contain contaminated water, sewage or other
wastes or liquids of unknown or unsafe quality, which may be
capable of imparting contamination to a public water supply as
a result of backflow. [Ord. 1711 §1 (part), 1974].
7.20.020 CROSS -CONNECTIONS DECLARED UNLAWFUL
The installation or maintenance of a cross-connectio*n, which, in
the opinion of the director of public works or his designee, will
endanger the water quality of the potable water supply of the city
of Edmonds, is unlawful. (Ord. 1711 §1 (part), 1974].
7.20.030 BACKFLOW PREVENTION DEV.'

representative, shall be installed and maintained by the service
customer on any service connection to the city of Edmonds water
supply system where the backflow prevention devices are necessary
for the protection of the city of Edmonds' water supply. (Ord.
1711 §1 (part), 1974].
7.20.040 REPUTATION'OF PRIVATE WATER SUPPLIES
Use or operation of a private water supply system, contrary to the
provisions of the ordinances of the city of Edmonds, or the laws of
the State of Washington or the rules and regulations of the State
Board of Health regarding public water supplies where the private
system is served by the city public water supply is unlawful.

7.20.060 ABATEMENT OF UNLAWFUL CROSS -CONNECTIONS AND INSTALLATION
OF BACKFLOW PREVENT DEVICES - PROCEDURES
Cross -connections declared in this chapter to be unlawful whether
presently existing or hereinafter installed and/or services
requiring backflow prevention devices and/or unlawful use or
operation of a private water ' supply system served by the city
public water supply are public nuisances, and, in addition to any
other provisions of this code or the ordinances of the city of
Edmonds on abatement of public nuisances, shall be subject to
abatement in accordance with the following procedure:

A. In the event that the director of public works or his designee
determines that a nuisance as herein provided does exist,
written notice shall be sent to the person in whose name the
water service is established under the records of the city of
Edmonds water division, or alternatively, a COPY of such
written notice shall be posted on the premises served.
B. The notice shall provide that the nuisance described herein
shall be corrected within thirty days of the date the notice
is mailed or posted on the premises.
C. In the event the nuisance is not abated within the prescribed
time, water service to the premises shall be discontinued.
D. In the event that the nuisance, in the opinion of the director
of public works, or his designated representative, presents an
immediate danger of contamination to the public water supply,
service from the city water supply system to the premises may
be terminated without prior notice, provided, however notice
will be posted on the premises in the manner heretofore
provided at the time the service is terminated. (Ord. 1711 §1
(part), 1974].
7.20.070 PENALTIES
In addition to the remedies set f orth herein, any . person found
guilty of violating any of the provisions of this chapter shall be
subject to the penalties as set forth in Section 5.50.020 of this

(a) Purveyors have the responsibility to protect
public water syste m s from contamination due to
cross -connections. Cross -connections which can
be eliminated shall be eliminated. The purve . yor
shall work cooperatively with local authorities to
eliminate or control potential cross -connections.
The purveyor shall develop and implement a
cross -connection control program acceptable to
the department. The scope and complexity -of
the program shall be directly related to -the size
of the system and the potential public -health
-risk. A department guideline 'tided 'Planning
Handboole is -available to �assist -the � utility. in
developing this program. 'Me most recently
published edition of the manual -tided 'Accepted
Procedure and Practice in Cross, Connection
Control - Pacific Northwest Section - American
Waterworks Association! shall be- used as "a
-resource to establish:
(i) Minimum cross -connection . control
operating policies;
(ii) Backflow prevention assembly installation
practices;
(iii) Backflow- prevention assembly' testing
procedures; and
(iv) Enforcement authority.
Purveyors and local authorities shall have the
option of establishing more stringent
requirements.
(c) The purpose of a. cross -connection control
program is to protect the health of water
consumers and the potability of the public water

back-out-p�drking would'normally be permitted, we recommend
against approval of the plans as shown. Whatever is approved
will be with us for many years to come. The traffic on Second
Avenue is increasing and will continue to increase in the
foreseeable future. Backing out will cause safety problems,
if not today then certainly within the near future.
We, therefore, recommend that the parking be redesigned to
