City staff to determinewheth, any potential

An applicant� or his/her representative, must
fill out the checklist, sign and date it� and
submit it to the City. -Me City will review
the checklist, make a precursory site visit,
and make a determination of the subsequent
steps necessary to complete a development

RE: BASKETBALL HOOP
Dear Resident:

MAYOR
A basketball hoop was recently constructed in the public right-of-way
adjoining your property. According the City codes, any type of
construction work within the public right-of-way needs to have'prior
approval by the Public Works Division.
In this case, the City would deny approval of the basketball hoop. As
a general policy, the City does not allow basketball hoops in improved
right-of-ways due to the potential for vehicles to injure a basketball
player on the street. For the City to allow a basketball hoop to
remain, increases the City liability risk to claims.
Assuming that the basketball hoop is your property, I am requesting
that it be removed within thirty (30) days of this letter. I hope that
you will be Able to find a suitable location on your property.

RE: Basketball Hoop

MAYOR
I have reviewed your September 14 letter with Noel Miller and other
City staff. As was stated previously to you, the City's general policy
is not to allow basketball hoops within the public right -or -way. The
reasoning behind this policy is our overall concerns about safety,
public nuisance and legal liability. In your situation, there is a
definite conflict between the safety of persons playing in the
right-of-way, pedestrians and moving vehicles in the roadway.
Therefore, the City requires that the basketball hoop be removed from
the City right-of-way. This should be accomplished within two weeks
from the date of this letter.
Thank you for your cooperation in this matter. If you have further
questions, please call Noel Miller at 771-0235.

provided for public use L-y the developer. J,hjs e'asernent as well as all
road areas are dedicated to puLlic use, and the specific use or. this util-
ity easement was for a joint side sewer system between the (3) suLject
lots.
