NOW THEREFORE, for and in consideration of the mutual covenants and benefits to be derived
therefrom, the parties do agree as follows:
That a side sewer shall be constructed in accordance with the District's standards and
specifications.
2. There shall be an easement four (4) feet wide and each party hereto does grant and
convey to the other an easement over his property for the period and purposes
hereinafter expressed.
3. The cost of maintenance, repair or reconstruction of that portion of the sewer used in
common shall be borne in equal shares by the owners except that the owners of any
lower parcel shall not be responsible for the part of the sewer above their connection;
and when necessary to repair, clean or reconstruct the sewer, the parties to this
agreement shall have a right of entry for that purpose. Whenever entry is made to repair,
clean or reconstruct such work shall be done in a workmanlike manner, and the premises
shall be promptly restored to their previous condition as soon as is reasonably possible.
4. The property owners who are parties hereto, their successors, assigns, (or tenants) do
hereby agree to indemnify and save harmless the Olympic View Water and Sewer
District and its commissioners, officers, and employees from all future damages resulting
from the connection of the side sewer to the above described premises.
5. This agreement shall be filed with the County and shall be a covenant with the land and
binding upon all parties and their heirs and assigns forever.

WHEREAS, Coons wish to subject these properties to the covenants and restrictions
contained herein for the mutual benefit of the future owners of the parcels;
NOW, THEREFORE, the undersigned Declarants hereby declares the properties
described above shall be held, sold and conveyed subject to the following easements, restrictions,
covenants and conditions, all of which are for the purpose of enhancing and protecting the value,
desirability and attractiveness of the parcels described above. These easements, covenants,
restrictions and conditions shall run with the real property and shall be binding on all parties,
having or acquiring any right, title or interest in the described properties, or any part thereof, and
shall inure to the benefit of the Declarants, their heirs successors and assigns.
ARTICLE I
USE RESTRICTIONS
1. Maintenance of Lots. Each Owner, at said Owner's sole cost and expense, shall promptly
and continuously maintain, repair, and restore said Owner's Lot (including the yard and
landscaping) and Home and other Improvements located thereon, and also such other
areas as may be required pursuant to the provisions of this Declaration, in a good, clean,
attractive, safe and sanitary condition and in full compliance with all applicable
governmental laws, rules and regulations and the provisions of this Declaration.
1.2. Residential Use. All Lots and Improvements located thereon shall be used, improved,
and devoted exclusively to residential use. No business of any kind shall be conducted
on any Lot with the exception of (a) the business of Declarant in developing and selling
all of the Lots and (b) such home occupation which may be permitted by the appropriate
local government and which is not otherwise in violation of the provisions of this
Declaration.
1.3. Buildings. Buildings shall be restricted to one single-family residence, including
appurtenant garage or carport, covered patio, or storage building. The garage, carport
and any of the other structures allowed shall be of similar construction, color, siding,
roofing and appearance as the residence. No temporary structures are allowed and no
tarps or vehicle enclosures made of metal, plastic, canvas or vinyl are allowed on the
property.
1.4. Oil and Mining Requirements. No oil drilling, oil development, oil refining, quarrying,
or mining operations of any kind shall be permitted upon or in any Lot; nor shall oil
wells, tanks, tunnels, mineral excavations or shafts be permitted upon or in any Lot. No

derrick or other structure designed for use in boring for oil or natural gas shall be erected,
maintained or permitted upon any Lot.
1.5. Mobile or Manufactured Housing. There shall be no mobile or manufactured housing.
1.6. Parking. Unless housed within a garage or substantially screened from view from the
street or from the ground level of adjacent Lots in a manner reasonably approved by the
other lot owner, in writing, no inoperable or unsightly cars or trucks, construction or like
equipment, or trailers (utility, boat, camping, horse, or otherwise), shall be allowed to be
parked or stored on any Lot for a period in excess of 14 days. No goods, equipment or
vehicle (including buses, trailers, recreational vehicles, etc.) shall be dismantled or
repaired outside any building or residential lot unless the repairs are completed within 14
days. Boats and travel trailers may be stored on a lot provided they are in good condition
and operable. The other lot owner may require removal of any inoperative or unsightly
vehicle, and any other equipment or item not stored in accordance with this provision.
Vehicles may not be covered by tarps or metal, canvas or plastic enclosures.
1.7. Utilities. All new utilities shall be installed underground. The existing utilities serving
Parcel A may remain overhead until such time as new lines are installed. No fuel tank
shall be maintained above ground unless properly screened from view.
1.8. Antenna or other items placed on roofs. No visible radio or television antenna, satellite
dish, solar panels or other similar type of exterior equipment shall be allowed on any Lot
except a satellite dish antenna twenty-four (24) inches in diameter or less.
1.9. Garbaize and Refuse. No garbage, refuse, rubbish, cuttings, debris, inoperable vehicles,
equipment or waste of any kind shall be deposited on or left upon any Lot unless placed
in an attractive container suitably located and screened from the view of any other Lot
Owner. All equipment for the storage or disposal of such materials shall be kept in a
clean and sanitary condition. Garbage cans may only be placed in public view on the day
of garbage pickup. The proper removal and disposal of all such materials shall be the
sole responsibility of the individual Lot Owners.
1.10. Nuisances. No noxious or undesirable thing, or noxious or undesirable use shall be
permitted or maintained upon any Lot or upon any other portion of the Property.
1.11. Clothes Lines, Other Structures. No clothes lines or other structures of a similar nature
are allowed.
1.12. Livestock and Poulqy. No animals, livestock, poultry or reptiles of any kind shall be
raised, bred or kept on the Property, except that dogs and cats, and other indoor
household pets may be kept provided that they are not kept, bred, or maintained for any
commercial purpose. No individual Lot owner shall keep more than two dogs.
1.13. Signs. No signs of any kind, nor for any uses shall be erected, painted, or displayed on
any building site in this subdivision whatsoever, except: public notice by a political
division of the State or County or as required by law, one professional sign of not more
than one square foot; any builder or the builder's agent may erect and display signs during
the period the builder is building and selling property in the subdivision, and any Lot
Owner or the Lot Owner's agent wishing to sell or rent that Owner's Lot may place a sign
not larger than five square feet on the property itself.
1.14. Exterior Colors and Finishes. Replacement roofing and siding material shall be the same,
as far as possible, in color and style as the original roofing and siding materials on
residences within the development. No vinyl siding is allowed. Building exteriors shall
be painted at least once every ten years with the same color as the existing color unless
both lot owners agree on a new color. Utilization of different exterior materials
including, without limitation, roofing materials, building siding materials and fencing
must be approved by both Lot Owners before installation.
1.15. Invalidation Not Affecting Remaining Provisions. Invalidation of any one of these
covenants by judgment or court order shall in no way affect any of the other provisions
which shall remain in full force and effect.
ARTICLE II
GENERAL PROVISIONS
Section 2. 1. - - Enforcement. The Declarants, their heirs, successors and assigns shall
have the right to enforce all restrictions, conditions, reservations, liens and charges now or
hereafter imposed by the provisions of this declaration by a proceeding at law or equity. Failure
by any owner to enforce any covenant or restriction herein contained shall in no event be deemed
a waiver of the right of a subsequent owner to do so thereafter. The prevailing party in any such
action shall be awarded his reasonable costs and attorney fees.
Section 2.2. Severability. Invalidation of any one or these covenants or restrictions
by judgment or court order shall in no way affect any other provisions which shall remain in full
force and effect.

B. Coons wishes to grant an easements to Parcel B across Parcel A for the benefit
of Parcel B.
NOW, THEREFORE, Coons subjects Parcel A to the following covenants,
easements, restrictions and provisions:
1. Coons declares, grants, establishes and creates an easement as follows:
A nonexclusive five foot easement for the conveyance of utilities under and
across the North five feet of Parcel A described above.
2. Coons declares, grants, establishes and creates an easement as follows:
A nonexclusive ten foot easement for the conveyance of utilities under and across
the South ten feet of Parcel A described above.
3. Coons declares, grants, establishes and creates an easement as follows:
A nonexclusive ten foot easement for the conveyance of sewer lines as
constructed upon Parcel A described above.
4. Coons declares, grants, establishes and creates an easement as follows:
A nonexclusive 2 foot easement for the placement and maintenance of a fence
and lights along the southern boundary and the southeast comer boundary of Parcel A
described above. The owner of Parcel B may place a wood fence in that location and
shall be allowed to maintain the fence as constructed.
5. The easements and covenants herein shall inure to the benefit of the
owners of Parcel B and bind the successors of the owners of Parcel A and shall run with
the land.
6. The owner of Parcel B shall maintain the utilities placed in the above
easements at its own expense and shall have reasonable access to Parcel A for that
purpose. All work performed on behalf of Parcel B upon Parcel A shall be performed in
a careful and workmanlike manner, free of any claims or liens. Upon completion of
construction of the portion of the fence, sewer line or utilities on Parcel A, and upon
completion of any subsequent work performed by on behalf of Parcel B upon Parcel A,

the Owner of Parcel B shall remove all debris and restore the surface of the property as
nearly as possible to the condition which it was at the time of commencement of such
work.
7. This Declaration of Easement is intended to create an easement in favor of
Parcel B. The intent of the grantors is that the easements be created and not merged due
to common ownership of the parcels.
8. This easement shall be effective upon recording.
9. In any dispute or legal proceeding (whether arbitration or court
proceeding) concerning the terms of this easement between the Parcel Owners the
prevailing party shall be awarded reasonable attorney fees and costs in any court or
arbitration proceeding initiated to enforce any provision of this instrument. Venue for
any such action shall be Snohomish County.

TRAFFIC IMPACT ANALYSIS REQUIRiEMENTS
This handout applies to all development activity. "Development activity" means any
construction, expansion, or change in the use of a building or structure that creates additional
demand and need for public facilities. These requirements are to be utilized in developing traffic
impact analysis. This handout outlines the traffic impact analysis requirements based on trip
generation thresholds. All applications for development activity projects which require review
must comply with the requirements outlined in the City of Edmonds Traffic. Impact Analysis
checklist below. Complete the attached Traffic Impact Analysis Worksheet or prepare a traffic
impact analysis report that complies with and addresses the City of Edmonds Traffic Impact
Analysis Checklist. Please note that required traffic impact fees shall be in accordance with
Chapter 18.82 Traffic Impact Fees of the Edmonds Community Development Code (ECDC).
The City shall collect impact fees, based on the rates in ECDC 18.82.120, from any applicant
seeking development approval from the City for any development activity within the City, where
such development activity requires the issuance of a building permit. This shall include, but is
not limited to, the development of residential, commercial, retail, office, and industrial land, and
includes the expansion of existing uses that creates a demand for additional public facilities, as
well as a change in existing use that creates a demand for additional public facilities.
Impact fees shall be assessed based upon the road impact fee rates in affect at the time an
application is deemed complete by the Development Services Department for an ADB design
review approval, conditional use permit, change of use permit, PRD, plat, short plat, remodel
permit or building permit, which ever occurs first for a development project. Impact fees shall be
paid at the time the change of use permit, remodel pen -nit or building permit is issued by the City,
and the pen -nit shall not be issued until the fee is paid.
For a change in use of an existing building or dwelling unit, including any alteration, expansion,
replacement or new accessory building, the impact fee shall be the applicable impact fee for the
land use category of the new use, less any impact fee previously paid for the land use category of
the prior use. If no impact fee was paid for the prior use, the impact fee for the new use shall be
reduced by an amount equal to the current impact fee rate for the prior use.
The assessed impact fee must be paid prior to the issuance of any building pen -nits.
The following are examples of types of projects that do not increase the number of residential
units or commercial or other activity using the roadway system and, therefore, do not create
additional demand on the roadway system. Traffic Impact Fees cannot be required as a condition
of development approval for these types of projects. (See ECDC 18.82.040, Exemptions.) These
types of projects do not require completion of the Traffic Impact Analysis Work Sheet or Traffic
Impact Analysis Report.

• A project that involves demolition of one single family residential unit and replacing it with
one new single family residential unit on the same lot.
• A residential remodel that does not increase the number of residential units.
• A residential addition (e.g., garage, etc.) that does not increase the number of residential
units.
• Decks, fences, retaining walls, etc.
• Accessory dwelling unit (ADU). (Per ECDC 20.21.020 and 21.30.010, approval of ADU
still limits the total number of individuals living at the property to one "family" as defined
in the code.)
The following are examples of types of projects that do increase the number of residential units
of commercial or other activity using the roadway system and, therefore, do create additional
demand on the roadway system. Traffic Impact Fees can (and will) be required as a condition of
development approval for these types of projects.
• Subdividing or short platting a property that had one house on it and converting it into two
or more residential lots.
• Construction of a project -on a previously undeveloped lot.
• Demolition of a single family residence and construction of commercial, mixed -use, duplex,
multi -family, etc. on the same property.

1. Alteration of an existing nonresidential structure that does. not expand the usable space or
add any residential units.
2. Miscellaneous improvements that do not expand usable space or add any residential units,
including, but not limited to, fences, walls, swirriming pools, and signs.
3. Demolition or moving of a structure.

4. Expansion of an existing structure that results in the addition of one hundred (100) square
feet or less of gross floor area.
5. Replacement of a structure with a new structure of the same size and use at the same site or
lot when such replacement occurs within twelve (12) months of the demolition *or

destruction of the prior structure. Replacement of a structure with a new structure of the
same size shall be interpreted to include any structure for which the gross square footage of
the building will not be increased by more than one hundred (100) square feet.
6. Alterations, expansions, enlargement, remodeling, rehabilitation or conversion of an
existing dwelling unit where no additional dwelling units are created and the use is not
changed [Accessory dwelling units (ADU) are not considered to create additional dwelling
units because Section 20.21.020, Community Development Code, does not consider ADUs
as increasing the overall density of a single-family residential neighborhood, and because
the City's traffic model does not assign additional trips to the network as a result of ADUs.]
7. Any ADB design review approval, conditional use pemiit, change of use permit, PRD, plat,
short plat, remodel permit and building permit application that has been submitted to the
City before 4:00 p.m. the business day before the effective date of ECDC Chapter 18.82 and
subsequently determined to be a complete application, based on the information on file as of
the effective date of ECDC Chapterl 8.82.
B. The Director shall be authorized to determine whether a particula ' r development activity
falls within an exemption identified in ECDC Section 18.82.040, in any other Section, or under
other applicable law. Determinations of the Director shall be in writing and shall be subject to
the appeals procedures set forth in -Section 18.82.070.
