On February 27, 2008, the City of Edmonds sent you a letter regarding your driveway
access off 84 1h Avenue West. In that letter,;it was indicated to you that the pavers were to
be removed or that a Right -of -Way Permit was to be obtained for you to construct a curb
cut to allow for the referenced driveway access. To date, neither option has occurred.
Please note that the City is now requiring the pavers to be removed by June 23, 2008
or a permit must be in place by June 12, 2008 to prevent further action by the City
Code Enforcement Officer.

I have reviewed your notice of appeal dated January 23, 2008. Unfortunately, since we
received a land use complaint about your driveway access off 84h Avenue West, we must
review the complaint and remain consistent when applying Edmonds City Codes.
Edmonds Community Development Code (ECDC) I 8.80.060(A) clearly states that a
driveway will not be constructed without a permit.
The driveway access off 84 1h Avenue West in question, appears quite clearly to be used
for vehicle and/or boat trailer access to the area on the side of your house presently being
used to park a boat. Therefore, my interpretation is that it is a driveway. Since it was
constructed without a permit, you must either:
1. Remove the existing driveway pavers, or
2. If you would like to continue to have this driveway access off 84 1h Avenue West,
submit an application fo ' r a Right -Of -Way Construction permit. This will require
you to install a curb cut constructed in accordance with Edmonds Standard Detail
E2.26, a copy of which has been previously provided to you.

I would like to appeal the decision of the City of Edmonds on above stated location in regards
to the driveway access deemed to, be in violation of ECDC 18.80.060. 1 have discussed this with
Jennifer Collins and was advised that this would be the next step to take.
First, over two years ago when this was considered, I stopped by the planning department to
inquire if permits were needed and if so which forms were needed. The person at the desk looked
the property up on the map and inquired about what was going to be done. I was advised that if
no more than 10 yards of soil were being moved then no permit was required. She asked if I
would like a curb cutout (my assumption was that the city provided this (at a fee of course)). My
response was that I did not need one as it would rarely be used anyway. She said I would be fine
to proceed. I did not know that written approval was needed to do something for which no'
approval or permits were required, so I did not get this in writing.
Second, from my discussions with Jennifer, I believe what it comes.down to is the definition of
"driveway access" for which I could not find anything defined within the Edmonds City Codes.
There is no mention of size (this is a very small spot); there is mention of a "driveway" being
made out of asphalt concrete pavement of which this small area is not. The area in question i�\
more closely resembles a small patio made of some bricks.
Lastly I would like to say that I am more than happy to work with the city to find that this is in
compliance and help to make it so. I consider this to be more of a patio than any type of
driveway. But without an actual definition it is hard to know what guidelines to go by. I know
this was the result of a compliant which you are obligated to follow up on. And also know the
source of the compliant as the rest,of the neighbors would have mentioned their disapproval
when it wa ' s being, done. The ones who did comment actually said it looked nice. Since this
compliant I have noticed many others in the neighborhood who have done similar but much
more extensive projects and the chances that they obtained the needed permits, I would bet, are
small.
Please let me know what we can do to resolve this as quickly and easily as possible.

Ave W. Subsequently a site visit was performed and it was determined that the driveway
approach has not been constructed in accordance with the City Standards and Edmonds
Community Development Code, 18.80.060.
One of two actions needs to occur:
1) You will need to apply for a Right of Way Permit for review and approval to
construct a driveway approach off 84 1h Ave W. I have attached a copy of City
Standard details, E2.26 of the driveway approach.
2) Or, the existing driveway pavers can be removed in order to alleviate any
violations with regards to the driveway access.

18.80.060
All streets and access easements must*be
paved to a minimum width of 16 feet unless
otherwise provided herein and developed in
accordance with the city of Edmonds' street
standards, on file in the city engineer's office.
This paving requirement does not pertain to
alleys as defined in ECDC 21.05.025.
The fight -of -way and paving requirements
will apply to any property upon subdivision or
for multi -family or commercial purposes. They
shall not be required for the development of a
single residential (RS -single- fami I y) lot on an
existing street or access easement unless devel-
opment impacts are required to be mitigated as
a condition of SEPA approval or of issuance of
a variance, conditional use permit, or other
grant of pern-fit requiring compliance with the
provisions of the Edmonds Comprehensive
Plan. [Ord. 3594 § 1, 2006; Ord. 2713, 1989;
Ord. 2528, 19851.
18.80.020 Plans and specifications.
A. Required. A plan and profile of the pro-
posed street, showing the following data, shall
be submitted to the public works director for
approval before construction or the issuance of
a building permit for any structure within a
subdivision and before construction or issu-
ance of a building permit for any commercial
or multiple residential building.
B. Plan.
1. Street alignment in stations of 100-
foot intervals;
2. Bearings on street center line;
3. Curve data on all horizontal curves;
4. Right-of-way lines and widths for
proposed streets and side streets;
5. All topography within the right-of-
way limits including all utilities;
6. Names of all streets and adjoining
subdivisions;
7. Typical roadway section of proposed
street;
8. Existing and proposed drainage struc-
tures (indicate direction of flow) and ease-
ments;
9. Suggested map scale F= 100' or F=
50'.
C. Profile.
1. Original ground line;
2. Stationing intervals of 100 feet;
3. Control elevation on border of sheet;
4. Grade line showing percents and ver-
tical curves;
5. Indicate datum used and all bench
marks;
6. Profile scale shall be yertical F = 10'
or F= 5% horizontal F = 100'or F= 50'.
18.80.030 Storm drainage.
Adequate provision shall be made for storm
drainage. The minimum standards for drainage
shall be as approved or directed by the public
works director.
18.80.040 Surfacing and base
preparation.
Street surfacing and base preparation s�all

be in accordance with standards adopted y the
public works director.
18.80.050 Utilities.
Locations for utilities shall be shown on the
engineer's drawing provided for in this chap-
ter. The public works director may authorize
deviations in the case of special circumstances
due to topographical configurations, existing
and proposed development or other engineer-
ing considerations. Mains and service connec-
tions to all lots shall be completed prior to
placing or replacing any surfacing materials.
The construction of underground utilities shall
conform to the Standard Specifications for
Municipal Public Works Construction adopted
by this chapter.
18.80.060 � Driveway and curb cut
requirements.
A. Permit Required. No person shall begin
work on the- construction alteration, repAilki—or
removal of any driveway or the paving of any
parking strip on any or adjacent to any street,
alley or other public place in the city, without

first obtaining a permit from the public works
director. Fees shall be as set forth in Chapter
15.00 ECDC.
B. Location.
1. No driveway shall be so located as to
create a hazard to pedestrians, bicyclists or
motorists or invite or compel illegal or unsafe
traffic movements.
2. Unless otherwise approved by the
public works director, all driveways including
the returns shall be confined within lines per-
pendicular to the curb line and passing through
the property comers.
3. No driveway shall be constructed in
such a manner as to be a hazard to any existing
street lighting standard, utility pole, traffic reg-
ulating device, or fire hydrant. The cost of
relocating any such street structure when nec-
essary to do so shall be paid by the abutting
property owner. The relocation of any street
structure shall be allowed only on approval of
the person owning the structure involved. -
4. On private property every driveway
must provide access to parking structures or
access specifically designated for parking pur-
(poses requiring the entrance of vehicles.
5. Downtown Businesskfea. Within the
downtown business area of the city as defined
in ECDC 17.50.070, vehicular access shall be
provided from alleyways for all on -site park-
ing whenever it is practically and reasonably
available. No curb cut shall be approved where
there is vehicular access to a lot in the down-
town area from an existing alleyway unless the
applicant demonstrates by substantial evi-
dence that:
a. One of the following conditions
exist:
i. No alleyway exists which would
provide reasonable vehicular access to the sub-
ject property; or
ii. Access from an existing alley-
way . would substantially impair reasonable
access to an abutting public street or utility
because of circumstances related to site size,
topography or orientation; or
iii. Access can be provided from
an existing or relocated driveway or curb cut in
a manner which preserves or enhances street
parking; or
iv. Providing access from a point
other than the alley would promote traffic
safety, or otherwise better promote the pur-
poses of the transportation element of the com-
prehensive plan.
b. The application complies with all
other criteria of the community development
code.
c. In such cases, the city engineer
may then consider use of an existing common
driveway or other alternative. Only when no
other reasonable alternative exists for access to
a property will a curb cut be approved which
results in the loss of existing on -street parking.
No more than one access point perlot will be
permitted in the downtown business area. The
city engineer's decision to approve alternative
access shall be processed in accordance with
ECDC 20.95.050.
C. Size and Number.
1. Except as otherwise provided, the
width of any residential driveway shall not
exceed 20 feet exclusive of the radii of the
turns, with such measurement being made par-
allel with the center line of the street. Drive-
way approaches shall extend from the edge of
the existing street a distance of 20 feet or to the
edge of the property line, whichever is greater.
Approaches shall be constructed of asphalt
concrete pavement or an equivalent approved
by the city engineer. The standard width for
commercial and other nonresidential streets
shall be 30 feet. At the application of the appli-

cant or the city engineer, additional width in
excess of the established standard 'may be
approved as a staff decision to a maximum
width of 40 feet. Such decision shall be made
only after notice and hearing in accordance
with provisions of ECDC 20.95.050. Such
application shall be approved only if. (a) it
conforms to the provisions of the comprehen-
sive plan; (b) is found to be in the public inter-
est when the needs of the applicant are
reviewed and balanced in light of the benefits
to the general public and the impacts, if any, on
the immediate neighborhood; and (c) is consis-
tent with or enhances public safety and will not
create a hazard to vehicular, pedestrian or
bicycle traffic. The public works director may
authorize additional residential driveway
width for three -car garages and for access
driveways necessary for off-street parking or
recreational vehicles.
D. Driveway Slopes.
1. Driveway slopes shall not exceed 14
percent unless authorized by the public works
director as set forth below.
2. The public works director may autho-
rize driveway slopes to exceed 14 percent, up
to a maximum of 20 percent, if he determines
that:
a. The driveway is the only economi-
cally and environmentally reasonable alterna-
tive;
b. The driveway will not present a
traffic, pedestrian, bicycle or safety hazard;
c. The police and fire chief concur in
allowing the increased driveway slope;
d. The public health, safety and gen-
eral welfare will not be adversely affected.
3. The public works director shall place
in the appropriate city file, a signed, written
statement of findings and reasons for authoniz-
ing the driveway slope to exceed 14 percent.
The statement shall also contain the maximum
slope authorized up to 20 percent. [Ord. 3302
§ 1, 2000; Ord. 3132 § 1, 1997; Ord. 2713,
1989].
18.80.070 Street slope requirements.
A. Street slopes shall not exceed 12 percent
unless authorized by the public works director
as set forth below.
B. The public works director may authorize
street slopes to exceed 12 percent, up to a max-
imum of 15 percent, if the director determines
that:
1. The street as proposed is the only eco-
nomical and enviromentally reasonable alter-
native;
2. The street as proposed will not create
a traffic, pedestrian or bicycle hazard or other-
wise negatively impact the safety of its use;
3. The police and fire chiefs concur in
the increased street slope; and
4. The public health, safety and general
welfare will not be adversely affected.
C. The public works director shall place in
the appropriate city file, a signed, written state-
ment of findings and reasons for authorizing
the street slope to exceed 12 percent. The state-
ment shall also contain the maximum slope

The City of Edmonds has received a complaint regarding the driveway access off 84 th
Ave W. Subsequently a site visit was performed and it was determined that the driveway
approach has not been constructed in accordance with the City Standards and Edmonds
Community Development Code, 18.80.060.
One of two actions needs to occur:
1) You will need to apply for a Right of Way Permit for review and approval to
construct a driveway approach off 84th Ave W. I have attached a copy of City
Standard details, E2.26 of the driveway approach.
2) Or, the existing driveway pavers can be removed in order to alleviate any
violations with regards to the driveway access.

18.80.060
All streets and access easements must.'be
paved to a minimum width of 16 feet unless
otherwise provided herein and developed in
accordance with the city of Edmonds' street
standards, on file in the city engineer's office.
This paving requirement does not pertain to
alleys as defined in ECDC 21.05.025.
The right-of-way and paving requirements
will apply to any property upon subdivision or
for multi -family or commercial purposes. They
shall not be required for the development of a
single residential (RS-single-family) lot on an
existing street or access easement unless devel-
opment impacts are required to be mitigated as
a condition of SEPA approval or of issuance of
a variance, conditional use permit, or other
grant of permit requiring compliance with the
provisions of the Edmonds Comprehensive
Plan. [Ord. 3594 § 1, 2006; Ord. 2713, 1989;
Ord. 2528, 1985].
18.80.020 Plans and specifications.
A. Required. A plan and profile of the pro-
posed street, showing the following data, shall
be submitted to the public works director for
approval before construction or the issuance of
a building permit for any structure within a
subdivision and before construction or issu-
ance of a building permit for any commercial
or multiple residential building.
B. Plan.
1. Street alignment in stations of 100-
foot intervals;
2. Bearings on street center line;
3. Curve data on all horizontal curves;
4. Right-of-way lines and widths for
proposed streets and side streets;
5. All topography within the right-of-
way limits including all utilities;
6. Names of all streets and adjoining
subdivisions;
7. Typical roadway section of proposed
street;
8. Existing and proposed drainage struc-
tures (indicate direction of flow) and ease-
ments;
9. Suggested map scale I" = 100'or F=
50'.
C. Profile.
1. Original ground line;
2. Stationing intervals of 100 feet;
3. Control elevation on border of sheet;
4. Grade line showing percents and ver-
tical curves;
5. Indicate datum used and all bench
marks;
6. Profile scale shall be yertical F= 10'
or F = 5% horizontal I " = 100' or F = 50'.
18.80.030 Storm drainage.
Adequate provision shall be made for storm
drainage. The minimum standards for drainage
shall be as approved or directed by the public
works director.
18.80.040 Surfacing and base
preparation.
Street surfacing and base preparation shall
be in accordance with standards adopted by the
public works director.
18.80.050 Utilities.
Locations for utilities shall be shown on the
engineer's drawing provided for in this chap-
ter. The public works director may authorize
deviations in the case of special circumstances
due to topographical configurations, existing
and proposed development or other engineer-
ing considerations. Mains and service connec-
tions to all lots shall be completed prior to
placing or replacing any surfacing materials.
The construction of underground utilities shall
conform to the Standard Specifications for
Municipal Public Works Construction adopted
by this chapter.
18.80.060 Driveway and curb cut
requirements.
A. Permit Required. No person shall begin
work on the construction alteration, repaik, or
removal of any driveway or the paving of any
parking strip on any or adjacent to any street,
alley or other public place in the city, without

first obtaining a permit from the public works
director. Fees shall be as set forth in Chapter
15.00 ECDC.
B. Location.
1. No driveway shall be so located as to
create a hazard to pedestrians, bicyclists or
motorists or invite or compel illegal or unsafe
traffic movements.
2. Unless otherwise approved by the
public works director, all driveways including
the returns shall be confined within lines per-
pendicular to the curb line and passing through
the property comers.
3. No driveway shall be constructed in
such a manner as to be a hazard to any existing
street lighting standard, utility pole, traffic reg-
ulating device, or fire hydrant. The cost of
relocating any such street structure when nec-
essary to do so shall be paid by, the abutting
property owner. The relocation of any street
structure shall be allowed only on approval of
the person owning the structure involved.
4. On private property every driveway
must provide access'to parking structures or
access specifically designated for parking pur-
poses requiring the entrance of vehicles.
5. Downtown Business Area. Within the
downtown business area of the city as defined
in ECDC 17.50.070, vehicular access shall be
provided from alleyways for all on -site park-
ing whenever it is practically and reasonably
available. No curb cut shall be approved where
there is vehicular access to a lot in the down-
town area from an existing alleyway unless the
applicant demonstrates by substantial evi-
dence that:
a. One of the following conditions
exist:
i. No alleyway exists which would
provide reasonable vehicular access to the sub-
ject property; or
ii. Access from an existing alley-
way would substantially impair reasonable
access to an abutting public street or utility
because of circumstances related to site size,
topography or orientation; or
iii. Access can be provided from
an existing or relocated driveway or curb cut in
a manner which preserves or enhances street
parking; or
iv. Providing access from a point
other than the alley would promote traffic
safety, or otherwise better promote the pur-
poses of the transportation element of the com-
prehensive plan.
b. The application complies with all
other criteria of the community development
code.
c. In such cases, the city engineer
may then consider use of an existing common
driveway or other alternative. Only when no
other reasonable alternative exists for access to
a property will a curb cut be approved which
results in the loss of existing on -street parking.
No more than one access point per.lot will be
permitted in the downtown business area. The
city engineer's decision to approve alternative
access shall be processed in accordance with
ECDC 20.95.050.
C. Size and Number.
1. Except as otherwise provided, the
width of any residential driveway shall not
exceed 20 feet exclusive of the radii of the
turns, with such measurement being made par-
allel with the center line of the street. Drive-
way approaches shall extend from the edge of
the existing street a distance of 20 feet or to the
edge of the property line, whichever is greater.
Approaches shall be constructed of asphalt
concrete pavement or an equivalent approved
by the city engineer. The standard width for
commercial and other nonresidential streets
shall be 30 feet. At the application of the appli-

cant or the city engineer, additional width in
excess of the established standard' may be
approved as a staff decision to a maximum
width of 40 feet. Such decision shall be made
only after notice and hearing in accordance
with provisions of ECDC 20.95.050. Such
application shall be approved only if (a) it.
conforms to the provisions of the comprehen-
sive plan; (b) is found to be in the public inter-
est when the needs of the applicant are
reviewed and balanced in light of the benefits
to the general public and the impacts, if any, on
the immediate neighborhood; and (c) is consis-
tent with or enhances public safety and will not
create a hazard to vehicular, pedestrian or
bicycle traffic. The public works director may
authorize additional residential driveway
width for three -car garages and for access
driveways necessary for off-street parking or
recreational vehicles.
D. Driveway Slopes.
1. Driveway slopes shall not exceed 14
percent unless authorized by the public works
director as set forth below.
2. The public works director may autho-
rize driveway slopes to exceed 14 percent, up
to a maximum of 20 percent, if he determines
that:
a. The driveway is the only economi-
cally and environmentally reasonable altema-
tive;
b. The driveway will not present a
traffic, pedestrian, bicycle or safety hazard;
c. The police and fire chief concur in
allowing the increased driveway slope;
d. The public health, safety and gen-
eral welfare will not be adversely affected.
3. The public works director shall place
in the appropriate city file, a signed, written
statement of findings and reasons for authoriz-
ing the driveway slope to exceed 14 percent.
The statement shall also contain the maximum
slope authorized up to 20 percent. [Ord. 3302
§ 1, 2000; Ord. 3132 § 1, 1997; Ord. 2713,
19891.
18.80.070 Street slope requirements.

imum of 15 percent, if the director determines

DECISION: The appeal is denied and the decision of the Plann-ing
Department dated September 28, 1989, is upheld.
INTRODUCTION
On September 20, 1989, the City of Edmonds Planning Department
granted preliminary approval for a three lot subdivision on
property located at 21308 - 84th Avenue W, Edmonds, Washington
98020. The approval was granted subject to conditions. Pursuant
to the administrative procedure of the City of Edmonds, Rosemary
and Paul Wheaton (hereinafter referred to as "Appellants"), 21224
- 84th Avenue W, Edmonds, Washington, filed an appeal. The basis
of their appeal of October 4, 1989, was objection to access for
the proposed development.
A hearing on this appeal was held before the Hearing Examiner of
the City of Edmonds on November 2, 1989.

After due consideration of the evidence presented by the Appellant
and the Appellant; and evidence elicited during the public
hearing; and as a result of the personal inspection of the subject
property and surrounding areas by the Hearing Examiner, the
following Findings of Fact and Conclusions constitute the basis of
the decision of the Hearing Examiner.
FINDINGS OF FACTS
1. Donald and Grace Cote (Applicants) requested approval of a
three (3) lot subdivision on property located at 21308 - 84th
Avenue W, Edmonds, Washington. The City of Edmonds conducted an
administrative review of the Applicant's request, and on September
20, 1989, the City of Edmonds Planning Department granted preli-
minary approval for the proposed 3 lot subdivision, subject to
conditions.
2. The approved access for the proposed subdivision was a 20
foot lane with a half hammerhead turnaround near the eastern
border of the most westerly lot. The 20 foot lane included a 10
foot strip of property of lots 1 and lot 2, and a 10 foot strip
from the property immediately north of proposed lots 1 and 2. The
Applicant 'obtained access easements over the property immediately
north of proposed lots Land 2.
3. The Appellants lease the property immediately north of lots I
and 2. They objected to the approval of the short plat because
the short plat and the access lane will disrupt their use of a
private driveway on the property. The Appellants submitted that
the driveway was used by their children as a safe place to play
and to ride bikes and is needed to park vehicles. There is no
room for parking of vehicles in front of the Appellants' house,
which is off the driveway.
4. The Appellants claimed that the access driveway will
effectively allow additional traffic in the area and a nuisance
will result.

5. The Appellant (Paul Wheaton) submitted that there is an
elevation difference between the subject property and the property
that he leases. The driveway, according to the witness, cannot be
created without significant improvements. In addition he sub-
mitted that there is a telephone pole in the middle of the exist-
ing driveway.
6. The Appellant (Rosemary Wheaton) submitted that she has
spoken with the owner of the Appellants' property and that he is
in agreement with the access as proposed by the short subdivision.
He has agreed to participate in the access easement.
7. The City submitted that the access easement will not be a
public -road, but a private access land that will be for the three
lots within the short subdivision and for the large lot immedi-
ately north of proposed lots I and 2. Each of these lots will be
required to have off-street parking.
CONCLUSIONS
1. The City of Edmonds granted preliminary approval of a 3 lot
short subdivision for property located at 21308 - 84th Avenue W,
Edmonds, Washington.
2. Access to the proposed 3 lot subdivision is through a 20 foot
lane. Approximately one-half of the lane will be located on the
Applicant's property, and the remaining half will be located on
the property immediately to the north.
3. The owner of the property immediately to the north has agreed
to participate in the provision for access easements to the
subdivided property. This effectively allows the owner of the
property to develop his property with adequate access.
4. The access easement is not a public road.
5. The access easement provides adequate means of access and
internal circulation to the 3 lot short subdivision.
6. The short subdivision was approved pursuant to the criteria
of ECDC 20.75.085.
7. The Appellants have failed to show that the September 20,
1989 short plat approval for the property at 21308 - 84th Avenue
W, was contrary to the provisions of Chapter 20.75 of the ECDC.

DECISION
Based upon the preceding findings of facts and conclusions, the
testimony and evidence submitted at the public hearing, and upon
the impressions of the Hearing Examiner at a site view, it is
hereby ordered that the Staff Decision of September 20, 1989,
approving a three lot short subdivision on property at 21308 -
84th Avenue W, Edmonds, Washington, is granted. The appeal of
Rosemary and Paul Wheaton filed on' October 4, 1989, is denied.
The plat approval remains, subject to conditicns as se4C forth in
the September 20, 1989, decision.

preparing a Development Permit
Application for the City of Edmondsprior
to his/her submittal of a development
permit'to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or his/her representative,
