From the City: Kirk J. Vinish, Project Planner, reviewed the staff report (Exhibit A) which concluded that the request met the variance criteri& From the Applicant: William Nelson, Sr., said he purchased the property in October 1994 with the intent of constructing die proposed garage on the site. He said he was not aware of the large setback requirements when he bought the property. He agreed to conform with the conditions of approval recommended by staff. From the Community: No one from the general public spoke either in favor of or in opposition to the variance request. WRITTEN COMMENTS: No written comments were submitted by members of the general public. FINDINGS, CONCLUSIONS AND DECISION: A . Site Description 1. Site Development and Zoning a) E=: (1) Im- The subject property is approximately 8,106 square feet in area. The proposed garage would be located in the south eastern portion of the property approximately 13-feet from the south property line (see Exhibit A, Attachment 4). (2) Zonin : The zoning of the subject property is Single Family Residential (RS-8). (3) Terrain and Ve=tation Ile subject property is fairly level, with an overall downward slope from the north property line to the south property line, with all open arm fully landscaped (see Exhibit A, Attachment 4). 2. Neighboring Development and Zoning: a) E=: (1) North: Developed with detached single family residences, and zoned RS-8. (2) South Developed with detached single family residences, and zoned RS-8. (3) Eaz Developed with detached single family residences, and zoned RS-8. B . History a) E =: (1) The subject property was annexed to the City on August 21, 1959 and was zoned RS-8. (2) In 1959, the street setback requirements for the RS-8 zone appear to have been 15-feet see Exhibit A, Attachment 5). (3) Permits for construction of the home were issued on November 10, 1959 (see Exhibit A, Attachment 5). (4) 'Me home appears to be legally nonconforming with respect to street setback requirements. C . Edmonds Community Development Code (ECDC) Compliance 1. Compliance with RS-8 Zoning Standards a) E=: (1) The fundamental site development staindards in a RS-8 zone are set forth in Chapter 16.20.030. (2) Minimum street setbacks in the RS-8 zone are 25-feet b) Conclusion - Except for the requested street setback variance, the applicant is proposing to build a structure which conforms to the RS-8 development standards for locating structures on a lot. 2. Compliance with requirements for a Variance ECDC Chapter 20.15B. 180A, states an applicant may request a variance from the standards of this Chapter pursuant to the procedures set forth in ECDC Chapter 20.85 (Variances). Chapter 20.85 of the ECDC sets forth the mechanism whereby a provision of the Code may be varied on a case -by -case basis if the application of the provision would result in an unusual and unreasonable hardship (see Exhibit A, Attachment 2). a) Facts: (1) ECDC Section 20.85.010 establishes the decisional criteria with which a variance request must comply in order to be granted by the Hearing Examiner. Ilese criteria i4clude: a special circumstance must exist; no special privilege is granted; the proposal is consistent with the Comprehensive Plan and the Zoning Code-, the proposal will not be detrimental and is the minimum necessary.. Willi�.m Nelson File No. V-95-66 Page 4 (2) Variances may be used to modify bulk standards. They may not be used to modify use or procedural requirements. (3) 'Me property was annexed to the City -and the home constructed in 1959. (4) In 1959, the front setback requirements appear to have been 15-feet. (5) A field survey of the street revealed that most home on the street have existing setbacks similar to the applicants. (6) The applicant's home appears to be legal non -conforming with respect to front setback requirements. b) Conclusions: (1) SMial Circumstances Special circumstances include the size, shape topography, location or surroundings of the property and public necessity for public structures. In this case, the applicant wants to construct a garage, on an existing single family dwelling. The additional garage is proposed to be adjacent to the existing gar -age and will be 14-feet, 6 inches wide and 18-feet, 6-inches long. The subject property is approximately 8,106 square feet in area ' and is legal nonconforming, and zoned RS-8. Other homes in the immediate vicinity have similar circumstances and have constructed similar additions. Special circumstances exist, therefore, due to the location of the existing dwelling already in the setback and that alternative locations for the garage are not feasible (see Exhibit A, Attachments 2 and 5). (2) SMial Privifte It does not appear that any special privilege will be demonstrated in granting this variance in that other properties in the same zone with similarly sized lots would also qualify for a variance (see Exhibit A, Attachment 2). (3) Zoning Code and the CompLehensive Plan Approval of the proposed variance would allow for the continued development of the site in a manner consistent with the intent of the Zoning Code and the Comprehensive Plan designation of the site (see Exhibit A, Attachment 2). (4) Not Detrimental Approval of the variance would not be detrimental to the public health, safety or welfare (see Exhibit A, Attachment 2). (5) Minimum Required The request is the minimum necessary for accommodation of the garage (see Exhibit A, Attachment 2). William Nelson File No. V-95-66 D Technical Committee Page 5 1 . Review by City Departments a) E=: (1). No comments were submitted by other departments. E . Comprehensive Plan (ECDC) 1 . Comprehensive Plan Designation a) E=: 1) The Comprehensive Plan designates the subject property as Low Density Residential. . b) Conclusion 1) The proposed project is consistent with the Low Density Residential designation in the Comprehensive Plan. DECISION: Based upon the foregoing findings of fact and conclusions, the request is approved, subject to the following conditions: I - This variance is to allow the proposal in the location identified on the proposed site plan (see Exhibit A, Attachment 3). Any other structures, additions or remodels would have to conform with the typical setbacks or height requirements for the zone or obtain another variance. 2. This application is subject to the applicable requirements contained in the Edmonds Community Development Code. It is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. 3. The applicant must obtain a building permit prior to construction. 4. The peri�it should be transferable. Any person wishing to file or respond to a recommendation or appeal should contact the Planning Department for further procedural information. A . Request for Reconsideration Section 20. 100.0 10.G allows for the Hearing Examiner to reconsider his decision or . recommendation if a written request is filed within ten (10) worldrig days of the date of the - initial decision by any person who attends the public hearing and signs the attendance register and/or presents testimony or by any person holding an ownership interest in a tract of land which is the subject of such decision or recommendation. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed. B . Appeals Section 20.105.020.A and B describe how appeals of a Hearing Examiner decision or recommendation shall be made. The appeal shall be made in writing, and shall include the decision being appealed along with the name of the project and the date of the decision, the name of the individual group appealing the decision,,,their interest in the matter, and reasons why the appellant believes the decision to be wrong. 'Me appeal must be filed with the Community Development Director within ten (10) working days after the date of the decision being appealed. LAPSE OF APPROVAL Section 20.05.020.0 states 'Unless the owner obtains a building pennit, or if no building is requimd, substantially commences the use allowed within one year from the date of approval, the conditional use perinit shall expire and be null and void, unless the owner files an application for an extension of the time before the expiration date.'
