INTRODUCTION Kim Pierce, 726 Hemlock, Edmonds, Washingtonr and hereinafter referred to as Applicant, has requested. approval of a conditional use permit, for tne purpose ot the placement ot 1,0004 cubic yards of fill and the use of the property for outdoor storage on land located at 21104 70th Ave. Westr Edmonds, WA, and more particularly. described as follows: Seattle Heights division 4, block 6, lot 3, except the south 170 feet thereof, as per plat recorded in volume' 9 ot plats on page 11 , records of Snohomish County The above described land is zoned RS-12. A hearing on the request for the conuitional use permit was held before the Hearing Examiner' of the City of Edmonds on June 4, 1981. Slides After due consideration of the evidence presented by the Applicant; evidence elicited from the public hearing; and as a result Of the personal inspection of the subject property and the surrounding areas by the Hearing Examiner, the following findings of fact and conluclusions constitute the basis of the decision ot the Hearing Examiner. 0 IN 11 Findings of the Hearing Examiner cu-26-81 Page 2 E III PTNDTNGS DE Z=T 1. The Applicant has request,ed approval of a conditional 1,001� use Cubic yards permit for the purpose of permitting fill Ot and the allowance of outdoor storage on prope t located at 'or 211U4 7Uth Ave. West, Edmonds, WA, and i e articulariy described as set forth above. 2. The above described property is zoned CG-General C: Edmond mmercial as Community established in Chapter 16.60 of the Development Code. 3. The Comprehensive policy Plan map designates the ; rea in wnich the property is located as high density residenti 1. 4. The property is on a lot that is 104.6 feet x 192.5 feet or 20,135 square feet. 5. The subject property as it currently exists is un eveloped. 6. The Applicant is submitting his application has submitted a plot plan which was submitted as exhibit 3 to th hearing and is attached hereto and by this reference is inc rporated as part of these findings. 7. As shown on the plot plan a building is to be etected of on the. the subject subject property at the northwest corner property. B. That portion of the lot where tne building is to be located of will be lower than the street grade from the acc ss street 70th Ave. West. 9. The proposed fill is for the purpose ot leveling ut tne grade building for the property in order to construct the prop sed on the site. 10. The site is to be used as a storage area for wreCKed the wrecked automobiles. The Applicant testified that to the neighborhood automobiles would not provide any eyesore or vicinity because it will be screened with 6 foot high fence. It appears that the! property owner to tnel drained , 0 northwest ot m water down the subject property has for years through the subject property. There have been1no easements acquired for this storm drainage line. The City Ihas requested that tnis drainage control as installed by the property with the d owner ainage plan to the northwest be considered submitted at the time of the applicaition for tne building permit. 11. In order for a conditional use permit to be gran ed within tne City of Edmonds the application must meet the r quirements as set forth in Chapter 20.05. 2 PRO Findings of the Hearing Examiner CU-26-81 Page 3 12. The fill that is proposed to be brought into the suoject property in order to level it to street level and the outdoor storage ot wrecked automobiles appears to be consistent with the goals and policies of Chapter 15.20.020 of I the Edmonds Community Development Code. 13. The proposed fill and storage of vehicles appears to be consistent with the zoning ordinances of the City of Edmonds and in particular the CG zoned district. 14. The proposed use will not be detrimental to adjacent properties or improvements. 15. 'The conditional use permit for the wrecKed automobiles should not be transferable. 16. The conditional use permit for the allowance of f ill on the subject property should be transferable. The planning statt of the city of Edmonds recommended that the conditional use permit request of the Applicant be granted sunject to the following conditions: 1. Temporary erosion control plan shall be required prior to the issuance of a building permit for this fill. 2. Comply with all ADB recommendations. 3. The condiitional use permit tor outdoor storage should not be transferable and should be limited to wrecked automobiles. 18. The Applicant testified to be in agreement with the 6': recommendations of the Planning Department. sted conditional use 19. There was no opposition to the reque permit. The application is for the approval of a conditional use I ot 1,004 cubic yards permit for the purpose of allowing fil and outdoor storage for wrecked automobiles on property located at 21104 70th Ave. West, Edmonds, WA, and more particularly described as set forth above. The subject property is zoned CG. 2. The proposed conditional use permit is consistent with the i goals and policies of Chapter 15.20.005 of the Comprehensive Plan ot the City of Edmonds. 3. The proposed conditional use permit is consistent with the zoning ordinances in the CG zoned districts of the City of Edmonds. 3 UNAMOMMIMMI ZZ OP I 4. The conditional use permit for the storage of wrecKed automobiles should not be transferable. 6. The conditional use permit for the allowance of fill of 1,004 cubic yards of fill should be transferable. 7. The conditional use permit request meets all ot the criteria 20.05.010 of the City of Edmonds as set forth in section Community Development Code. 8. The planning staff of the City of Edmonds has recommended approval of the conditional use per mit subject to the conditions listed in finding no. 17. Using the above findings and conclusions as the basis of the it is decision of the Hearing Examiner of the City of Edmondst hereby ordered that the conditional use permit request ed by Kim Pierce for outdoor storage of wrecked automobiles and an allowance ot fill ot IjO04 cubic yards for property located at 21IU4 7utn Ave. West, Edmonds, WA, and more particularly described in the introduction to this document is granted subject to the following conditions: 1. A temporary erosion control plan is required prior to the issuance of any building permit for the fill allowed in this conditional use permit. 2. The Applicant is to comply with all ADB recommendations. 3. The conditional use permit for the outdoor storage should not be transferable and is limited strictly to wrecked automobiles. 4. The conditional use permit for the fill to be brought into the subject4 is'prantea. 5. The Applicant is to properly screen the property with z. 6 foot high fence in order to prevent any aesthetic problems to the neighborhood. 6.
