Dear Mr. Herzberg:
Our apologies for not responding to your July 17, 1978 information sooner.
We have reviewed the claim you have sent us regarding the Bohon residence
and his apparent disagreement with the LID assessment. We are also in
receipt of the notarized claim for damages filed to the City Council,
which does not include any damages sustain ed by the claimant other than
expenses to remedy the future flooding.
This policy covers the city from l/l/65 to 68 for all sums they become
legally obligated to pay aadamages because of property damage caused by
an occurrence, subject of course, to the applicable term, limits and
conditions of the policy.
Briefly, property damage means physical injury to, or destruction of tangible
property which occurs during the policy period4 This would not include
remedial costs for constructing a retaining wall or other improvements of
that nature. It would cover physical damage to tangible property caused by
the city such as flooding, but that does not appear to be alleged so we
likely cannot provide coverage for this claim.

Confirming our discussions of December 13, 1-977 and
�January 12, 1978, relative to the old cross -arm retaining �-.,all
you constructed in 1967, the City Council Minutes on the Final
Assessment Roll Hearing for L.I.D. No. 148 are fon,;arded here-
wi th. The City Attorney at the tiiiiie of the Hearing indicated
that you could file a claim for the work that had been done,
and if after further investigation the Council decides compens,--i-
tion was due, a deduction could be made on your assessment. Our
records indicate you did not file a formal claim with the City
of Edmonds.
In further reviewing the matter, Edmonds corrected the

from Warren E. Bohon, 1000-22nd A,%,,j. S., objecting to the amount of his assessncnt
because of the work done by him arid his wife on city right-of-way in front of their
property to alleviate flooding. Hearing wau then opened.
Mr. McBurney presented and real a list of A complaints which lie had against, th,� com-
pletion of the project. Mr. Bohon then submitted snapshot3 of his propert,7 to sub-
stantiate his letter of coi;iplaint, and both lie and I,Lrs. Bohon cxplain,_?d their problem

A motion was made by Councilman 31y�, seconded by Councilman Kincaid that proposed
Ordinance j�1321 be passed, approving arid confirming the final asscssment roll for
LID #148. Attorney Iiurphy explained that Pir. & Mrs. Bohon could file a,.clai-m for
the work they had done and after further in,,estiga i_0n1'___if the coun'cil de,�id-�s that
some compensation is due them, the deduction allowed on their ass�issment would be
charged to.the street fund. A roll call vote passed unanimously to adopt the

of a comprehensive street plan as set forth in File U-4-67. city Planner Locan
gave an explanation of the recommend ati ons and summarized the minutcs, of the three
meetings when hearings hc�ld before the Planning Commission. Hr. Log,�n ;ilso
noted that extorisive publicity fiid been t7iven thiS matter. and all publication!; were

and Marian H. Thomasson. One letter was read from G. T. Bo,..,,en, commending the City
for creating a Planning Commission and hiring a City Planner, arid agreeing to the
necessity for proposed R/W for logical planning for the future of Edmonds. Hearing

Jim Mueller, Casper Street, felt the comprehensive street plan was a goOdideU, but
he had moved to Edmonds with the idea that the narrow streets %,,Pre desirable. There-
fore, he proposed the city widen only the necessary arterials arid leave the narrow
residential streets that would maintain the small town atmosphere which everyone

Confirming our discussions of December 13,' 1.977 and
January 12, 1978, relative to the old cross -arm retaining �..7all
you constructed in 1967, the City Council 14inutes, on the Final
Assessment Roll Hearing for L.I.D, No. 148 are for,.,;arded here-
wi th. The City Attorney -at the time of the Hearing indicated
that you could file a claim for the i-,,ork that had been done,
and if after further inves-tigation the Council decides compensa-
tion was due, a deduction could be made on your assessment. Our
records indicate you did not file a formal claim with the City
of Edmonds.
In further reviewing the.matter, Edmonds corrected tlie
drainage runoff problems in the design and construction of the
street. Provisions were made to connect the local draina��e
immediately to the west of you and to allow connections from
your downspouts to the installed drainage system. A copy of
the construction drawing involving that portion of the street
adjacent to your house is also enclosed which indicates these
provis.ions. A claim form is enclosed herewith but now may not
be valid due to.the statute of limitations.

NOTE No. I —The owners of the property may obtain a permit to construct sewer inside property line. A licensed Side Sewer Contractor
must be employed to construct side sewer in street area. Do not cover any portion of sewer before it has been inspected.
NOTE No. 2—Obtain full Wormation regarding Ordinance 11.16.030 and Regulations governing side sewers when you get permit.
NOTE No. 3—Top of side sewer must have at least 30 inches coverage at property line and 12 inches inside property line; minimum grade of
201o. No bends in grade sharper than % will be permitted.
NOTE No. 4—Trenches in street must be water settled and surface of street restored to original condition. Contractors shall be responsible for
failure due to improper work which may develop within one year of completion.
NOTE No. 5—It is unlawful to alter or do any other work than is provided for in the permit, or to do any work on the main sewer or its ap-
purtenances except to insert the pipe into the wye.
