Edmonds, WA 98020 Dear Mr. Scobby: In review of the root intrusion problem into your 6" sewer lateral that serves your residence, it appears that this lateral and the trees causing the problem are outside of the City's right-of-way ownership and therefore, the property owner's responsibility. According to available information on "Bellin Gardens" (the plat adjacent to your property), the City has a ten (10) foot wide utility easement for the eight (8") sewer main only. From the TV records of February 3 and March 4 of 1997, the 8" main is free of roots and the 6" concrete lateral has roots entering the pipe starting at eight (8) feet from the main and continuing to the 4" P.V.C. pipe. Your removal of the two trees which are likely causing the damage would reduce the root problem for now, but ideally the 6" lateral should be replace with P.V.C. pipe. Your City staff has been most, generous and consideratb in helping us to track down what we thought was a commitment, by the land developer, to hook up Mr. Scobby's property, and others, at the time of that development, in 1972. Mr. Mitchell and his staff have been most helpful. Having exhausted our remedies to have the now errant land developer install the side sewers, we have now concluded that Mr. Scobby must meet the City's regulations, and put in his sewer, notwithstanding the fact that his septic tank functions fully. Our problem is this: That Mr. Scobby and his family will be obliged to pay, roughly, $1, 200. 00 by way of hook-up costs, and some $500. 00, or so, in running the sewer line to their home.
