Dear Ms. Zukowski and Mr. Carlstad:
I represent the Flahertys concerning Chase Lake Elementary ingress/egress and
the Community Transit bus stop on 84th. By now, you are familiar with how the convergence of
these two factors impacts the Flaherty's property, as well as the safety of pedestrians in the area.
I want to emphasize, from my legal standpoifit, the troubling nature of this
situation. On the practical side, the City's decisions are forcing the Flahertys to take
extraordinary steps to protect their own children. Further, the family effectively will be held
captive within their home during peak traffic hours. In fact, I now understand that the City has
asked the Flaherty's to move their driveway to accommodate the City's decisions.
Legally speaking, the City has created a public nuisance and has inversely
condemned the Flaherty home by virtue of this combined action. Mr. Flaherty no doubt will
blanche at the threatening nature of my legal claims, as he is looking to work with the City'
toward a solution, but I fear the City is taking advantage of Mr. Flaherty and his family.
If there remains a possibility of working with Mr. Flaherty toward a solution, I'm
all for it. If not, please have your legal counsel call me. Thank you.

Critical Areas . Checklist
The Critical Areas Checklist contained on
this form is to be filled out by any person
preparing a Development Permit
Application for the City of Edmonds prior
to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or his/her representative,
must fill out the checklist, sign and date it,

review.the checklist, make a precursory site
visit, and make a determination of the
subsequent steps necessary to complete,a
development permit application.
With a signed copy of this form, the
applicant should also submit a vicinity map

and identify the subject parcel(s). In
addition, the applicant shall include
other pertinent information (e.g.'site
plan, topography map, etc.) or studies in
conjunction with this Checklist to assist
staff in completing their preliminary
