Edmonds, WA 98026 RE: BASKETBALL HOOP Dear Resident: LAURA M. HALL MAYOR A basketball hoop was recently constructed in the public right-of-way adjoining your property. According the City codes, any type of construction work within the public right-of-way needs to have'prior approval by the Public Works Division. In this case, the City would deny approval of the basketball hoop. As a general policy, the City does not allow basketball hoops in improved right-of-ways due to the potential for vehicles to injure a basketball player on the street. For the City to allow a basketball hoop to remain, increases the City liability risk to claims. Assuming that the basketball hoop is your property, I am requesting that it be removed within thirty (30) days of this letter. As was stated previously to you, the City's general policy is not to allow basketball hoops within the public right -or -way. The reasoning behind this policy is our overall concerns about safety, public nuisance and legal liability. In your situation, there is a definite conflict between the safety of persons playing in the right-of-way, pedestrians and moving vehicles in the roadway. Therefore, the City requires that the basketball hoop be removed from the City right-of-way. This should be accomplished within two weeks from the date of this letter.
