Located at Wispy Willows Cofidos: 21025,21035,21101, & 21103 — 80th Ave. W Dear Mr. B m*e', Thank you for submitting two Tree Hazard Evaluation Forms prepared by Martin Macauley (Certification ID #PN-5768A) and dated November 30, 2012 regarding the hazardous trees that you would like to cut on the Wispy Willows Condo property addressed 21025, 21035, 21101, and 21103 80th Ave. W, located - adjacent to the northern boundary of your property addressed 7905 212' St. SW. For your reference, I am enclosing these Tree.Hazard Evaluation Forms and photographs that Mr. Macauley submitted to me via email on December 4, 2012 as well as the photograph that I took when I visited the site on December 10,2012. The Tree Hazard Evaluation Forms. prepared by Mr. Macauley address two trees, one of which has two trunks. Tree #1 was identified as being hazardous by Mr. Macauley because t " he tree is dead. Tree #2, which has two trunks, was identified by Mr. Macauley as being hazardous because the tree is dying, with only a 50% live crown ratio and severe decay. The trees assessed in the enclosed Tree Hazard Evaluation Forms are located within a wetland and/or its associated buffer. As such, the cutting of these trees is subject to the applicable critical areas regulations of Edmonds Community Development Code (ECDC) Chapters 23.40 through �3.90. Generally the removal of trees, or any vegetation, within a critical area or critical area buffer is not an allowed activity, unless it involves the removal of invasive species or hazard trees. Removal of hazardous trees in critical areas is regulated in the. Edmonds Community Development Code (ECDC) at Section 23.40.220.C.7.b. Such removal is an allowed activity as indicated by the code below: The removal of treesftom critical areas and buffers that are hazardous, posing a threat to public safety, or posing an imminent risk of damage to private property provided, that.-.' i. The applicant submits a reportfrom an ISA- or ASCA-certified arborist or registered landscape architect that documents the hazard andprovides a replanting schedulefor the replacement trees; ii. Tree cutting shall be limited to pruning and crown thinning, unless otherwi.sejustified by a qualiftedprofessional. Where pruning or crown thinning is not sufficient to address the hazard, trees should be removed or converted to wildlife snqgsl� iii. All vegetation cut (tree stems, branches, etc.) shall be left within the critical area or buffer u nless removal is warranted due to the potentialfor disease or pest transmittal to other healthy vegetation or unless removal is warranted to improve slope stability, - Page I of 3 iv. The -land owner shall replace any trees that are removed with new trees at a ratio of two replacement treesfor each tree removed (two to one) within one year in accordance with an' approved restoration plan. Replacement trees may be planted at a different, nearby location if it can be determined that planting in the same location would create a new hazard or potentially damage the critical area. Replacement trees shall be species that are native and indigenous to the site and a minimum of one inch in diameter at breast height (dbh) for deciduous trees and a minimum of sixfeet in heightfor evergreen trees as measuredftom the top of the root ball; v. If a tree to be removedprovides critical habitat, such as an eagle perch, a qualified wildlife biologist shall -be consulted to determine timing and methods of removal that will minimize impacts; and vi. Hazard trees determined to pose an imminent threat or danger to public health or safety, to public or private property, or ofserious environmental degradation may be removed or pruned by the land owner prior to receiving written approvalfrom the city provided, that within 14 daysfollowing such action, the land owner shall submit a restoration plan that demonstrates compliance with the provisions of this title; Additionally, the following code provision from ECDC 23.40.220.C.7.d applies to trees within wetlands: d. Unless otherwise provided, or as a necessary part of an approved alteration, removal of any vegetation or woody debrisftom afish and wildlife habitat conservation area or wetland shall be. prohibited The above referenced Tree Hazard Evaluation Forms prepared by Martin Macauley and associated photographsidentify and describe the location and health of the subject trees. Based. on this information, it is clear that removal of these trees is warranted as Ion g as the requirements of E CDC 23.40.220.C.7 are followed. It shall be noted, however, that the City cannot authorize you to conduct work on property that is not owned by you. As such, you may not cut any trees located on the neighboring property without the Wispy Willows Homeowners Association's permission; Additionally, ECDC 23.40.220.C.7.b.iv requires that hazard trees be replaced with new trees at a ratio of two -to -one. Thus, following the cutting of the subject trees, the trees will need to be replaced at a ratio of two-to�one. An exemption for the tree cutting requested in the Tree Hazard Evaluation Forms prepared by Mr. Macauley (dated November 30, 2012) is granted with the following conditions: The City cannot authorize you to conduct work on property owned by another individual and/or condo association. As such, the subject trees cannot be put without permission from the Wispy Willows Homeowners Association. A private agreement is to be made between both parties before any cutting occurs on the neighboring property. 2. Only the trees identified in the Tree Hazard Evaluation Forms prepared by Mr. Maca.uley and dated November 30, 2012 (enclosed) may be cut. No additional trees may be cut without further review and approval by. the Planning Division. .3. Unless a safety hazard is posed f6r the individuals cutting the subject trees, the trees shall be converted to snags instead of cut to the ground. If there is a safety hazard with cutting the trees to snags, the trees may be cut to stumps, but the stumps shall not be removed. 4. All debris from the cutting shall be left in the wetland in the general area of the subject trees. Page 2 of 3 5. All work must be done using hand ' labor and light (hand-held) equipment, and appropriate erosion control must be implemented to minimize impacts to the critical are ' as. The replacement trees must be installed using the same techniques in the general area that the subject trees are cut. 6. Cut trees must be replaced at a ratio of two -to -one consistent with ECDC 23.40.220.C.7.b.iv within one year of tree the tree cutting activity. Replacement trees must be planted in the general vicinity of the cut trees. 7. Pursuant to ECDC 23.40.220.C.7.b, replacement trees shall be a minimum of one inch diameter at breast height for deciduous trees and a minimum of six feet in height for evergreen trees as measured from the top of the root ball.
