STAFF FINDINGS AND CONCLUSIONS:
A. Description of the Subject Property and Surrounding Area
The subject property is located on the southwest corner of
the intersection of 212th St. S.W. and 72nd Ave. W. The
property is developed with a professional office building.
The property owner removed the approved landscaping because
of frequent destruction of the sprinkler system by people
walking through the area. Further, the trees that were
planted in the subject area obscured the view of the owneris
new business sign. The owner filled the area where the
landscaping was removed with rocks.
In May of this year, the City notified the owner that he was
in violation of Section 17.80 of the Edmonds Community
Development Code.
The Applicant is seeking a variance to allow planter boxes
to replace the landscaping in an 108' section of the street
frontage along 212th St. S.W. The proposal calls for three
6' x 15' planters. Each planter with have a mixture of
junipers, azaleas, and Japanese maple trees.
Surrounding development is a mixture of multifamily and
commercial development.

1. Special Circumstances
No special circumstances appear to exist in this
particular case. While it is regrettable that the
property owner has had problems with people destroying
his landscaping, removing all the landscaping was not
necessary.
2. Special Privilege
The proposed variance does appear to represent a grant
of special privilege. Other measures could be taken to
alleviate the problems of people walking through the
landscaping.
3. Comprehensive Plan
The Comprehensive Policy Plan map designates the
subject property as Commercial/Business, as are the
adjacent properties.
The proposed variance does appear to conflict with the
purposes of the Comprehensive Plan. Section 15.15.030
(d) of the ECDC states the landscaping should be used
as a visual screen in and around parking lots.
4. Zoning Ordinance
The subject property, as well as the surrounding
properties to the south, north and west, is zoned CG2.
To the east, the adjacent property is designated as CG
in Snohomish County.
The proposed variance does appear to conflict with the
purposes of the zoning ordinance and the CG2 zone
district.
5. Not Detrimental
The proposed variance does not appear to pose any
significant impact to the public or to any near by
private property or improvement.
6. Minimum Variance
The requested variance does not appear to represent a
minimum variance request.

FINDINGS OF FACT
The Applicant has requested approval of a variance to
reduce the required 15' street landscaping requirement
at 21200 - 72nd Avenue W, Edmonds, Washington. The
property is located on th6 southwest corner of the

The Edmonds Community Development Code (ECDC)

the trees that were planted on the landscaped area
have been damaged by pedestrians. In order to solve
this problem -the Applicant removed the sprinkler system
and the trees and filled the -area with 1" by 1 1/2"
gravel. (Bowman testimony)
4. The Applicant is seeking a variance to allow the gravel
to remain and to allow a planter box to be located in
the landscaped. area. The Applicant originally
submitted a prop6sal to the Architectural Design Board
(ADB) for placement of three planter boxes with di-
mensions of 4' by 12'. The ADB rejected this request
and instructed the -Applicant to increase the size of
the planter box to 61 by 15'. Upon review of the
increased size -of the planter boxes the ADB rejected
the proposal for this type of landscaping by the
Applicant.
Thus, the request of the Applicant for a variance
to allow planter boxes to replace the required,15'
street landscaping i * s moot. However, the request
for a variance from the landscaping standards of ECDC
16.60.020A is a request in which a decision can be
made. (Bowman testimony, Responte testimony)
5. In order for a variance to be granted within the City
of Edmonds, the criteria as set forth in ECDC 20.'85.01.0
must exist. Those criteria include-:

A. Because of the special circumstances relating to
the property, the strict enforcement of the zoning
ordinance would deprive the owner of use rights
and privileges permitted to other properties in
the vicinity with the same zoning.
B. The approval of the variance would not be a grant
of special priviliage to -the property in comparison
with the limitations upon other properties in the
vicinity with the same zoning.
C. The approval. of the variance will. be consistent
with the Comprehensive Plan of the City Of
Edmonds.
D. The approval of the variance will be consistent
with the purposes of the zoning ordinance and the
zone district in W'hich the property is located.
E. The variance as approved ' or conditionally approved
will not be significantly detrimental to the
public health, safety and welfare or injurious to
the property or improvements in the vicinity and
same zone.
F. The requested variance is the -minimum necessary to
allow the owner the rights enjoyed by other pro-
perties in the vicinity with the same zoning.

6. The Planning Department submitted that no special
circumstances*exist and that the Applicant should -be
require . d to adhere to the landscaping standards of
the code. (BowmCan testimony)
7. The Applicant submitted that the development of
the nearby apartment building in -the area, and the
recent opening of a video rental store on a corner
lot across the street from the landscaped portion of
the property, have made it impossible to control and
maintain the landscaping of the site.
8. The Planning Department submitted that the grant of a
variance would be the grant of a special privilege to
the Applicant. According to the Planning Department,
there are solutions to the destruction of the land-
scaping by pedestrians. (Bowman testimony)

9. The Applicant submitted that he had spent approximately
$1,000 replacing the old landscaping and putting in
gravel. To remove the gravel would be a loss of this
investment. (Responte testimony)
10.' The comprehensive policy map of the City of Edmonds
designates the subject property as commercial business.
The Planning Department submitted that ECDC 15.15.030
(D) requires landscaping be used as a visual screen in
and around parking lots. According to the Planning De-
partment, removal of the landscaping would not
adequately screen the parking lot adjacent
to it. (Bowman testimony)
11. The Planning Department recommended denial of the
variance. They submitted:
a) Other measures could have been taken to resolve
the property ownerls problems. They include:
fencing, a pathway, a hedge, or a combination of
any of these items.

12. A witness, Jim Tandoo, submitted to be the property
owner west of the subject property. His property is
developed with a single family residence, although it
is zoned general commercial. The witness submitted
that the variance should not be granted because the
landscaping is a benefit to the site. (Tandoo tes-
timony)
13. A witness, Mary Davis, submitted that the gravel -that
is on site will be used by children for throwing rocks.
She recommended removal of the gravel. (Davis
testimony)
CONCLUSION
1. This application 'is for the approval of a variance to
eliminate the required 15' street landscaping require
ment at 21200 - 72nd Avenue W, Edmonds, Washington.
2. Although the Applicant's original request to the ADB
for a planter box to replace the required 15' land-
scaping was denied, the request for the elimination of
the landscaping is active. The specific land . scaping
request before the ADB is MOOt.

flict with the putposes of general commercial zones.as
set forth in ECDC 16'.60.005. -These purposes specifi-
cally listed in A through D of this section, do not
address landscaping.
8. The requested variance would create an impact to the
public because 21.2th and 72nd Avenue W are arterial
streets and landscaping is required to create aesthetic
relief on these thoroughfares. Removal of som I e land-
scaping will impact the public.
9. Other possibilities for resolving the Applicant's
problem exist.
DECISION
Based -on t I he p . receding Finding of Facts and Conclusions, and
the public testimony and exhibits presented at the public
hearing, it is hereby ordered that the requested variance
for relief from the requirements of ECDC 16.60.020 for a
street setback -area -to be fully landscaped at property
located at 21200 72nd Avenue W, Edmonds, Washington, is
denied.

rnMMENTS
The Applicant has presented a difficult problem. As noted
in the Findings, his property is well -maintained and is in
good repair. His property had been landscaped properly, and
had met the standards as set forth in the ECDC. However,
with the 'development of an apartment building and the
opening of a video rental store in the area, the Applicant's
property became a convenient pathway for the residents and
customers of these concerns. The landscaping that existed
on site was destroyed and the sprinkling system to maintain
the landscaping was ruined. In order to alleviate these
problems, the Applicant placed the 1" by 1 1/211 gravel in
the landscaping strip. The end result, was that there was
no landscaping, contrary to the standards of the City of
Edmonds.
To grant a variance from the landscaping standards will not
solve the problem. To do so would give a signal to the City
that if landscaping can not be maintained then no land-
scaping should be required. This policy would not be in the
best interests of the City.
A more thoughtful and constructive approach to this problem
would be cooperation of the Applicant, the apartment owner-
ship and the video rental owners. The Applicant is en-
couraged to talk to these individuals about the possibility
of relandscaping the strip in a manner that will not be
subject to further abuse. Through the use of hedges,
fences, shrubs, 1 ' ow lying bushes and other means, the
property can be landscaped and protected. Although the
Hearing Examiner and the City have no authority to require
the participation of the apartment or the video store,
equity would appear to exist for their participation.
