Following the procedures listed below should help and simplify the installation process and minimize the inconveniences: 1. You will need to acquire a side sewer permit from Olympic View Water and Sewer District. The cost will be $35.00 for inspection. If you have not paid assessment frontage already to Olympic View Water, you will be required to pay a $7.00 per frontage foot of your lot in addition to the $35.00 fee for inspection. There is also a $856.00 general facilities fee that is required by Olympic View Water District. 2. After you have completed the above, you will need to have a bonded contractor do the crossing on 220th Street to the property line. The contractor must obtain a city of Edmonds of Right -of -Way permit for $30. A patch restoration will be approximately $150 for a 3' X 60' patch. 3. You should contact Olympic View at 774-7769 for their inspection schedules and requirements. 4. Can you pay the special connection fee in advance, even ifyou don't connect to sewer now, to avoid the inflation factor being applied to thefeefrom the time of adoption of thefee to the time of connection? Yes, you may pay the sewer special connection fee right away, or at any time. 2. Ifyou pay the special connection fee in advance, prior to connecting to the sewer system, can you pay in installments? No, the option of paying installments will not be available through the City. 3. You said theproperty at 21919 88th Avenue Wis apart ofyour same subdivision (Manor Court) and is presently connected to the sewer system through a connection across the neighbor's driveway at 8725 220th Street SW. You stated that you didn't know specifically how they did it, or if they got permits/approvals. Since 21919 8e Avenue W is not included in the special connection fee because the arealready y connected to sewer, you asked what would happen if they wanted to connect to the stub out the City installed? Wouldweletthem? Would they have to pay the special connection fee? The property at 21919 Wh Avenue W has not been included in the special connection fee because it is already connected to the sewer system. Note that 21919 88th Avenue W is presently an Olympic View Water and Sewer District (OVWSD) sewer customer, not a City customer. We have reviewed the side sewer as - built drawings provided by OVWSD for both 8725 220th Street SW and 21919 88th Avenue W. The as -built drawings indicate that these sewer connections were installed in September 1998 and August 1999 respectively, and that the side sewer for 21919 88 1h Avenue W goes across the property at 8725 220'h Street SW and connects to the sewer main through the same sewer lateral as 8725 220th Street SW. The as -built drawings indicate that these sewer connections were inspected by an OVWSD inspector. Since the property at 21919 88 th Avenue W is presently connected to the sewer system through Incorporated August 11, 1890 C;-4— r;+,, 14-1A.— I---- what appears to be an appropriately authorized connection and is presently an OVWSD sewer customer, the City would not allow them to connect to the stub out we have installed. 4. You also mentioned that the owner of 8805 220th Street SW is planning to subdivide that lot and build additional houses. You asked what would happen if the ownerldeveloper wanted to connect the new houses to the stub out the City installed? Wouldweletthem? Would they have to pay the special connection fee? Wehad previously determined that the one house presently at 8805 220th Street SW is connected to the sewer main in 220th Street SW through an existing side sewer, which is big enough for three houses (the maximum number that can be built on that lot under current zoning codes). Also, this property is presently an Olympic View Water and Sewer District (OVWSD) customer. Therefore, this property was also not included in the special connection fee. As with the property at 21919 88b Avenue W, the City would not allow the new houses planned for 8805 220th Street SW to connect to the stub out we have installed. They will be required to connect to the sewer main through the existing side sewer connection. 5. You asked, ifyou incur the total cost to install the 8 inch sewer collectorpipe to connect your house to the City -installed stub out and the other two property owners (21903 and 21911) don't participate in this, a) would the other two property owners have to pay the special connection fee, and b) how wouldyou be able to recover your costs of installing the sewer collectorfrom the other two property owners? Yes, the other two property owners will have to pay the special connection fee to connect to the sewer collector. During our phone conversation, I explained that one option for you to recover your costs from the other property owners would be through a latecomer agreement. 6. Finally, you said that there is a covenant in your Manor Court subdivision that says that allfour properties have to go in together on things such as sewer lines, etc. You asked how the property owner at 21919 8e Avenue W could have connected to the sewer by himself and not be part of the special connection fee? Youaskedwhatyou can do about that? During our phone conversation, I responded that the City could not advise you regarding any subdivision covenants, which are not for the City to enforce or interpret. WHEREAS, the City of Edmonds has constructed a major street improvement project for 220th Street Southwest; and WHEREAS, an opportunity existed to install sanitary sewers in conjunction with said improvements and said sanitary sewer construction has now been completed; and WHEREAS, residential properties located on 88 1h Avenue West near the street improvements are served by septic systems rather than sanitary sewers; and future; and WHEREAS, the existing septic systems are likely to fail within the foreseeable WHEREAS, due to the localized nature of the sewer project and its limited benefit to the rest of the sewer utility, the City Council deems it to be in the public interest to fund the project with monies from the City's sewer utility subject to the payment of a special connection fee by affected property owners when they connect to the sewer system, and WHEREAS, the City Council deems it appropriate to create a special connection fee based on the actual costs of construction of this component of the City's sanitary sewer system and to levy that charge against the properties described herein at the date of connection, and WHEREAS, the City Council deems it appropriate, when connection to the sanitary sewer system and payment of the special connection fee is deferred, that the fee be adjusted in consideration of the time value of money applied to the original actual cost of construction, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. ECC Chapter 7.30 Water Rates and Sewer Charges is hereby amended by the addition of a new Section 7.30.036 Sewer Special Connection Districts to read as follows: 7.30.036 Sewer Special Connection Districts A. A connection charge shall be paid by each new customer connecting to the City's sewer system within the following described district(s). This special connection charge is based upon the actual cost of constructing improvements which relate directly and exclusively to homes within the district(s) and which are, because of the special nature of the construction, separate and distinct from the overall costs of the system paid by a customer pursuant to ECC Chapter 7.30.035. These charges shall be in addition to the charges paid by a new customer pursuant to 7.30.035 and do not duplicate any costs contained in the underlying sewer utility connection charge. B. 88h Avenue West Sewer Special Connection District. 1. Properties addressed as 21903, 21904, and 21911 881h Avenue West shown on the attached Exhibit A maintained on file in the City Clerk's office and any subdivision, lot line adjustment or reconfiguration of the lots or the property represented by such addresses shall pay a special connection fee, to be paid in full at the time of connection to the sewer system, of $2,941.39 per lot. 2. Due to the significant additional sewer system construction that will be required at the property owners' expense to connect these properties to the sewer system after completion of the sewer project by the City, these properties may defer -2- VA connection and shall not be required to connect to the sewer system within the time limit requirements of ECDC 18.10.010 and ECC 7.30.040. 3. The owner of any of these properties that does not connect to the sewer system within the time limits in accordance with Edmonds Community Development Code 18.10.010 shall, upon connection to the sewer system, pay the above established special connection fee, increased based upon the Department of Labor Bureau of Labor Statistics Consumer Price Index for construction for the Seattle -Bellevue -Everett area from the effective date of this ordinance to the time of connection to the sewer system. Section 2. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
