THAT CERTAIN PRIVATE ROAD OVER LOT 7, BLOCK 5, ALDERWOOD MANOR NO. 9 DESCRIBED AS
THE SOUTH 50 FEET OF THE EAST 135 FEET OF THE NORTH 330 FEET, AND THE WEST 50 FEET OF
THE EAST 135 FEET, EXCEPT THE NORTH 280 FEET THEREOF.
The easement area is depicted in the drawing attached as Exhibit A.
THE CITY agrees to restore to substantially the original condition such improvements as are disturbed
during the construction, maintenance, and repair of said utility or utilities, provided the grantors, their heirs, or
assigns shall not construct any permanent structure over, upon, or within the permanent easement.

DETENTION PIPE (JIM SMITH'S SHORr PIAT)
On March 2, 1987, 1 inspected the interior of the 36" detention pipe
installed in Jim Smith's short plat. The gaps at the joints,
discovered on previous inspections, have been covered with an asphaltic
emulsion. This material was of a runny consistency, and, consequently,
it is impossible to determine if this will be a satisfactory plug for
the gaps between the pipes. The intent is to stop the pipe from
leaking. (See the attached letter to Jim Smith for a history of this
pipe.)
At the present tine, I feel this my be the best product we can get
with the given circumstances. I recommend that we accept the pipe,
aware of the existing limitations. I feel that we should determine if
it is necessary to use scime of the bond mney for road repairs prior to
releasing the bond.

I am writing in response to your request for a list of conditions
required in order to proceed with the subject development. In order to
do this, it is necessary to list the problems with the existing systems
and the events leading up to the present.
1) The existing system is too small.
2) The work was buried without an inspection.
3) An observation pit had to be dug in the new asphalt.
4) Large gaps exist at the pipe joints.
5) Difficulty trying to resolve the problem with your contractor.
We are willing to issue the second building permit based on the
following conditions:
1) The existing joints shall be sealed and inspected to our
satisfaction.
2) The observation pit shall be filled with crushed rock, compacted
to City standards and paved with 3" of ACP.
3) The drainage deficiencies shall be addressed with an on -site
system on lot 3 prior to issuing the remaining building permit.
In a separate matter, it is necessary to Ifint out that this is not a
final punch list for the subject plat. Other items, such as the
failure of the road, will need to be repaired to City standards even

With respect to the subject project, it appears necessary to clarify a
few things. First, I concur with your interpretation of the standard
specifications. It very clearly states that, if required in the plans,
a storm sewer can be tested by exfiltration.
You will recall, that storm sewer was installed and backfilled without
an engineer from the City'inspecting it. In addition, there was some
question about the size of pipe installed. The receipts that you gave
us show 36" diameter pipe and the approved plan shows 42" diameter (73%
of the required volume).
We attempted the exfiltration test not to "test" the pipe, but to
establish the amount of capacity available in the buried pipe. We
tried to fill the pipe from a nearby fire hydrant. The meter on the
hydrant indicated that we had put sufficient water in the pipe to fill
it, and yet there was no visible indication that the pipe was filling
with water.
At that time, it was agreed that I would make a visual inspection of
the pipe from the inside after your crew removed the end section. Upon
entering the pipe, I found the ends of the pipes to have up to 2" of
gap between them. This certainly explains why the system failed to
hold water. This information was relayed to one of your crew. At a
later date, we found your crew trying to seal the gaps with "rubberized
acrylic caulk." A subsequent exfiltration test indicated the pipe
still fails to hold water. Since it was the intent of this pipe to
hold water, and since it fails to hold water, the pipe does not serve

We believe we have installed the retention on Mr. Smith's
short plat to meet the necessary requirements. You have physically
inspected the inside of the pipe, the bands and the grade, and to our
knowledge you have found no problem.

Regarding your requirement to have the pipe water tested,
I believe, in reading to me the requirements for testing storm., that
you are assuming that all storm is tested. The fact is that most all
storm installed in all of our surrounding areas, including Snohomish
and King Counties, is not required to be tested, so plans do not call
for pipes to be constructed of material to be tested. In the plan for
Mr. Smith, which was designed by Lovell-Sauerland and approved by the
City, item 7 in the general notes calls for galvanized or aluminum
piDe, which is a material that is not designed nor built to be pressure
tested in any form. Refer to the enclosed letter from the Marketing
Manager for Cascade Culvert Corp. who manufacture and distribute metal
pipe in the 3 Western States and Alaska. Also refer to the insert which
refers to testing of storm drains constructed of premiable materials,
which the aluminum pipe is not.
Mr. Smith has posted a cash performance bond, so I see no
need to withold the building permits on these lots.

I previously offered to work with the developer in an attempt to come
up with a way to compensate for the 27% + deficiency in detention
volume. This offer still stands. However, as this system currently
exists with the introduction of a large volume of water under the road,
the system is not in accordance with generally accepted engineering
practices.

Cascade Culvert had no knowledge that the pipe Supplied was to
be water tested.
Corrugated metal pipe typically will not pass any form of pressure
test at the joint or the helical lockseam.
It has been our experience that when tested storm sewer is required,
it will be specified on the engineer's plans.
Any questions regarding this or future storm sewer applications,

1. Silt fences and filter bartiers shall be inspected i"diately after
each rainfall and at least daily during prolonged rainfall. Any
required repairs shal I be made immediately.
2. Should the fabric on a silt fence orl filter barrier de�lompose or
become ineffective prior to the end*pf the expected us4ble life and

3.� Sediment deposits should be removed after each storm ejent. They
