Ron Snare, Everett, Washington, hereinafter called Applicant, has requested approval of a Preliminary Plat for land located at 21015 80th Avenue West, Edmonds, Washington, and more particularly described as: Tract 24, Willowdale Gardens Division #1, except the north 70 feet of the west 150 feet thereof, except the west 89 feet of the south 90 feet thereof. The above described land is zoned RS-8 and it has a comprehensive plan designation of low density residential. The zoning and comprehensive plan designations have been established by the City Council of the City of Edmonds, Washington. A hearing on the request was held before the Hearing Examiner of the City of Edmonds, Washington, on February 5, 1981. The following presented public testimony: Duane Bowman Planning Department City of Edmonds Dan Smith Planning Department City of Edmonds Berl Long Bill Glutch Dwight Thomas The following exhibits were presented at the hearing and were admitted into evidence: Exhibit 1 - Staff Report of Planning Department of City of Edmonds Exhibit 2 - Comments from the City Engineering Department Exhibit 3 - Engineering Requirements of the City of Edmonds for Plats and Subdivisions Exhibit 4 - A Plat Map of the Subject Property Exhibit 5 - A Vicinity Map of the Subject Property Exhibit 6 - The Application for the Subdivision Exhibit 7 - A Final Declaration of Nonsignificance for SEPA Regulations I Findings and Recommendations of the Hearing Examiner of the City of Edmonds File Number: HE-81-PP-1 Page 2 After due consideration of the evidence presented by the Applicant; evidence elicited during the public hearing; and as a result of the personal inspection of the subject property and surrounding areas by the Hearing Examiner, the following findings of fact and conclusions constitute the basis of the recommendation of the Hearing Examiner. 1. The Applicant has requested approval of a Preliminary Plat review of a 6-lot subdivision for property located at 21015 80th Avenue West, Edmonds, Washington, and more particularly described as set forth above. 2. The zoning for the above described land is RS-8 as established by. the Edmonds Community Development Code. 3. The Comprehensive Policy Plan Map of the City of Edmonds, Washington, designates the subject area of one of low density residential. 4. The zoning and development of the adjoining properties are as f ollows : north: RS-8/A partial development and partial marshy area; south: RS-8 PRD; east: RS-8 subdivision; west: RS_ B/Alderwood Manor 5. The subject property is presently undeveloped. 6. The subject property slopes at an approximate 6% grade to the east until it comes to a marshy area located within the confines of the property. After the marshy area the property slopes upward again to the east at a 6% grade. 7. The vegetation on the subject property includes brush and small alder trees and some large fir trees located on the western 2/3 of the property. The eastern third of the property is coveeed with scattered conifers and alder trees. 8. At approximately the eastern third of the subject property there is a wet marshy area that bisects the property in the north -south direction. This wet marshy area is drained in a northward direction of the property. 9. The Applicant in submitting his application submitted a plat map of the proposed subdivision. A copy of the plat map is hereby attached and is incorporated as part of these findings. 10. The land west of the marshy area and the land east of the marshy within the subject property is the area in which the proposed subdivision lots would be located. 11. As shown on the plat map there are 6 lots in the proposed subdivision. Lots 1, 2, 5 and 6 are located on the part of the land that is east of the above mentioned marshy area. Lots 3 and 4 are located on that part of the subdivision that is east of the marshy area. 0 0 Findings and Recommendations of the Hearing Examiner of the City of Edmonds HE-81-PP-1 Page 3 12. Access to the proposed subdivision would be off of 80th Avenue West at the intersection of 211th Place Southwest. This would be the only access for the proposed subdivision. 13. The proposed 211th Place SW will front on lots 1, 2, 5 and 6 of the proposed subdivision and will front on an access road that will provide ingress and egress to lots 3 and 4. This street, 211th Place SW, cul-de-sacs within the proposed subdivision. 14. The access to lots 3 and 4 would be of f of a roadway approximately 105 feet long that would extend to lots 3 and 4 and connect to 211th Place SW. This roadway would not be a dedicated street but would be a driveway for the use of structures on lots 3 and 4. 15. The Planning Department for the City of Edmonds testified that the Fire Department of the City did not have any objections to the proposed 211th Place SW and the cul- i de -sacs that it forms. 16. Drainage through the marshy area would be by means of a swale that would be located between lots 2 and 3 and lots 5 and 4. 17. The location of the swale would be approximately 10 feet east of the natural drainage that currently exists on the property. However, the Applicant and the City testified that the proposed drainage swale would adequately drain all runoff from the lots on the development and all water collected in the marshy area. 18. The Planning Department and the Engineering Department of the City of Edmonds recommended that a catch basin be located at the point in which the drainage swale meets the north boundary of the subject property. The City testified that the catch basin would prevent any damming of property to the north and would allow for the natural drainage of water caught within the marshy area. 19. The City Planning Department testified that the required f rontyard setbacks of lots 2 and 5 should be reduced to 12 1/2 feet in order to allow future construction of homes so as not to interfere with the drainage swale. It was the Planning Staff Is recommendation that the f inal plat must show these setbacks. 20. The Planning Department of the City of Edmonds, recommended approval of the preliminary plat subject to the following conditions: It is the recommendation of the staff that P-3-80 be approved subject to the following conditions: 1) As provided by Chapter 20.50, the front yard setbacks of Lots 2 and 5 should be reduced to 12 1/2 feet to allow future homes to be constructed further away from the drainage swale. Final plat must show these setbacks. Findings and Recommendations of the Hearing Examiner of the City of Edmonds HE-81-PP-1 Page 4 2) Lots 3, 4 and 5 are flag lots. Their setbacks should be: STDE a) Lot 3 FRON West REA East North/South b) Lot 4 Same c) Lot 5 211th North/ West/South Pl. SW East 3) Lot 1 should access.only onto 211th Place SW. 4) Compliance with all the Engineering requirements outlined in Exhibit 3. 5) An oil separator is required. 6) Stream culvert size to be determined by calculation (12" shown not approved). 7) "Catch basin with restrictor" subject to detailed design and approval by Engineering Division. 8) No healthy trees 8" in diameter or over in rear and side setbacks of Lots 3 and 4 should be removed. 9) If at all possible, large f irs to the entrance at the subdivision, should be preserved. 10) Lots 3 and 4 are to share one common drive over the drainage swale. Culvert should not exceed 20 feet in length. 21. In addition to the conditions as set forth in the proceeding finding, the City.of Edmonds Engineering Department submitted exhibit 3 which is hereby attached and incorporated as part of these findings. Exhibit 3 sets forth the engineering requirements for plats in subdivisions that must be met either prior to the recording of the plat or at another time during the development of the plat. . 22. The Planning Department of the City of Edmonds testified that there was currently no detailed drainage plan that had been submitted, and no soils report had been submitted for the subject property. 23. The Applicant testified in agreement to the recommendations of the City Planning Department. 24. Testimony was received from other parties expressing a concern over the drainage problems that could exist on the subject property. These items were addressed by the City Planning Department and the witness agreed with the conclusions as set forth by the testimony of the Planning Department. 25. A final declaration of no environmental significance was issued on the subject property. This declaration of nonsignificance was issued pursuant to the State Environmental Policy Act. 4 0 0 Findings and Recommendations of the Hearing Examiner of the City of Edmonds HE-81-PP-1 Page 5 I . The application is for the approval of a Preliminary Plat of a 6-lot subdivision located at 21015 80th Avenue West, Edmonds, Washington, and more particularly described as set forth above. 2. The zoning classification for the subject property is RS-8 and the Comprehensive Policy Plan designates the area as a low density residential. 3. The Hearing Examiner has authority to review and make recommendations on the proposed Preliminary Plat of the subdivision pursuant to section 20.100.010 A.1 of the City of Edmonds Community Development Code. 4. The proposed subdivision is in accordance with State standards to prevent overcrowding of land and it promotes the public health and safety and general welfare. 5. The proposed subdivision appears to provide adequate water, utilities, sewage, storm drainage and other public requirements as set forth in section 20.75.020 of the City Edmonds Development Code. 6. There is proper ingress and egress to the proposed subdivision off of 80th Avenue West where it intersects with 211th Place SW. 7. The proposal for the subdivision appears to be consistent with the purposes of Xhapter 20.75 of the Edmonds Community Development Code. B. The proposal appears to be consistent with the provisions of the Edmonds Comprehensive Plan and other adopted City policies. 9. The proposal appears to meet all the requirements of the zoning ordinances of the City of Edmonds. 10. Traffic circulation through the proposed project appears to be adequate with the cul-de-sac of 211th Place SW which will provide access to lots 1, 2, 5 and 6 and will connect to a drive way that will provide access through lots 3 and 4 of the proposed subdivision. 11. The drainage swale as proposed by the Applicant in which the marshy area of the subject property will be drained appears to be adequate to control any drainage problem that will occur on the property. 12. There appears to be a need for a drainage control plan that properly identifies all drainage problems within the proposed subdivision and sets forth in greater detail the drainage swale that is proposed by the Applicant. 13. There appears to be a need for a soils study of the subject property in order to properly determine the stability of the soil that will be used during construction. 0 0 Findings and Recommendations of the Hearing Examiner of the City of Edmonds HE-81-PP-1 Page 6 14. The Planning Department of the City of Edmonds has recommended approval of the proposed subdivision subject to the conditions listed in number 20. 15. The Applicant testified in support of the recommendations of the Planning Department of the City of Edmonds. Using the above findings and conclusions as the basis of the recommendation, the recommendation of the Hearing Examiner to the Edmonds City Council is for approval of the Preliminary Plat review of a 6 lot subdivision for property located at 21015 80th Avenue West, Edmonds, Washington, and legally described as set forth in the introduction of this document, subject to the following conditions: 1. As provided by Chapter 20.50 of the Edmonds Community Development Code, the front yard setbacks in lots 2 and 5 of the proposed subdivision should be reduced to 12 1/2 feet to allow future homes to be constructed so as not to interfere with the drainage swale that is proposed. Prior to any approval of the final Plat, these setbacks should be set forth and made. 2. The setbacks for lots 3, 4 and 5 which are flag lots, should be established by the Planning Department of the Citylof Edmonds prior to the approval of the final Plat. 3. Lot I of the proposed subdivision should have access only off of 211th Place SW and off of no other street. 4. The Applicant must comply totally with all of the requirements as set forth by the Engineering Department of the City of Edmonds. 5. An oil separator will be needed in the proposed subdivision. The location of the oil separator should be determined by the Engineering Department of the City of Edmonds and the Applicant. 6. A drainage swale should be provided in the marshy area of the subject property as identified above. All culverts that are to be used for drainage should have the size determined by calculation and measurements as established by the Department of Engineering of the City of Edmonds. 7. The Applicant should be required to install a catch basin with a restrictor at the point in which the drainage swale meets the north boundary of the subject property. This catch basin with restrictor should be subject to the detail and design of the Engineering Department of the City of Edmonds. 0 0 Findings and Recommendations of the Hearing Examiner of the City of Edmonds RE-81-PP-1 Page 7 8. The Planning Department and the Parks and Recreation Department of the City of Edmonds should make a determination as to which trees on lots 3 and 4 should not be removed. In making such a determination factors such as healthy trees, and the size of trees should be taken into consideration. In addition, the location of the trees within the subject property should be considered. 9. If at all possible, large f irs at the entrance to the subdivision should be preserved. 10. The Applicant shall provide a common drive off of 211th Place SW to lots 3 and 4 for the purpose of access to those lots. The lots should be of suf f icient size to adequately carry the traffic to these lots. Further, the driveway should be maintained by the Applicant or his successors in such a manner as to not endanger anyone traveling over the driveway and to not threaten blockage of the drainage swale or culverts underneath the driveway. 11. The Applicant should supply the Planning Department with a detailed drainage plan showing the drainage for the entire proposed subdivision. 12. A soils report should be submitted by the Applicant. 13. The Applicant should be required to provide a covenant with all successors to his interests in the property for the continual and perpetual maintainance of the catch basin located at the north boundary of the subject property. 14. The Applicant should be requrired to dedicate 211 Place SW prior to the final recording of the plat.
