Dear Bruce: Enclosed please find an application 'for a conditional use permit and architectural design review for -the above referenced project. The project proposed by Hillhaven Corporation includes new landscaping, modifications to the existing service road and re -sealing and re -striping of the existing parking area. Additionally, a new parking lot is being proposed on an adjacent lot which will require a conditional use permit. This parking lot will bring the total number of spaces to 69, which will conform to city requirements for a 98-bed care facility. Project consists of sitework modifications to an existing care center. Existing site consists of a 26,440 square foot building with 30 parking spaces, asphalt driveway and service road, and several landscaped areas (see attached plan). Site improvements will include reducing the parking stalls on the existing site from 30 to 26 stalls and adding 48 stalls on the adjacent undeveloped lot to the south of the existing site. These improvements will bring the total number of parking stalls in conformance with City requirements. Improvements will also include enhancement of the building exterior and additional landscaping. The site is located on 76th Ave. W. at 210th St. S.W. The undeveloped southwest corner of this facility is going to be improved for use as a parking lot. Proposed Changes: The addition of a new parking lot has necessitated the need for a surface detention basin due to the increase runoff. The proposed detention basin located in the planting island of the parking area will handle only the additional stormwater generated by the new parking lot. The rate of runoff will be restricted to pre -development flows by means of a control orifice plate. The control orifice will be part of an oil separator and will be of a type which has no overflow feature. This facility will contain a 10-year event storm without any_flooding over the parking lot. An 8 inch discharge lane will connect the restrictor orifice structure to an existing catch basin on the site. Storm Detention Calculations: The site to be developed for the parking lot is approximately 165 Ft. x 124 Ft. = 0.47 acres. The Yrjanainen & Warren Method for simple retention/detention basin design was used for the design. Qmpw$ L MAYOR FILE: CU-40-86 Hillhaven Corporation, 1148 Northwest Market, Tacoma, Washington, 98402, (applicant) has requested approval of a conditional use permit for an expansion of parking facilities at the,Edmonds Care Center at 21008 76th Avenue West, Edmonds, Washington. A hearing on the request was held before the Hearing Examiner of the City of Edmonds on October 16, 1986. Pike Street City of Edmonds Seattle, WA 98122 Edmonds, WA 98020 At the hearing the following exhibits were submitted and were admitted as part of the official record of this proceeding: Exhibit 1 - Staff report 2 - Application 3 - Site plan 4 - Vicinity map After due consideration of the evidence presented by the applicant;.. evidence elicited during the public hearing; and, as a result of th6 personal inspection of the subject property and surrounding areas by the Hearing Examiner, the following Findings of Fact and Conclusions constitute the basis of this decision of the Hearing Examiner. FINDINGS OF FACT 1. The applicant has requested a conditional use permit for the expan- sion of parking facilities at the Edmonds Care Center, 21008 76th Avenue West, Edmonds, Washington. The property is zoned RM-2.4. Findings and Decision of the Hearing Examiner of t ' he City of Edmonds, RE: CU-40-86 Page 2 All properties adjacent to the subject propertyexcept for the property to the south are zoned RM-2.4. The prpoerty to the south is zoned BN. (Bowman testimony, staff report) 2. The property is a 2.3 acre site that is located on the west side of the intersection of 76th Avenue West and 210th Street Southwest, Edmonds, Washington. Onsite is a 26,440 square foot convalescent center. In addition to the center there are 63 parking spaces. It is the intent of the applicant to change the building facade of the center, to modify the existing parking, and to revise the existing landscaping. (Staff.report) I 3. Admitted as Exhibit 3 to this hearing . and attached,hereto is a site plan. On the site plan it is shown that the applicant proposes to -construct a new parking lot on an undeveloped southern portion of the property. (Staff report, Bowman testimony) 4. ECDC 16.30.020(c)(2) classifies convalescent homes as primary uses requiring a conditional use permit. In order to construct the new parking lot on the undeveloped southern portion of the site, the applicant must obtain a conditional use permit. (Bowman testimony) 5. ECDC 20.05.010 sets forth the criteria that must be satisfied in order for a conditional use permit to be granted with the City of Edmonds. These criteria include: a. The proposed use must be consistent with the Comprehensive Plan of -the City of Edmonds; b. The proposed use and its location must be consistent with the purpose of.the zoning ordinance in which the property is located; C. The proposed use must not be significantly detrimentalto the public health, safety or welfare, nor injurious to the nearby private properties or improvements; and, d. The Hearing Examiner shall determine whether the conditional use permit shall run with the land or shall be personal. (ECDC) 5. The subject property is designated as high -density residential. The proposed conditional use permit will not conflict with the purpose-s of the Comprehensive Plan. (Staff report) 6. The proposed use shall not be significantly detrimental to the public nor to nearby private properties or improvements. A declaration of non -significance pi4rsuant to State Environmental Policy Act was issued for the project. The applicant desires to construct the parking lot to create a better.visual appearance for the center. This will result in more landscaping and less asphalt on the portion of the site that fronts 76th Avenue West. (Bowman testimony) 8. The Planning Department of the City of Edmonds has recommended ap- 'tional use permit subject to the following con- proval of the condi ditions: 1. The applicant -shall comply with all architectural design board requirements. 2. The permit should be transferrable. (staff report) 9. The architectual design board has reviewed the application and has approved the design of the building. (Bowman testimony) 10. No adverse testimony was.received in this matter. CONCLUSIONS 1. The application is for the approval of a conditional use permit for the allowance of the expansion of a parking lot on the property lo- cated at 21008 76th Avenue West, Edmonds, Washington. 2. A conditional use permit is required because the facility is consi- dered a community facility in an RM zone. 3. The criteria for granting a conditional use permit as set forth in the ECDc 20.05.010 have been reviewed, the applicant has satisfied the criteria. 4. The proposed use W4 11 be consistent with the Comprehensive Plan of the City of Edmonds. The property designation of high -density residential does not conflict with the proposed use of 'the appli- cant. 5. The proposed parking expansion does not conflict with the purposes of the RM zone property. 6. The proposed use will not be detrimental to the public nor nearby property or improvements. 7. The permit should be transferrable. nILIOTOTnM Based upon the preceding Findings of Fact and Conclusions, the testimony and evidence submitted at a public hearing, and upon the impressions of the Hearing Examiner it is hereby ordered that the request of the C'. Findings and Decision of the Hearing Examiner of the City of Edmonds RE: CU-40-86 Page 4 applicant for CU-40-86 is granted subject to the following condition 1. The -applicant shall comply with all architectural design board requirements. 2.. The applicant shall secure all necessary pe rmits from the City prior to any construction. 3. The conditional use permit shall not be transferrable.. 4. The applicant shall develop the proposed parking lots in a manner consistent with the site plan as shown on Exhibit 3.
