In response to your July 13, 2006 letter, by the City Building Official this matter has been
referred to the Public Works Department since this department has the ownership and
maintenance responsibility of the fire hydrant. Enclosed is a copy of the City Utility Easement
(#8502210076) which reserves a 10 foot strip of land within the west 15 feet of Lot 6 of the
Espland Estates plat for this City water line utility.
After reviewing the Edmonds Community Development Code (ECDC) 19.25.070 (G) and
discussing this matter with the City Fire Marshall, the northerly 15.feet of the fence must be
removed so that it does not extend in front of or past the existing main port of the fire hydrant.
My department is also sending a letter to the easterly property owner, Mr. Farr, where the fire
hydrant is located, informing him of the requirement to provide and maintain a 36" clear area
around the fire hydrant as required by ECDC 19.25.070 (D).
Please inform your client Mr. Kirkpatrick that this section of fence, including the access gate,
needs to be removed as soon as possible and no later than August 31, 2006. Please note that
the City Building Official has made a determination that there are no permits required to
perform this work.

Dear Ms. Graf,
I am the attorney for Steven Kirkpatrick and Linda Skurdal. I am writing about the
City's letter to them dated June 15, 2006. My'clients are willing to comply with the
ultimate decision of the City but need additional information to understand the City's
requirernents.
Steve and Linda (Steve's partner) also understand that this particular hydrant is in an
unusual location since it is located on private property at least 90 feet from the city street
and is outside the ingress egress utility easement of the private road that extends from
88 1h Place. The private road with the ij �Iit easement is on Steve's private property. The
Farr property next to Steve's property (where the hydrant is located) is not listed on the
ingress, egress easement document. The Farr property appears also appears to have no
easement (ingress, egress) listed on the Snohomish County property information across
my client's property. The Farr access in on a separate. parcel of land. The fence
extension that the city hasasked Steve to remove is actually located completely on his
private property 6 feet from the hydrant.
We request that the City provide documentation of ownership of the hydrant and the
easement for location of the hydrant in its present location.
After meeting with the Fire Marshall, Steve and Linda understand that the reason behind
the city's request to remove the extension is because the hydrant must be visible from
88 th Place when the fire truck arrives, according to 19.25.070G. The visibility of the
hydrant is not obstructed by the new fence extension - from view of a fire truck
approaching. The fence is 6 feet -away from the hydrant. The view of the hydrant could
be obstructed once the fire truck parks close to the hydrant on their easement. 'Steve and
Linda also constructed a large gate through the fence for easy access and exit of hoses.
T he pictures submitted with this.letter show the above.
After your review of the ownership of the hydrant and the city regulations, please advise
if the City still feels i the fence needs a permit or needs to be removed. It appears that if
you feel your regulations apply, then only ten feet of the fence would have to. be
removed. Please verify. that. My clients intend to remove a section of the fence unless
another solution can be found.
We also expect that the same rules to, apply to Steve's neighbor. Upon reading the
Edmonds Community Development Code provided by the Fire Marshall, it has come to
my clients' attention according to Section 19.25.070D that the visibility of the hydrant is
also obstructed for another reason. The.current owner of the property (Thomas Farr)
where the'hydrant is located installed railroad ties and extra dirt on the street side of the
hydrant in O*rder to make a parking pad next to his garage. Steve and Linda know that the
pad was installed after ' the construction of the house and the final inspection so we have
reason to believe that Thomas Farr did not have a permit allowing him to change the
ground levels around the hydrant.
Enclosed are the following pictures:

2. Pictures of the hydrant on the neighbors' property showing the alterations to the
ground level and' improvements immediately adjacent to the hydrant.. (seven
photos).
The above hydrant pictures that show the grade level prior to the construction of the Farr
house an - d pictures that show the grade of the ground near the hydrant after construction,
which now obstructs the visibility of the hydrant from the approaching fire truck on 88 1h
Place W.
The Development Code also states that the lowest outlet of the hydrant is to be 18 inches
above the adjacent finished grade and at least 36" of clear area around the hydrant for
wrench clearance on both outlets andthe control valve. As you can see in the pictures of
the hydrant after construction, the clearance is severely compromised. Mr. Farr should
be required to raise the level of the fire hydrant or remove the obstructions he placed next
to the hydrant. Please infon-n him of the City requirements.
This letter serves as documentation that Steven will comply to the city's final decision.
We also believe there is an alternate solution for all parties -concerned. The better
solution is for the City to move the hydrant to a more central location near the mailboxes.
Attached is a drawing showing a more central, location for the hydrant. That would
resolve any sight and fence issues. We can explain more completely at a later date at
your convenience.

RE: Fence interference with City Fire Hydrant
Dear Mr. Kirkpatrick:

It has come to the City's attention that a fence has been extended on your property without first
obtaining City approval and a fence permit. Also, it appears that the fence may interfere with the
use and maintenance of a City Fire Hydrant. Please refer to the enclosed fence handout that
describes when fences are required to obtain a permit.
In order for the City to issue a fence permit the following documents (at a minimum) are
required:
• Permit Application(s) and fees,
• Plot plan showing the existing property lines, house, driveway, etc.
• The location of the extended fence in relation to the property lines and the City Fire
Hydrant.
Please be advised, the fence cannot extend past your property line into developed or undeveloped
City night -of -way without special approval by the City Engineer. If you suspect that your fence
does encroach onto City property a second permit called an Encroachment Permit would also be
required however, please be advised no Encroachment Permit shall be approved for fences that
obstruct or interferes with a City Fire Hydrant.
Please respond in writing by June 23, 2006 regarding this matter and decide whether you will
remove the fence extension or make complete application for all required pen -nit approvals. If
you have any questions about the permit submittal process please contact a Permit Coordinator at
425-771-0220. Note, since the fence was extended in advance of City approval investigation
fees, in addition to normal permit fees, shall be applied to all permit applications.

19.25.065 Mains and service lines.
A. All public hydrants in single-farruly
C
areas shall be supplied by not less than six-inch
looped water mains. All hydrants in areas other
than single-family residential shall be supplied
by not less than eight -inch looped water mains.
Dead-end water mains to hydrants shall be at
least eight inches in diameter, with the excep-
tion of mains up to 50 feet long which may be
no less that! six inches in diameter. -
B. The se rvice line from the water main to
the hydrant shall be no less than six inches in
diameter. Any service lines over 50 feet in
length from water main to hydrant shall be no
less than eight inches in diameter.
C. When city streets, or state highways
having water mains in the public right-of-way,
are improved to permanent street or highway
improvement standards, any water mains in
the public right-of-way of said.streets or high-
ways that are substandard as to size . or material
according to applicable city standards s.hall be -
replaced with ductile iron water mains con-
forming to applicable city standards and plans.

19,.25.070 Hydrant specifications.
A. The installation of flush type hydrants
(hydrants entirely below grade) is prohibited.
B. Fire hydrants shall have two two -and -
one -half -inch hose outlets. and one four -and -
one -half -inch pumper outlet. All outlets' ports
shall have national standard thread. Addition-
ally, the pumper outlet shall be provided with
a four -inch Storz adapter. Fire hydrants shall
meet the American Water Works Association,
Standard No. C-502 and current city standards.
C. Fire hydrants and appurtenances shall be
installed - in accordance with generally
accepted engineering practices and city stan-
dards, and to the 'approval of the city engineer,
who shall also approve the selection and use of
all pipe fittings and valves. There shall be a
foot valve installed between the service main
and the hydrant sufficient to permit the repair
and replacement of the hydrant without disrup-
tion of water service. The'foot valve shall be
installed to city standards. The. location of all
such valves installed shall be properly and
accurately marked on as -built plans or draw-
ings with generally acceptable engineering
detail, two copies of which shall be furnished
to the public works department. Valves shall
be furnished with a standard valve box.
D. Hydrants shall stand plumb, be set to
established street arade with the lowest outlet
of the hydrant at least 18 inches above the
adjacent finished grade and at least 36 inches
of clear area around the hydrant for clearance
of hydrant wrench on both outlets and on the
control valve. The pumper port -shall face the
street, as determined by the fire marshal.
E. Where reasonably necessary to protect a
hydrant from damage, the fire marshal may
require hydrants to be protected by two or
more posts, eight inches in diameter by five
feet long, made either of reinforced concrete or
steel.
F. If there presently exist fire hydrants
which do not conform to these requirements,
they shall be replaced with conforming
hydrants upon redevelopment or the timetable
established by the city's comprehensive plan.
A G. No person shall plant any vegetation,
erect any structur6 or perform any action
which results in the obstruction* of a fire
hydrant for a distance of 50 feet along the
immediate route of approach. The owner -
occupant of any area in which a hydrant is
located shall be responsible for removing
weed and.tree growth from around the hydrant
for a distance of not less than five feet. The
purpose of this section is to maintain clear
approach and visual area around the hydrant.
H. The installation of the fire hydrants and
mains may be accomplished by city capital
contract, developers (as a condition of devel-
opment) or public works department employ-
ees. All installations are to be approved by the
city engineer.

19.25.075 Penalties.
A. Any person who violates any of the pro-
visions of the lFC including those standards of
the National Fire Protection Association spe-
cifically referenced in the IFC as adopted and
amended herein or falls to comply therewith,
or who violates or falls to comply with any
order made thereunder, or who builds in viola-
.ti on of any detailed statement of specifications
or plans submitted and approved thereunder,
and from which no appeal has been taken, or
who fails to comply with such an order as
affirmed or modified by decision of the city's
board of appeals or by a court of competent
jurisdiction, within the re ' quired time, shall
severally for each and every such violation and
noncompliance, respectively, be guilty of a
gross misdemeanor, punishable as provided in
ECC 5.50.020.
B. The imposition of one penalty for any
violation shall not excuse the violation nor per-
mit it to continue; and all such persons shall be
required to correct or remedy such violations
or defects within a reasonable time; and when
not otherwise specified, each day that prohib-
ited conditions exist or are maintained shall
constitute a separate offense. The application
of the above penalty shall not be held to pre-
vent the enforced removal of prohibited condi-
tions. [Ord. 3502 § 2, 2004].

Your letter requested our response by June 23rd. This is our written response
letting you know we are making complete application for the required permit
approval.
Since we were out of town and received your letter on June 21 st, we will assume
this letter will serve as notification that we will be applying for a permit
immediately. We assume the whole process will not be impaired while we obtain
the correct forms and go through the required process.
We would like to mention that we were quite surprised since this is a short
extension of our existing fence and is completely on our own private property.
No city easement is recorded on our property description. Our new fence
extension is located on our private property approximately 90 feet from any city
property.
The hydrant adjacent to our property is approximately 6 feet from our fence and
is also on private property. The hydrant on this private property is also located
90 feet from any city property. On our own, with no knowledge of any
requirement, we built a large gate in the fence which provides very easy access
to the hydrant from our private property.
Your letter stated, "it has come to the City's attention that a fence has been
extended on your property". We will also require the source of this information.

RE: Fence interference with City Fire Hydrant
Dear Mr. Kirkpatrick:
It has come to the City's attention that a fence has been extended on your property without first
obtaining City approval and a fence permit. Also, it appears that the fence may interfere with the
use and maintenance of a City Fire Hydrant. Please refer to the enclosed fence handout that
descn*bes when fences are required to obtain a permit.
In order for the City to issue a fence pennit the following documents (at a minimum) are
required:
• Permit Application(s) and fees,
• Plot plan showing the existing property lines, house, driveway, etc.
• The location of the extended fence in relation to the property lines and the City Fire
Hydrant.
Please be advised, the fence cannot extend past your property line into developed or undeveloped
City right-of-way without special approval by the City Engineer. If you suspect that your fence
does encroach onto City property a second permit called an Encroachment Pen -nit would also be
required however, please be advised no Encroachment Permit shall be approved for fences that
obstruct or interferes with a City Fire Hydrant.
Please respond in writing by June 23, 2006 regarding this matter and decide whether you will
remove the fence extension or make complete application for all required permit approvals. If
you have any questions about the permit submittal process please contact a Penult Coordinator at
425-771-0220. Note, since the fence was extended in advance of City approval investigation
fees, in addition to normal permit fees, shall be applied to all permit applications.
