As a follow-up to your recent site inspection of my property and more specifically to address the issues al, d -
requiring changes this letter is written. Please find enclosed a summary of the issues, background
information and proposed solutions.
Summary of Issues:
1. Removal and replacement of the old driveway access to I OOh Ave. West.
2. Valiance of new driveway grade fi-om 14% to 20% including additional safety features on die
steep western edge.
3. Transition of new driveway fi-om concrete to asphalt.
Background Information:
As pall of the remodel as defined in permit #970431 the existing gal -age which entered and exited
onto I 001h Ave. West was made part of a new kitchen, family room. Due to the increase in traffic
on I 0(yh since the house was built in 1959, continued use of the old driveway was considered a
safety hazard. A new garage was built with a driveway entering and exiting onto Elm Way. This
design presented special problems that resulted in several compromises which, in pal t, are the
basis for our engineering issues.
The lay of the land dictated die location of the new driveway egress to Elm Way (cast of an
existing file hydrant and storm drain, west of my water meter -supply). All primary utility irms are
on the opposite side of Elm Way from the new driveway. A natural dn&.ex�isus on my side of
the street. In addition the driveway could not be built at a maximum grade of 14%.
The following construction items were completed to accommodate the above considerations
(please refer to the attached sketch):
q> a) A drain field was installed east of the new driveway where the spring is located. Se" 06vk*
(Db) A 12 inch concrete culvert was installed under the new driveway feeding directly
into the storm dl-ain.
c) A rock wall was built around the fire hydrant providing level access fi-om the street.
This after consultation with the Edmonds Fire Chief.
d) The driveway section over the culvert used concrete with fiber but without rebar due
to thickness and strength considerations. A breakawayjoint was made in the
concrete to allow easy removal.
e) 'Me initial grade is 10% rising to 18% at the transition point� then reducing to level.
A fence has been planned along the property fi-onting, I 00th Ave. West to shield the traffic.
Although not specified in the original building permit, removing the old driveway was planned to
take place when the fence was installed. OK.
Proposed Solution and Schedule:
Although the new driveway use is up and fi-om Elm Way to the east, the steep lower side does not
have adequate protection for vehicles. I propose to install several (at least two) concrete posts
adjacent to the rock wall sturounding the fire hydrant. This will insure vehicle safety and
direction into and out of the new driveway.
A yanmcc of driveway grade to 20% maximum is requested. Apparently the architect's letter
requesting this with the original application either didn't arrive or got lost.

I am applying for the fence permit along with this letter and variance to 6 feet. Since the fence
posts will be set in concrete I propose to remove the old driveway and replace with sidewalk and

I have been receiving calls from people indicating that shrubbery at
the intersection of 220th St. S.W. and 100th Ave. W. is impairing
visibility. I recognize that there are instances where home owners
install plantings within the public right-of-way. These plantings
sometimes become overgrown and create a sight distance hazard.
Before I request City crews trim the public right-of-way, I would like
to enlist your cooperation.
I will be directing City crews to do the necessary pruning on August
19, 1991. If you desire to have the plants trimmed in a particular
manner, please do so prior to that date.
Enclosed is a copy of the section of the City Code that pertains to
height restrictions at corners. Because of the volume and speeds of
the vehicles at this intersection, I would request your cooperation in
upgrading the sight lines on your property. I would like to meet you
at your convenience to discuss the possibilities.

FENCES AND HEDGES
17.30.000 GENERAL HEIGHT RESTRICTION
A. The height of a fence shall not be more than six (6)
feet unless a conditional use permit is first
obtained. The height of a particular section of fence
shall be measured from the lowest finished grade at that
section of the fence.
When a retaining wall three (3) feet in height or
greater is contiguous -to and below a proposed fence, the
proposed fence may be constructed for the purposes of
safety not -greater than four (4) feet above the top of
the retaining wall or the finished grade, whichever is
less, without the necessity for a conditional use
permit.
B. The height of a hedge shall not be more than six (6)
� feet unless a conditional use permit is first obtained.

17.30.010 SPECIAL HEIGHT RESTRICT -IONS.
A. Streets and Corners... Height shall normally be limited
to three feet within ten feet of any street or access
easement, and within 30 feet of any corner as shown in
Figure 17-1, unless an exception is approved.
B. Exception. If the Building Official finds thatho
hazard to users of the street or to nearby property will
be created, he or she may approve a fence or hedge of up
to six feet in height.
C. Hazard. No fence or hedge may be.constructed or
maintained if it creates a hazard to users of the street
or to nearby property (See Section 18.85.060).

The proposal is exempt pursuant to ECDC 23.40.230.
Z-Erosion Hazard. Project is within erosion hazard area. Applicant must prepare an erosion and
sediment control plan in compliance with ECDC 18.30.
Critical Area Report Required. The proposed project is within a critical area and/or a critical area
buffer and a critical area report is required. A critical area report has been submitted and evaluated
for compliance with the following criteria pursuant to ECDC 23.40.160:
I The proposal minimizes the impact on critical areas in accordance with ECDC 23.40-.120,
Mitigation sequencing;
2. The proposal does not pose an unreasonable threat to the public health, safety, or welfare
on or off the development proposal site;
3. The proposal is consistent with the general purposes of this title and the public interest;
4. Any alterations permitted to the critical area are mitigated in accordance with ECDC
23.40.110, Mitigation requirements.
5. The proposal protects the critical area functions and values consistent with the best
available science and results in no net loss of critical functions and values; and
6. The proposal is consistent with other applicable regulations and standards.
F] Unfavorable Critical Area Decision. The proposed project is not exempt or does not adequately
mitigate its impacts on critical areas and/or does not comply with the criteria in ECDC 23.40.160 and
the provisions of the City of Edmonds critical area regulations, See attached findings of
noncompliance.
A —Favorable Critical Area Decision. The proposed project as described above and as shown on the
attached site plan meets or is exempt from the criteria in' ECDC 23.40.160, Review Criteria, and
complies with the applicable provisions of the City of Edmonds critical area regulations. Any
subsequent changes to the proposal shall void this decision pending re -review of the proposal.
Conditions. Critical Area specific condition(s) have been applied to the permit number referenced
above. See referenced permit number for specific condition(s).
