RIGHT OF ENTRY AGREEMENT
This Right of Entry Agreement (Agreement) is made effective October 17, 2011 between
the City of Edmonds, WA, a municipal corporation of the State of Washington,
hereinafter referred to as "CITY" and Beverly and HqM Shelton, hereinafter referred to
as the "OWNET'.
The undersigned OWNER of the following Property hereby grants the CITY access to
the Property for the following purposes:
Tree Removal — I Fir per attached photo. Located in the southeast comer
of the property at 21925 95 1h Avenue West.
1. Grant of License.
OWNER grants to the CITY a non-exclusive license of reasonable access to the
Property for the purposes stated above. The CITY will not permit any other party,
except CITY's duly authorized representatives, employees, agents and independent
contractors (collectively "Representatives") to enter or use the Property.
2. Contacts.
Prior to access, the CITY and/or its designated Representative(s) shall contact the
following representative(s) of the OWNER to arrange for access to the Property:

3. Liability.
While on the Property, the CITY will comply and will cause all of its Representatives
to comply with all applicable government laws and regulations. The CITY and its
Representatives will be responsible for any damage done to the Property by the CITY
or its Representatives during the performance of the above described work and will
pay the costs of repairing and restoring the Property to substantially the same
condition as existed before the CITY's or its Representative's entry onto the Property.
4. Governing Law/Captions.
The validity, meaning, and effect of this Agreement shall be determined in accordance
with the laws of the State of Washington.

5. No Third Party Rights/Assignment.
Nothing in this Agreement, express or implied, is intended to confer any rights or
remedies upon any person, other than the parties and their respective employees and
representatives.
6. INDEMNIFICATIONMOLD HARMLESS.
The CITY shall indemnify and hold the OWNER and its officers and employees
harmless from and shall process and defend at its own expense all claims, demands, or
suits at law or equity arising in whole or in part from the CITY'S negligence or breach
of any of its obligations under this Agreement; provided that nothing herein shall
require the CITY to indemnify the OWNER against and hold harmless the OWNER
from claims, demands or suits based solely upon the conduct of the OWNER, their
agents, officers and employees and provided further that if the claims or suits are
caused by or result from the concurrent negligence of (a) the CITY'S agents or
employees and (b) the OWNER, their agents, officers and employees, this indemnity
provision with respect to (1) claims or suits based upon such negligence, (2) the costs
to the OWNER of defending such claims and suits, etc. shall be valid and enforceable
only to the extent of the CITY'S negligence or the negligence of the OWNER'S
REPRESENTATIVE or employees. The provisions of this section shall survive the
expiration or termination of this Agreement.
7. Termination
This agreement shall remain in full force commencing on the effective date
herein and shall terminate no later than December 31, 2011.

Dear Mr. Shelton:
I have reviewed your account and will allow a credit for the billing period between
April 10, 1997 through June 9, 1997 in accordance with our City policy. The policy states
that the customer will be billed at the retail rate based upon the average water consumption
for the same period during the previous year. In addition, the excess water lost from the
leak will be billed to customer at the City's wholesale rate with a 15% surq4a�ge add ' ed for
administrative cost. Only one leak credit will be granted in any three year period.

I would like to request that you consider a review and
reduction of my water bill received in June.
As you know I put in a sprinkler system and after the
system was in I had a line break between the meter and
control valves.
I did not know I lost so much water until my bill arrived.
I made the repairs myself and it is OK now. Thank you.

NOTICE TO WSTOMER: This contractor is registered with the State of Washington,
registration No. OLDSO**317BO, as a general/ specialty contractor and has posted with
the State a bond or cash deposit of $6,000/$4,000 for the purpose of satisfying claims
against the contractor for negligent or improper work or breach of contract in the conduct
of the contractor's business.
This bond or cash deposit may not be sufficient to cover a claim which might arise
from the work done wider your cantract. If any supplier of materials used in your construction
project or any employee of the contractor or subcontractor is not paid by the contractor
or subcontractor on your job, your property may be liened to force payment. If you wish

Permits, if required, will be the owner's responsibility.
We shall not be liable for damage to or breakage of septic tanks, underground pipes,
and or conduits not visible from the surface of the ground nor for any damage to approaches
(including sidewalks) from the street to the property line. -
We cannot be responsible for sub grade failures or setifing of subgrade material which
was not installed under the above agreement.
Soil sterilization (weed killer), if included in contract, will be applied at rates specified
by manufacturer. Olds Olympic Inc. will not be responsible for any subsequent growths
of horsetail weed, morning glory, deep rooted ferns, or perennials, which have not reached
maturity prior to application.
All material Is guaranteed as specified. All work to be completed in a wbrkman-like
manner according to standard practices.
Olds Olympic Inc. accepts no responsiblity for any work other than that specifically
described above. Any additions to or alterations of the above work will 6e.executed only
upon written orders and may become an additional charge.
Ali agreements are contingent on strikes, accidents, delays of carriers, and other delays
unavoidable or beyond our contmi.

I am requesting that the city install a barricade or more to
protect my property from being damaged again by out -of -control vehicles.
There has been at least a dozen near misses, but four times now our
fence has been damaged and once a twenty-one year old tree destroyed
by reckless drivers since we-#,qve lived here. The last time was a
hit-and-run on March 30 which also sheared off a telephone pole. I am
fed up with being the victim of crimes. With uninsured motorists and
this hit-and-run we lost the $50. deductible on our own insuran�e
coverage. Besides going through the hassel of getting the fence'repaired
we have to find a way to keep our German Shephard confined until it is
done. He also could be injured.
On March 30 we were in California and the neighbors had to find
the dog when they discovered the damage the next morning. This was
close to seven o1clockon Sunday morning and they had to call our son
in Woodinville and he had to come over, put up a temporaty fence to
keep the dog in, call the police, etc. etc. etc.
To add insult to injury the P.M. truck that installed the new
telephone Dole damaged the ditch and ground on both sides so we can't
keep the grass mowed and damaged the culvert tile. We need this ditch
kept cleaned out and working properly so our yard does not flood in a
bad rain storm. The City representative that I talked to said they
would repair this damage, but it hasn't been done yet,
My point is that, likely, there would�,,Ibe no more damage to our
property if the city would -put up a barri Cade on the north side of the
ditch. I don't know what3td-,tape there is involved to get this taken
care of, but I would like an immediate response to this letter. I am
not attempting to send pictures or diagrams at this time. I will show
you the situation if you will come out to examine it. Thank you.
