GENERAL CRITICAL AREAS REPORT REQUIREMENTS Critical Areas Reports identify, classify and delineate any areas on or adjacent to the subject property that may qualify as critical areas. They also assess these areas and identify any potential impacts resulting from your specific development proposal. If a specific development proposal results in an alteration to a critical area, the critical areas report will also contain a mitigation plan. General Mitigation Requirements for all Critical Areas are discussed in ECDC 23.40.110 through 23.40.140. REPORT REQUIREMENTS — WETLANDS The site investigation has shown that the site may contain or be adjacent to a wetland. Wetlands are areas inundated or saturated by ground or surface water that support, under normal circumstances, vegetation adapted for life in saturated soil. Wetlands are generally rated according to their size, condition, function, and vegetation types into four (4) different categories described in ECDC 23.50.010 and by use of the "City of Edmonds Wetland Field Data Form" by the critical areas consultant. Buffer widths for wetlands vary depending on the category of the wetland as listed in ECDC 23.50.040.F. In addition to the general requirements for Critical Areas reports referenced above, there are specific Critical Areas report requirements for wetlands that are provided in ECDC 23.50.030. DEVELOPMENT PROPOSALS ASSOCIATED WITH WETLANDS Development proposals that encroach into wetlands, wetland buffers, or building setbacks may be allowed through the approval of certain processes. The width of a wetland buffer may be reduced through buffer enhancement if the criteria described in ECDC 23.50.040.F.3 can be met. The maximum amount that a buffer can be reduced through buffer enhancement is 50%. A buffer may also be modified through a process called buffer averaging. The criteria applied to buffer averaging are listed in ECDC 23.50.040.F.4. The maximum amount that the buffer width can be reduced at any single location through buffer averaging is 50%. • Development proposals that proposed encroachments into buffers beyond what is allowed through the above methods require a Critical Areas Variance, or a Reasonable Use Exception. Perhaps your street needs paving, perhaps the septic tank is acting up and a sewer would be the answer, perhaps the City of Edmonds needs a new City Hall or a sewage treatment plant, or perhaps a trunk sewer to serve an area of the City not already served. Having agreed upon the need for one of these worthwhile improvements, the first question is WHO PAYS? The answer to this question depends upon several things, the most important being the answer to the question of WHO BENEFITS from the proposed improvement. Appropriate methods of financing are indicated as follows: Improvement benefit to All people in the City (a) General Obligation Bonds The people in one specific area within the City and/or (b) Revenue bonds (a) Local Improvement District, or (b) private funds As indicated below, the Local Improvement District (L.I.D.) method or use of private funds comprise the financing methods available for an improvement affecting a single area within the City. In order to use private funds to finance an improvement, all the people in the area must AGREE TO PAY their share of the cost of the project. Since it is difficult to find many people that will all agree on something, this method of financing is usually successTu-T only in small projects involving a limited number of people who will agree to share the costs. This means that for larger projects, the most successful method of financing is the L.I.D., which needs only a majority of property owners to initiate an improvement project. 0 Incorporated August 11, 1890 0 Sister Cities International — Hekinan, Japan CREATING AN LOCAL IMPROVEMENT DISTRICT (L.I.D.) The following two (2) methods exist for creating an L.I.D., both of which are outlined by State Law: 1. The Petition Method The petition method requires the submission to the City Council of a petition bearing signatures of property owners representing a majority of the area within the proposed district. Districts may be created within or outside of the City subject to Boundary Review Board review. 2. The Resolution Method An L.I.D. is initiated by the adoption of a Resolution of Intention by the City Council whenever the Council sees a need for a certain improvement. With the resolution method, a hearing is held prior to actual establishment of the L.I.D. to determine whether or not the property owners desire to go ahead with this project. Since the petition method does not require a public hearing, the Edmonds City Council generally is adverse to the use of the petition method alone and has established a policy of accepting a petition and then setting a hearing by resolution method in order to give all property owners an opportunity to hear the facts directly, to ask questions, and to comment on the proposed improvement. The steps to be taken by a property owner or a resident interested in creating a L.I.D., then, are as follows: 1. Hold discussion with neighbors to determine the limits of the area where residents are interested in improving. 2. Have a petition prepared outlining the desired improvement project. 3. Obtain signatures of property owners representing 51% or more of the area. 4. Present the petition to the City Clerk for presentation to the City Council. (The Edmonds City Council meets every Tuesday evening at 7:00 p.m.) 5. City officials will check petition for adequacy of signatures by bonafide property owners. 6. Upon establishment of validity of the petition, the City Council will set a date for an official public hearing. Notices will be sent to each property owner giving the time and place of hearing and the estimated amount of assessment for each parcel of land. (Occasionally, the City Council will hold two (2) hearings, the Page 2 a db fi'rst of which will be an informal hearing prior to sending out assessment estimates.) 7. The hearing is held. This is the time and place for those persons who are opposed to the project to submit protest in writing to the City Council. The present policy of the City Council is to consider protests in excess of 50% of the total cost of the project if required at this time as sufficient to terminate the project. The signature of each property owner is evaluated as the amount of his assessment. During the next thirty -day period following the hearing, protests from property owners whose share would total 60% of the total project costare required to invalidate the project. Sanitary sewer and fire hydrant project protests of 60% may be over ruled if an unanimous Council approves with a finding that public health or safety necessitates improvement. 8. At the close of the thirty -day waiting period after the hearing, if protests then in hand are insufficient to invalidate the project, the Council will order the legal and engineering work on the project to proceed. 9. Contract plans and specifications will be completed and construction bids will be called for and award made to the lowest competent bidder. .10. The project will then be constructed and accepted after final inspection by the City. 11. Actual total final costs will be determined, actual final assessments to each property owner will be computed, and the final assessment roll prepared. Notices of final assessments will be sent to all property owners and a public hearing held with regard to the final assessment roll. 12. Following the hearing, property owners generally will have thirty (30) days to pay their assessment in full or in any part, interest free. Otherwise, the first payment will become due one (1) year later. The remainder of the assessment may generally be paid over a ten (10) year period in ten (10) equal payments, plus interest. The Council may provide for bonds of up to thirty (30) years to be issued (typically ten years). Assessment Method The approved preliminary assessment role will establish the method of assessment per parcel in accordance with the RCW's, Chapter 35.44. It is desirable that a preferred method of assessment be accompanied with the L.I.D. petition. Common methods of assessment which will vary with the type(s) of improvement include a cost per front foot, cost per parcel or equivalent parcels, cost per square foot, and a cost based on a zone and termini method. In no case should the assessment on a parcel exceed the benefit to the parcel as determined by a qualified appraiser, unless waived by the property owner(s). The city engineer may inspect the premises or property which are desired to be used in order to ascertain any facts which may aid in determining whether a permit shall be granted and shall endorse his findings on such application and transmit the same to the city councill. Any application for a permit to construct, erect or maintain an awning, marquee, sign areaway, or any structure in a public place shall be transmitted by the city engineer to the building official, who shall ascertain if the plans and specifications conform to the regulations pertaining to safety, material and design of the building code. The building official shall then endorse his findings on the application and transmit the same to the city engineer. If the city council, in regular session finds that the application conforms to the requirements of the Edmonds City Code pertaining thereto, and also that the proposed use of such public place will not unduly interfere with the rights of the public, said council may approve thereof, and if approved, shall fix the time for which the permit may be granted and shall direct the city engineer to issue a permit, upon the applicant's compliance as herein specified with the provisions of this Ordinance and such conditions as deemed necessary by the city council. Section 6.40.040 Indemnity_2n apprqyed.applications for permits If the city engineer and/or the city council determines that there is a possibility of injury, damage, or expense to the city arising from an applicant's proposed use of any public place, the applicant may be required -2- to provide adequate provision for indemnity. In addition the city may require as a condition for such permit bonds, deposits or other provisions to provide for inspections, surveys, plans, and other services performed by the city, of restoring the street and removing any earth or other debris from the street, the replacement of any utility interrupted or damaged, or the completion of any work left unfinished, the cost of filing of an indemnity agreement with the city, if such an agreement is required with the permit, and any other expense the city may sustain in con- junction with the permitted work. If the city engineer or the city council determines that engineering or similar studies must be made prior to the approval of any appli- cation for permit, the cost of such study shall be paid for by the applicant, or deducted from his indemnity de- posit, if one is required. Section 6.40.060 Revocation -of permits All permits granted under the provisions of this Ordinance for the use of any public place shall be wholly of a temporary nature, shall vest no permanent right and shall be issued and may in any case be revoked by the city council upon thirty days' notice; or without notice, in case any such use or occupation shall become dangerous or any structure or ob- struction permitted, shall become insecure or unsafe, or shall not be constructed, maintained or used in accordance with the provisions of this Ordinance. If any such structure, obstruction, use or occupancy is not discontinued on notice so to do by the city engineer, he may forthwith remove such structure or obstruction from such place, or make such repairs upon such structure or obstruction as may be necessary to render the same secure and safe, at the expense of the grantee of the permit, or his successor, and such expense may be collected in the manner provided by law; and the city council may require a surety bond in such connection.
