After discussing your concerns with you and your brother, we summarized them into three primary issues, which I would like to address as follows: 1. You feel you were singled out and treated inqppropriately by Cily Engineering Division staff during the plan review and inspection of your projec Your allegations that Engineer Division staff singled you out and treated you in a prejudicial and discriminatory manner are very serious allegations and are taken seriously by the City. Please be assured that it is the City's policy to treat all developers in a professional and consistent manner, as necessary to ensure compliance with applicable codes and approved plans. After reviewing your letter and your comments in our meeting, and looking into the project history, I must take exception to your allegations. Although your project had some site constraints that led to frustration for you in obtaining permit approvals, and some inspections resulted in disapproval and re -inspection, I believe our staff acted in a professional and consistent manner in our dealings with you. Nonetheless, it is clear that you are quite passionate in your perception of your treatment by Engineering Division staff. During our meeting, you agreed that there is nothing that can be done to change any past actions. However, I assured you that I will counsel our Engineering Division staff to make sure that we all have an appreciation for how our actions and proceduresinay be perceived, and that we make sure that we deal with all developers in a professional, consistent, and respectful manner. 2. You believe that the Edmonds Communily Development Code (ECDC) needs to be revised so it can be uniformly and consistently applied. We agree. It has been a number of years since the ECDC has had a major update, and there are a number of areas where it could be clearer and easier to interpret. The Development Services Director had planned to undertake the significant task of a major Incorporated August 11, 1890 code update in 2003. Unfortunately, due to significant budget cuts this year, the City Council was not able to approve the funding in the 2003 budget that the Development Services Director requested, to accomplish this task. Therefore, the best we can do for the foreseeable future is to continue to address and clarify individual issues on a case by case basis. If you can provide us specific recommendations to improve specific sections of the ECDC, that would be helpful and .greatly appreciated. 3. You want Cily approval to not remove that asphalt "parking space" that we have directed you to remove and replace with landscaping per the approved plans. As we discussed, there are actually two corrections directed by Mr. Chrisman's letter of January 24, 2003 that, as of our meeting, you had not completed. You were directed in that letter to 1) remove the block wall from the City right of way, and 2) remove the asphalt area in the front yard that could be used as a parking space and restore landscaping per the approved plans. During our meeting, you agreed to remove the block wall from the right of way. Regarding the asphalt "parking space", you explained that you do not intend this to be a parking space and that your intent is that it be a walkway extension from your previously existing sidewalk. As we agreed, you will submit a revised plan requesting City approval for a sidewalk extension in this location. I explained to you that the City's concern is that this not be later converted back to a paved area that could be used for parking because it does not meet City standards and would not be safe for parking a vehicle. Therefore, your revised plan must include permanent changes to the existing asphalt and features that will preclude it from being easily restored to a paved area that could be used to park a vehicle. In other words, prior to our approval, we must be assured that, for example, the landscaping cannot simply be removed again to restore the "parking space". Even though you.have assured me on your letter and during the meeting that the City Engineering Division "deal with all developers in a professional and consistent, and respective manner", this has not been my personal experience. I don't think it is helpful to dismiss my concerns as a personal feeling and not acknowledge inconsistent or improper actions by the Engineering department staff. I still clairn that Ms. Danielle Gilbert, City Engineering Division staff Engineering inspector, has over step her authority to contact my brother and I on Feb 18 and find her comments and warning to me during that call out of line. Even though, I can't prove what she said to me over the call, I'll send you a receipt from our cell phone carriers which will show the time and phone number that her call originate from. Following her call, a notice was posted on my property from the Building department within 48 hours. Her call was a continuation of problems she presented to me over the course of her inspections. I had difficultly with all of the inspections she performed. If you review all other inspections perform on this.project, examples Building and Fire, and take the time to talk to those inspectors you'll find all those inspections we done without any difficulty. So, it is not right to dismiss the problem as project constraint but rather acknowledge there is merit to my claim and maybe Ms. Gilbert conduct through my and my project has not been proper. 2. It is interesting that the only thing you did acknowledge during our meeting is the necessity for major upgrade to ECDC code for which there are not sufficient funds at this time. What I was hoping to hear is that you'll review the engineering practices of Engineering Department. I agree the no code is perfect, however, that doesn't take a way the requirement of good engineering practice of consistent interpretation of existing code and timely response. It took well over six months and number of register letters to get an approval for the width of access road to the project. During this time, the Engineering Department insisted on requiring an extra 2 times 'shy distance' width to the access road that is not in the code. It took the intervention of senior department engineer to drop this subjective requirement. 3. During the meeting we agreed to remove the block wall and we had already done that. We stated the paved asphalt area in front was not a 'parking space' as it is not big enough for this purpose. Also, we don't need to create an additional parking space since we have ample parking both on and off the property. We stated that we needed the paved area as a continuation to the paved surface to the house. You agreed. We have lined the paved area with stone blocks on both sides and added back landscaping. The site address is 21405 73d place west Edmonds, WA. Existing site is approximately 11,520 SF. in area and contains an existing house located on west portion of site along 73 pl. west. The project site is bounded to north, south, and east by existing lots and structures and to the west by 73d place west. Topography of site is sloping fromwest to east with approximate relief of 8 Ft. Existing on site soil consists of gravely sandy loom and designated as hydraulic group c based on Snohomish County soil survey. The proposed project is to construct approximately 2,270 SF. of new building along with parking and drive areas. It is also required to modify the existing residential structure to provide fire access to project. i 2. Existing Site Hydrology/Vpstream, Downstream Consideration Existing site consist of and 11,5 10 SF. of a parcel with and existing house along with it's paved driveway to 73d place west. Site slopes from west to east with and an average slope of 6%. Existing storm run off sheet flows from west to east and percolate to ground along low portion of site along east property line. There is no storm drainage conveyance downstream from site. An existing apartment complex is located to the East Side of project with no storm run-off conveyance to this parcel. There are no upstream drainage run-offs to this project site from adjacent properties. Upstream drainage basin for this project is from areas to west of 73 d place west and 215th. SW. Storm drainage run-off from upstream areas is tight lined along 73 d place west and bypasses the project site and drains toward south. Storm drainage run-off from 73 rd place west and upstream tributary area is tight lined and drains toward 216 th St. SW. From here storm drainage system travels northerly along 216 1h St. SW and discharges to Haliscreek. Due to the fact tat this project does not proposes to discharge any run-off to this system, there will be no adverse impact to downstream conveyance system. 3. Proposed Site Hydrology Storm drainage conveyance and discharge system for this project is designed in the same manner to existing conditions. C & H Design performed a percolation test based on King County surface water design manual and the result is included within this report. On August 11, 2004, 1 personally observed the vehicle parking in the asphalt area in the front of your property at 21507 73d Place West while I happened to be passing through your neighborhood for another purpose. Not only did I observe the parked vehicle, but I also observed that the approved 6 foot wide asphalt walkway had been widened to well over the approved 6 foot width by removing some of the landscaping, relocating the concrete blocks, and exposing additional asphalt. As a result, my letter dated August 12, 2004 directed you to correct the situation. Your letter indicates that, as of August 27, 2004, the asphalt had, been removed. However, at that time, the extent of the asphalt removed was insufficient, the remaining asphalt was still in excess of 8 feet wide, and the concrete blocks needed to be relocated after completion of the additional asphalt removal. Lyle Chrisman and I both spoke to Mr. Hauck on August 27 and explained the additional asphalt removal required and the extent to which the blocks needed to be relocated. The voice mail that you left for me on August 27, 2004 did not leave a phone number. I tried to call you on the phone number we had on file, but it appeared to be a fax number. So, I sent the enclosed e-mail to respond to your voice mail. On Monday morning, August 30, 2004,. Lyle and I inspected the walkway and determined that additional asphalt had been removed over the weekend, and that the extent of asphalt removal and relocation of concrete blocks was acceptable. The enclosed photographs indicate the approved width of walkway asphalt and location of concrete blocks. As indicated in these photographs, which were taken on September 1, 2004, the restoration of landscaping remains to be completed. However, since the asphalt width has been reduced to the approved 6 foot width and the concrete blocks have been relocated, we do not intend to pursue enforcement action, civil fines or penalties at this time. On March 3, 2003, you were issued a correction notice for your development project at this location pertaining to the asphalt area in the front yard that, if left in its configuration at that time, could have been used as a non -compliant parking space. The correction notice required that you submit a revised plan requesting City approval for a walkway extension from the previously existing sidewalk or remove the asphalt area in the front yard that could be used as a non -compliant parking space, and restore landscaping per the approved plans. On March 7, 2003 we received a revised plan from you showing a 6 foot wide asphalt walkway extending from your previously existing concrete sidewalk to the new asphalt driveway on the south side of your property. My letter to you dated March 12, 2003 advised you that, although the configuration of the proposed asphalt walkway was acceptable, we could not approve it because you had not addressed the City's concern identified to you in previgus correspondence, specifically: ".'..the City's concern is that this not be later converted back to a paved area that could be used for parking because it does not meet City standards and would not be safe for parking a vehicle. Therefore, your revised plan must include permanent changes to the existing asphalt and features that will preclude it from being easily restored to a paved area that could be used to park a vehicle. In other words, prior to our approval, we must be assured that, for example, the landscapi ng cannot simply be removed again to restore the 'parking space'." Your letter dated March 18, 2004 stated that "...the area in question was never intended to be a parking stall and was never used for parking." You further stated that the City "...can continue to monitor for changes and issue a violation if we make any changes. Based upon your written assurances that no changes would be made from the'revised plan submitted with your letter of March,7, . 2003 subsequent to our approval, and that your proposed plan would be'pennanent, my letter dated March 25, 2003 approved your proposed 6 foot wide asphalt walkway, lined with concrete block units and extending from your previously existing concrete sidewalk to the new asphalt driveway on the south side of your property. Unfortunately, as noted above, we have now observed that your approved plan has indeed been changed and the asphalt area in question is now, in fact, being used for a parking space. This parking space does not meet City standards and is not safe for parking a vehicle. Accordingly, we have no choice but to direct you to restore this area to the 6 foot Wide walkway as approved by my letter,dated March 25, 2003. The existing pathway is not big enough for parking stall. In my plan, I forgot to highlight the length of the pathway. I stress again, the area in question was never intended to be a parking stall and was never used for parking. The length of the pathway (12 feet) prohibits it to be use as a parking stall. Also, the changes that I made will make it very difficult for anyone to park there. You can continue to monitor for changes and issue a violation if we make any changes. Other than that, I am not sure that I can offer to do. The changes that I had made cannot easily be tindone and you have my assurance that no changes will be made following your approval of current plan. I own and have been involved in the construction of three town homes addition to my property at 21505 73rd Pl. W. I want to ask you a simple question? Would you as professional individual tolerate name calling and insult by a city inspector? This is the experience that I had last Tuesday 4; morning (February 18 around 8:30am) with Ms. Danielle Gilbert (Engineering inspector) ,i who called me after calling my brother to get my mobile number. During the call, Ms. 6ft called me "stupid'_'and stated that "if you think that we are not watching you, you are being- stupid"'- F611_6wing the phone call, I visited the city of Edmonds, to inquiry about her and find out -about her supervisor's name. On the same day, she had contacted zz�, the planning department, a different department from where she works, and had them "landscaping z 1ZIe P ost a notice of enforcement violation on my property stating removed to 4; accommodate additional parking space. Remove parking spaces and restore landscaping." The space in question is not big enough to accommodate a car. Also, as.you can see from the drawings the landscaping had to be changed to allow access to the existing sidewalk to the house on the property. Without this access, you had to walk over the grass to get to the existing sidewalk which is not proper. My problems with Ms. Gilbert are not recent issue. From her first encounter toward me tie, ,V1 ,2.d ,, and my project I can only conclude that she has prejudices toward me. It is my request to w-jj._.�r you to have her stop harassing me and have her avoid making phone calls to me. I found WIA� her phone call to me very upsetting and offending. And I found her comment "if you think that we are not watching you, you are being stupid" to imply that city of Edmonds have too much resources and can spare inspectors to keep an eye just on us. If you see my project, you would be proud to have this project insuch a location, where on both north and south of my project there are very dense apartment buildings. I believe we have build the only side walk on the street. If you continue on this sidewalk in front of the house you'll immediately walk into the electrical post and wiring tensioners. Here is some my past encounters with Ms. Gilbert which leads me to believe she has a personal issue with me and my project. I got a permit for my project issued by the City of Edmonds on July 13, 2000. At that time, the city of Edmonds had told me that I would be able to renew my permit for another year. One month prior to expiration of my permit, June 2001, 1 went to renew my permit and at that time I was told that I have to complete at least one inspection before I could renew my permit. My first experience with Ms. Gilbert was when she came onto the job site with Mr. Michael Snook (building inspector) for per -construction meeting. She made a comment that the set of plans that I present her was not legitimate approved site plans and she had to call to verify my original plans. She stated that her visit did not count as an inspection and she refused to sign the inspection card. We continue to do site development. Next, we 44. installed 80 feet 8" side sewer with a manhole. Again, she came out and i nspected the work but refused to sign the inspection card. Then on 7/9/02, we installed detention system and called for inspection again. This time we got lucky and got a different inspector. That inspector came out inspected the detention system and we got the first signature on our inspection card, what we needed to renew our permit. Again, on another occasion 7/18/02, we called for inspection of water line from the street to the new building site. This time neither I nor my contractor (John Spencer) were at the site, however, my contractor's son was there. At that occasion Ms. Gilbert comes to the site and notices that the contractor did not have copper wire around the water line and she comments to my contractor's son, that she is very made at me and I (Nasser) should have know better. Why does she exhibit such behavior? I ask you is this type of treatment that people building in Edmonds should expect? I must tell you that I have heard in numerous occasions that builders avoid building in. -Edmonds because of similar -treatments that I have encountered. In numerous occasions I had called for inspection and Ms. Gilbert had either not showed up for inspection or failed to re -schedule. Overall I had a total of 7 inspections required by Engineering Department (Ms. Gilbert) and all of them were challenging and frankly nightmarish. In contrast, I had, 16-17 building inspection done by the Building Department by Mr. Michael Snook and all of these inspections were pleasant experiences. In fact, Mr. Michael Snook encouraged my to build again in City of Edmonds which I'll never do. Also, my Fire and Planning inspections were completed very professionally. My problems with the Engineering department goes back to Mr. Lyle Chrisman, Development Services Engineer, reviewing of my project where he insisted on enforcing an non -existing set back called "shy distance". It toke six months and may registered letters to get a reply and finally Mr. Gerbert had to step in to resolve this matter. I would like your office to look into this discriminatory behavior and reply within 7 days to my letter'since I only have 10 days to reply to the Notice I received from city of Edmonds. E2.26 There were several issues with this permit during the review of the drawings. The biggest was access width on the south side of the project. Originally the architect indicated two way traffic and this would have required a 16' driveable access. In order to meet that requirement the architect was told he first floor of the existing house to be cut back in order to get the required 16' and initially, that was shown on the drawings. Our policy, although unwritten but used for years, required a two foot shy distance from structures which the ECDC defined fences and of course buildings as structures. This issue was expressed to the architect and when Gordy did the initial review and I carried if forth when I took over. I sent Nasser excerpts from the code that defined structures and tried numerous times to -explain why it was required. We went around and around on this and he procrastinated in responding to our requirements. Finally he decided to make the access on the south side one-way and we identified the access width as a minimum of 12'. With the first floor cut back and the access one-way, the required distances could have been met. As it turned out, the architect's drawings did not accurately depict the width between the existing fence and building. The shy distance was still required from the fence but allowed him to place a curb along the side of the house, which was to have landscaping behind it to provide some protection to the house. When inspected the minimum width, shy distance, curbing and landscaping was not met nor could it be. HATZENBUHLER MOVED TO APPROVE V-22-80 BECAUSE HE DID NOT FEEL IT WOULD ENDANGER THE PUBLIC HEALTH AND MORALS AND HE FELT IT WOULD BE IN HARMONY WITH THE SURROUNDING AREA AND WOULD MAKE REASONABLE USE OF THE LAND. VICE CHAIRMAN BYRD SECONDED THE MOTION, FEELING IT WAS A MINIMUM VARIANCE WHEN CONSIDERING THE SURROUNDING DEVELOPMENT OF PROPERTY. Mrs. Medina said the area around this site is overdeveloped and the zoning was changed to alleviate some -of that. She felt there was a valid reason to rezone that area and said added units would create additional traffic. Mr. Hatzenbuhler argued that.property is becoming a premium and it is not possible to spread out more so the only choice Is to be more dense on the ground. Mr. Bowman noted that the single family development is farther to the west and that the apartAent develop- ment is all just to the north of this site and farther to the I south. ' He said this is one of -the last pieces of property there that can be developed into apartments, that it is a single family house existing in a multi- family zone. Mrs. Medina said there are children all over the place, and the question was whether this was a minimum variance, and she thought it was not. THE VOTE WAS TAKEN, WITH MR. Don VanDriel, 1233 Olympic View Dr., said he had been involved in selling. this property originally. He said the home is on the street and there is a 23' access alongside the home which is adequate for access to the rear. The back portion of the property has large apartments on one side and a nursing home at the back of it, and it becomes a large piece of property which is zoned for multi -family dwellings. He felt the highest and best usage in that area could best be served by allowing this variance. He said it wou-ld not cause any problems because the other development is quite a distance from the property line. Further, he noted that the change was from a 3-unit to a 4-unit building, a matter of one additional unitg and the design of a building normally is not that different, and for appearance's sake it normally would not look that different. He also noted that the buildings would not even be seen from the street. He felt that by limiting it to three units that would be cutting down a large portion of the allowable space and in the costs of construction and of land that would adversely affect the owner. A. ESC Minimurn Requirements. All activities necessitating a clearing or grading permit and all utility nroiects consistina of more than 500 lineal feet of trench excavation shall be required to control erosion and sediment during construction and to permanently stabilize exposed soil resulting from construction. Projects involving a critical area may also be required to comply with any combination of the ESC minimum requirements. Compliance will be demonstrated through the implementation of an approved ESC - W — — L plan. Guidelines for preparing ESC plans are provided in the manual. The plan must address the following i�quirements: EX CB EX CB EX WATER VALVE 1. ESC Minimum Requirement - Construction Access Route. Construction vehicle access shall be, whenever practical, limited to one route. Access points shall be stabilized with quarry spalls or crushed— — — SD rock to minimize the tracking of sediment onto public roads. If sediment is transported onto a road surface, the roads shall be cleaned thoroughly at the end of each day. Sediment shall be removed from roads by shoveling or sweeping and be transported to a controlled sediment disposal area within 24 hours. Street washing shall be allowed only after sediment is removed in this manner. in 2. ESC Minimum Requirement - Stabilization of Exposed Areas. All soils exposed by land disturb g activities shall be stabilized by suitable application of BWs, including, but not limited to, sod, hydroseeding, or other vegetation, plastic covering, or mulching. All BMPs shall be selected, designed, and (n maintained in accordance with the manual. The exposed soils shall be stabilized according to an approved timetable. (Typically, no soils shall remain exposed for more than two days from October I through April PROVIDE TEMP CH 30 and no more than seven days from May I through September 30). Adjacent properties shall be protected from sediment deposition by appropriate use of vegetative buffer strips, sediment bwTiers or filters, dikes or mulching, or by a combination of these measures and other appropriate BMPS. 4. ESC Minimum Requirement - Maintenance. All erosio n and sediment control BMPs shall be regularly I inspected and maintained by the owner to ensure continued performance of their intended flinction. All maintenance and repair shall be conducted in accordance with the manual. 5. ESC Minimum Requirement - Other BMPs. As required by the city, other appropriate BMPs to mitigate the effects of increased runoff shall be applied. C9 6. Erosion and Sediment Control Requirement 6 Underground Utility Construction. The construction of underground utility lines shall specifically address the following: a. Erosion control for excavated and stockpiled materials; EX CB b. The placement of excavated material where consistent with safety and space considerations shall be placed on the uphill side of trenches; c. Daily cleanup and street maintenance. V) 7. Additional ESC Minimum Requirements for Larger Developments. All new development and redevelopment that includes land disturbing activities of greater than, or equal to, one acre in addition to EX 8" WATER — meeting the minimum requirements set forth above shall comply with ESC requirements listed below. 8. ESC Minimum Requirement - Delineate Clearing and Easement Limits. In the field, mark clearing limits and/or any easements, setbacks, sensitive/critical areas and the buffers, trees and drainage courses. 9. ESC Minimum Requirement - Sediment Trapping. Prior to leaving the site, storm water runoff shall pass through a sediment pond or sediment trap, or other appropriate BMPs. Sediment ponds and traps, perimeter dikes, sediment barriers, and other BMI?s intended to trap sediment on -site shall be constructed as a first step in grading. These BMPs shall be functional before land disturbing activities take place. Earthen 30' R/W- structures, such as dams, dikes, and diversions shall be seeded and mulched according to an approved 30' R/W timetable. V) 10. ESC Minimum Requirement - Cut and Fill Slopes. Cut and fill slopes shall be designed and constructed in a manner that will minimize erosion. In addition, slopes shall be stabilized in accordance with ESC Requirement No. 2. 11. ESC Minimum Requirement - Controlling Off -Site Erosion. Properties and water ways downstream from development sites shall be protected from erosion due to increases in the volume, velocity, and peak flow rate of stonn water runoff from the project site. 12. ESC Minimum Requirement - Stabilization of Temporary Conveyance Channels and Outlets. All temporary on -site conveyance channels shall be designed, constructed and stabilized to prevent erosion from the expected velocity of flow from a two-year, 24-hour frequency storm for the developed condition. Stabilization adequate to prevent erosion of outlets, adjacent stream banks, slopes and downstream reaches shall be provided at the outlets of all conveyance systems. 13. ESC Minimum Requirement - Storni Drain Inlet Protection. All temporary erosion and sediment control BMPs I shall be removed within 30 days after final site stabilization is achieved or after the temporary BMPs are I no longer needed. Trapped sediment shall be removed or stabilized on site. Disturbed soil areas resulting 3: from removal shall be permanently stabilized. 15. Erosion and Sediment Control Requirement - Dewatering Construction Sites. Dewatering systems shall discharge into a sediment trap or sediment pond. 16. Erosion and Sediment Control Requirement - Control of Pollutants other than Sediment on EX FIRE HYDRANT Construction Sites. All pollutants other than sediment that occur on site during construction shall be handled and disposed of in a manner that does not cause contamination of storm water. 17.
