Per CA-95-28, a study is required due to a wetland on or nearby the site. In talking with
John Bissell who determined that a study is required, he said that based on the site plan
for the proposed project, at minimum the wetland would be 77' from the proposed
addition (27' more than if a wetland did exist and a 50' buffer was required). Also, the
proposed addition is exempt from a Critical Area Study pursuant to ECDC
20.15B.04OA2. Given a worst case senario, the project does not appear to increase the
potential impact to the possible Critical Area or its buffer.

A site inspection of the property has revealed a wetland. This wetland has been studied for three
other properties, and has been determined to be a class 2 wetiand (CA-92-17; CA-92-66; CA 93-
150). Theses previous studies did not identify the location of the wetland boundary on the subject
property.
Based on the above findings, it is determined that there is potentially a critical area on or adjacent
to the site. A Critical Areas Study is. required to delineate the boundaries of this potential critical
areas, the buffers and setbacks. A wetland biologist must identify the boundaries of the wetland,
then a licensed land surveyor must prepare a map which delineates the wetland, the critical area
buffer, and the buffer setbacks. The wetland biologist and land surveyor must be approved by the
City. All work required by this determination must be performed through a three party contract
and all studies must be conducted according to section 20.15B of the Edmonds Community
Development Code.
If the property owner wishes to apply for a specific development permit which they feel would not
impact the Critical Areas located on the site, they may submit their proposal to the Planning
Department for review. If the Planning Department finds that the proposed development permit
will not adversely impact a Critical Areas or its buffers, a conditional waiver may be issued on a
proiect by proiect basis. -

Thank you for taking the time as a citizen of Edmonds to write me. It is most unfortunate
that you were treated in the manner described in your letter. I have spoken with the City
Engineer regarding the incident and have his assurance that he will talk to the employees
in his department regarding your treatment at the counter. The employees know they are
here to serve the public.
I will respond to your questions in the order presented in your letter:
As you probably know, the annexation of the area in which you live was the result of
several failed septic tank systems in your neighborhood. Our records indicate that a
sufficient number of your neighbors signed the petitions to validate the request for
consideration of annexation. Unfortunately, as Mr. Charles Day explained to you by
phone, the County Assessor's Office had not given us the proper owner's name on
the mailing labels for your property. These lists were used in notifying the property
owners in your area of public meetings held to discuss the pro's and con's of the
requested annexation. There were actually two separate requests for annexation in
your area. One involved the westerly area across the street from your house, and it
started in 1990. The second petition involved the area where your property is
located, and this effort was started in 1991. Both of these annexations took several
months to form. Legal notices were given out and posted, along with information
regarding the City. The desire to connect to sanitary sewers was the motivation for
the annexations. The need to form an LID for sewer service was known during the
annexation petition stage. Our mailing label indicated the information was sent to
Mr. Ronald L. Becker, the prior owner of your property. Mr. Day told me you had
notified the County that the owners information on your tax record was incorrect
and that you had provided the County Assessor's Office with corrected information
to update your file. However, no correction was made, and as a result, the mailed
notices were not delivered to you. The City had no prior knowledge that you were
not receiving these notices until you were contacted by Mr. Gordon Hyde. We rely
on the County's records as being accurate until we find out otherwise. Mr. Day
indicated he would be willing to search the County system through our computer tie
and see if your record has been updated. You would need to allow sufficient time
for the correction to be made by the County, and then call Mr. Day (771-0240,
extension 369) �o look up the information as a check on the City.

2. Regarding the LID as being a surprise, as mentioned above, the fact is the entire
annexation petition was predicated on needing sewer lines because neighboring
septic systems, had failed. Again, letters were mailed to the property owners using
labels supplied by -the County- Neighborhood meetings were held, and two meetings
were conducted' b46�e' ihe' di� Council, including the public hearing for the
:"..,preliminary assessment roll., But this time, a letter to your address was returned to
the City, and this pro : mpte&Mr. Hyde to come to your address. It was certainly not
intentional on -the:pampf, thdCity for you to not receive information regarding
either issue.
3. When your area was annexed into the City of Edmonds, your water service from the
Alderwood Water District stopped. Edmonds has its own water utility, and yes, our
rates are higher than those charged by Alderwood Water District. For years you ,
have enjoyed a low water rate, even lower than Olympic View Water District rates.
The City of Edmonds purchases its water from Alderwood, and consequently we pay
a marked up price. Therefore it follows that our customers pay a higher rate than
Alderwood customers, but the difference is more in the 40% range than the 50% to
75% referred to in your letter.
As I mentioned in the first paragraph, the City Engineer is dealing with his employee that
spoke with you at the counter, and I certainly do apologize for the way you were treated.
As a new citizen of Edmonds, I want you to know that in my position as Mayor I welcome
input from the residents. Please feel free to contact me regarding this or any other issue of
concern.

COVENANT
COVENANT made this date by the undersigned, hereafter
referred to as "Owners",
WHEREAS, Owners own property located at 21915 - 92nd
Avenue West in Edmonds and legally described as set forth on
Exhibit A, attached hereto and incorporated herein by this
reference as if set forth in full, and
WHEREAS, Owners's property is currently outside the
city limits of the City of Edmonds and is on a septic tank
system, and
WHEREAS, Owners' septic tank system is currently
failing thereby necessitating immediate hookup to a sanitary
sewer, and
WHEREAS, currently it is feasible for Owners to
connect to the Olympic View sewer on 220th, and
WHEREAS, pursuant to agreements between the City of
Edmonds and Olympic View Water District, the City of Edmonds
must consent to any connection to the Olympic View Water
District's sewer on 220th, and
WHEREAS, -the City policy has been to require annexa-
t.ion prior to connection to sewers but that in this instance
connection can be made prior to annexation if Owners agree to
support current annexation proceedings in the area, and

WHEREAS, the City is currently studying the feasibi-
lity of forming an LID in the area, including Owners' property
for construction of a sanitary sewer, and
WHEREAS, the City Council finds that it is in the best
interest of the public health, safety and welfare to allow
connection to the sanitary sewer under the terms and
conditions set forth herein, now, therefore,
IN CONSIDERATION of the City of Edmonds allowing
Owners to connect to the sanitary sewer on 220th Owners agree
as follows:
1. Owners agree to support any annexation petition for
annexation into the City of Edmonds and further agree that
they will not oppose in any manner any annexation efforts.
2. Owners agree that they will not protest the formation
of any LID or ULID for construction, in part, of a sanitary
sewer if the boundaries of the proposed LID include the above
described property. Owners reserve the right to challenge the
amount of their individual assessment and/or the method of
assessment. Owners agree that they will not file written
protest and/or institute suit against formation of any LID or
ULID which includes their property, which LID is for the
construction, in part, of a sanitary sewer.
3. This Covenant shall be deemed to run with the land
described on Exhibit A and shall be binding upon Owners, their
heirs, successors, assigns and lessees. Recording costs of
this covenant shall be borne by Owners.

4. Owners agree that in addition to an action for
damages, the City may maintain an action for specific perfor-
mance of the terms of this agreement including suit to compel
signature of the Owners on any documents, petitions or other-
wise necessary to effectuate the intent and purposes of this

suit to enforce any provision of this agreement and/or seek
damages, Owners shall pay, in the event the City prevails, the
City's costs including reasonable attorney's fees and expert

On November 15, 1983 the residents at 21915 - 92nd Ave. W. appeared
at the City Council meeting and requested authorization to connect
to the Olympic View Water District (OVWD) sanitary sewer. The agree-
ment between OVWD and the City of Edmonds requires that OVWD obtain
written consent from the City prior to making any sewer connection
outside the district boundaries. This property is located outside the
district.
The on -site sewage disposal system appears to have failed., which re-
quires immediate action.
I recommend that the Council authorize this1connection, with the
following requirement:

Analyst. (2) The ad hoc steering committee will meet weekly for approximately three
hours. (3) A Data Processing Time Frame Schedule was provided for approval. It is
anticipated that the committee will complete their work by February 7, 1984 and
report back to the Council. Mr. Housler said the elected body should convey the
findings of the study to the rest of the Council with some confidence. All the
information has been gathered from the users and it is now at the point of deciding
how to put the system together. Councilmember Nordquist suggested that there be more
than two Councilmembers on the committee so if one cannot be present at a meeting
there will be a backup. He questioned whether the City Engineer would be very
involved in the process as it was his understanding that in most cities the Engineering
Department has a system of its own. City Engineer Jim Adams responded that he deals
with a computer on a daily basis and has had a lot of education in computers for the
last 20 years, and he thought that whatever the City gets will be used a lot by the
Engineering Department. He presently handles all of the construction contracts for
the City and works with the Finance Department, and he said as they go through the
study it can be determined whether his department will use one system or two systems.
It was decided that Councilmembers Nordquist and Naughten will serve on the committee
with Councilmember-elect Lloyd Ostrom as a resource person and after he becomes a
Councilmember he will continue to serve in the place of Councilmember Naughten. Mr.
Ostrom said he would have to be disassociated from anything that has to do with
acquisition, but he was told he would only be designing a system and then it will go
out for bid. Councilmember Gould suggested that if the committee needed until the
first of April they should take that time.
RECOMMENDATION ON PROPOSED SEWER CONNECTION REQUEST FOR HOME LOCATED AT 21915 92ND AVE. W.
City Engineer Jim Adams stated that the people who wanted to connect found it is
going to be quite expensive to connect to Olympic View, so he gave them some advice
on how to upgrade their existing drainfield, which may improve their situation enough
to wait until their area is'annexed and they can get sewers along with the others in
the proposed annexation. He recommended, however, that the Council authorize this
individual connection on the condition that the property owners sign and record a
covenant on the property which states that they will support any annexation petition
to the City and support and participate in a sewer LID when the area is annexed to
the City. That way, should they be unable to improve their present situation and
decide to connect, the approval will already be in place and there will be no delay
for them. City Attorney Wayne Tanaka indicated that at the time of final assessment
roll the Council could give credit for improvements that were already done which are
consistent with the LID. Councilmember Gould asked if there could be a separate
agreement for the City to run in an 8" line and then when any people come in have
them pay for the connection to that, rather than tear the street up twice..,That
would require approval of the County to put in the line and it would delay the people

On November 15, 1983 the residents at 21,915 - 92nd Ave. W. appeared
at the -City Council meeting and requested authorization to connect
to the Olympic View Water District (OVWD) sanitary sewer. The agree-
ment,between OVWD and.the City of Edmonds requires that OVWD obtain
written consent from the City prior to making any sewer connection
outside the district boundaries. This property is located outside the
district.
The on -site sewage.disposal system appears to have failed, which re-
quires immediate action.
I recommend that the Council authorize this connection, with the
following requirement:
The property owner sign and record a covenant on
the property, which states that they will support
any annexatio'n petition to the City and support
and participate in a sewer L.I.D. when the area
is annexed to the City.

The regular meeting of the Edmonds City Council was called to order at 7:35 p.m. by
Mayor Pro tem Jo -Anne Jaech in the Plaza Meeting Room of the Edmonds Library. All

AUDIENCE
Dan Rice, representing the Edmonds Business Association, requested financial help for
their Christmas promotion. They had anticipated raising enough funds at the Taste of
Edmonds to support the Christmas activities, but although the Taste of Edmonds was
successful in promoting Edmonds it was not financially successful. Mr. Rice said the
City of Edmonds had contributed $800 last year and he hoped it would do the same this
year, and he invited a representative of the Council to attend the next meeting of
the Edmonds Business Association on the morning of November 18 at which time he also
hoped the City's contribution would be presented. He did not as yet have a budget
for the activities but one of the major items will be the boughs for the Christmas

GOULD, TO CONTRIBUTE $800 AGAIN THIS YEAR TO THE EDMONDS BUSINESS ASSOCIATION FOR
CHRISTMAS DECORATIONS, FUNDS TO COME FROM THE COUNCIL CONTINGENCY FUND. MOTION
CARRIED.
Rita Olson, 21915 92nd W., just outside of the Edmonds City Limits, asked for approval
to hook up to the Olympic View sewer system because of a septic tank problem. She
had sent a letter to the Mayor with this request last week. She said she has a
health problem that has to be solved. City Engineer Jim Adams said this prODerty is
included in the area to be addressed this evening under an annexation petitio'n and if
she were to hook up now she would have to pay an assessment to Olympic View (she said
it would be $805) and if there later is an LID there when the property is annexed she
may have to pay again. City Attorney Wayne Tanaka stated that an agreement may be
reached with these property owners to assure their participation in the annexation
and in any future LIDs but without double charges to them, and he asked for an
opportunity to pursue this and return with a recommendation. He said there is a
problem of equity in that it is not known how many other people may be experiencing
similar problems, and if one septic system.fails it is not unreasonable to suppose
others in the immediate area may experience similar problems. He said to exclude
them entirely from an LID would result in others paying a higher cost, but an agree-
ment may be worked out to allow them to hook up now and give them credit towards a
future LID. Councilmember Allen wanted immediate action if there is such a serious
health problem, and Mr. Adams recommended that they be allowed to connect and pay the
assessment to Olympic View and then deduct the assessment they pay from any assessment
that might be due on their property at the time there is an LID and that they be
required to hook up to the Edmonds system when it is put in. Councilmember Allen
asked that his recommendation be considered next week along with any other that there
may be. She wanted to be sure the matter is considered next week in light of the
fact that the following week's meeting has been canceled.

COVENANT
COVENANT made this date by the undersigned, hereafter
referred to as "Owners",
WHEREAS, Owners own property located at 21915 - 92nd
Avenue West in Edmonds and legally described as set forth on
Exhibit A, attached hereto and incorporated herein by this
reference as if set forth in full, and
WHEREAS, Owners's property is currently outside the
city limits of the City of Edmonds and is on a septic tank
system, and
WHEREAS, Owners' septic tank system is currently
failing thereby necessitating immediate hookup to a sanitary
sewer, and
WHEREAS, currently it is feasible for Owners to
connect to the Olympic View sewer on 220th, and
WHEREAS, pursuant to agreements between the City of
Edmonds and Olympic View Water District, the City of Edmonds
must consent to any connection to the Olympic View Water
District's sewer on 220th, and
WHEREAS, the City policy has been to require annexa-
tion prior to connection to sewers but that in this instance
connection can be made prior to annexation if Owners agree to
support current annexation proceedings in the area, and .

WHEREAS, the City is currently studying'the feasibi-
lity of forming an LID in the area, including Owners' property
for construction of a sanitary sewer, and
WHEREAS, the City Council finds that it is in the best
interest of the public health, safety and welfare to allow
connection to the sanitary sewer under the terms and
conditions set forth herein, now, therefore,
IN CONSIDERATION of the City of Edmonds allowing
Owners to connect to the sanitary sewer on 220th Owners agree

as follows:
1. Owners agree to support any annexation petition for
annexation into the City of Edmonds and further agree that
they will not oppose in any manner any annexation efforts.
2. Owners agree that they will not protest the formation
of any LID or ULID for construction, in part, of a sanitary
sewer if the boundaries of the proposed LID include the above
described property. Owners reserve the right to challenge the
amount of their individual assessment and/or the method of
assessment. Owners agree that they will not file written
protest and/or institute suit against formation of any LID or
ULID which includes their property, which LID is for the
construction, in part, of a sanitary sewer.
3. This Covenant shall be deemed to run with the land
described on Exhibit A and shall be binding upon Owners, their
heirs, successors, assigns and lessees. Recording costs of
this covenant shall be borne by Owners.

4. Owners agree that in addition to an action for
damages, the City may maintain an action for specific perfor-
mance of the terms of this agreement including suit to compel
signature of the Owners on any documents, petitions or other-
wise necessary to effectuate the intent and purposes of this
agreement. Owners agree that in the event the City brings
suit to enforce any provision of this agreement and/or seek
damages, Owners shall pay, in the event the City prevails, the
City's costs including reasonable attorney's fees and expert
witness fees.
