Description of the Subject Property and Surrounding Area The subject property is the site of a six lot subdivision that was approved in April of 1981. The plat was, recently modified to allow a culvert instead of a open drainage swale through the property. The applicant is proposing to use approximately 3,000 cubic yards of material on the lots in the subdivision. FINDINGS OF FACT 1. The application is for the approval of a conditional use permit for the purpose of providing fill of approximately 3j000 cubic yards of material on property located at 21015 80th Avenue West. - Edmonds, Washington. The subject property is a parcel of land that has been approved for a six -lot subdivision. Approval of the subdivision occurred in 1980. In 1985 the approval was amended to allow for a change in the plans for the development of the subdivision. The change involved a redesign of the drainage system to a culvert instead of an open ditch swale. (Bowman testimony.) 3. The Applicant needs fill material in order to properly develop -is on the site and to bring portions of the site up to the 10 the proper elevation for development. (Snare testimony.) 4. The fill material has been placed on site. Part of the material has been brought -:to the site by the Applicant and some of the material has been deposited on site. The material is clean and is adequate for fill purposes. (Snare testimony.) 5. The subject property is zoned RS-8. (Bowman testimony.) 6. The surrounding properties are zoned single-family residential. The property to the south is zoned multiple family PRD classi- fication. (Bowman testimony.) 7. In order for a conditional use permit to be granted within the City of Edmonds the criteria as set forth in Section 20.05.010 of the Edmonds Community Development Code (ECDC) must be satis- fied. These criteria include: A. The proposed use must be consistent with the Comprehensive ,Plan of the City of Edmonds; B. The proposed use in its location must be consistent with the purposes of the zoning ordinance in which the pro- perty is located; C. The proposed use must not be significantly destrimental to the public health, safety or welfare, nor injurious to nearby private properties or improvements; and, D. The Hearing Examiner shall determine whether the conditional use permit shall run with the land or shall be personal. (ECDC.) 8. The Planning Department of the City of Edmonds submitted that the request has been considered with the Comprehensive Policy Plan Map and the Comprehensive Plan of the City of Edmonds and the request is consistent with these plans. 9. All grading §hall conform to Chapter 70 of the Uniform, Building Code. An erosion control plan must be submitted for review and approval, with the Building Permit. 2. Comply with all conditions of Preliminary Plat P-3-80. 11. No adverse testimony was received in this matter. CONCLUSIONS 1. The application is for the approval of a conditional use permit to allow material of up to 3,000 cubic yards of'fill on property located at 21015 80th Avenue West, Edmonds, Washington. 2. In order for a conditional use permit to be granted within the City of Edmonds the criteria as set forth in Section 20.05.010 of the ECDC must be met. These criteria, with the use of con- ditions, are satisfied by this application. 3. The requested grading and conditional use permit will not be inconsistent with the zoning ordinances of the City of Edmonds and the RS-8 zone in which the property is located. 4. The grading and conditional use permit will not be inconsistent with the Comprehensive Policy Plan Map and the Comprehensive Policy Plan of the City of Edmonds. 5. The requested grading and conditional use permit will not be detrimental to the public, nor to nearby private properties or improvements. The Applicant must adhere to the conditions of approval in order for this criterion to be satisfied. 6. The City of Edmonds has recommended approval of the request subject to the conditions listed in Finding #10. DECISION Based upon the preceding Findings of Fact and Conclusions; the testimony and -evidence submitted at the public hearing; and, upon the impression6 of the Hearing Examiner at a site view, it is here- by ordered that the requested conditional use permit be granted.
