C. Introduction: The existing mini -market at 22324 Highway 99 is changing its gas
supplier to Exxon, and thus is applying for new signage and a new canopy to match
the Exxon corporate colors and logos. In this case the applicant is applying to
install a new gas pump island canopy with the Exxon Colors and Signs, and to
replace the existing freestanding sign.
It should be noted that the Exxon signs proposed for the sign canopy are over
height and require a variance. Based on past discussions with the Board, this item
is placed on the Board's agenda for final approval with the condition that the
applicant obtain a variance for the proposed canopy sign height. In this case the
applicant has applied for variance, and a hearing is scheduled before the Hearing
Examiner on April 18, 1995.
D. Staff Analysis, Pump Island Canopy:
1. Material: The applicant is proposing to replace the existing facade
with a powder coated aluminum surface. In addition, each end will have a
ten foot length which is illuminated. The surface of the illuminated section
will be vinyl covered and will be flush with the aluminum facade.
2. Lighting: A 10 foot section at each end of the canopy containing the
proposed Exxon sign is to be illuminated as is the spanner portion
containing the sign in between the pumps.
3. Colors: The applicant is proposing to change the face of the canopy
to red. The word "Exxon" is to be white.
4. Sign Location: The applicant has proposed Exxon signs on the north
and south ends of the proposed canopy as well as on the illuminated
spanner portion facing west between the pumps.

F. Staff Analysis, Freestanding Sign:
1. Material: The applicant has proposed an acrylic faced internally lit
freestanding sign.
2. Lighting: The proposed freestanding sign is internally lit.
3. Colors: The proposed sign has large red letters on a white
background at the top. Below that section, the sign has white letters on a
blue background. Beneath that section is a reader board with black letters
on a white background.
4. Sign Location: The sign is proposed in a landscaping bed at the
- intersection of 224th Street Southwest and Highway 99.
S. Landscaping: The Community Development Code requires an area
of landscaping twice the size of the square footage of the proposed sign. In
this case the applicant is proposing to place the sign in a landscape bed
which meets the minimum standards.

Note: The Community Development Code requires that the Board
find that a freestanding sign is the only reasonable alternative
for the identification needs of the building.
7. Design Guidelines: The applicant has proposed a sign with a reader
Board. In the past, the ADB has consistently expressed concern with
reader -boards as they have been found to add to sign clutter, have excessive
brightens, and in some cases, do not follow with the theme of the
development.
E. Summary In order to approve this application, the Board must find that the
proposal is consistent with the Design Policies found in the Comprehensive Plan
and the requirements found in the Zoning Ordinance.

Plaza Room, Edmonds Library, Edmonds, Washington, and closed at 10:05 a.m. Participants at
the public hearing and the exhibits offered and entered are listed in this report. A verbatim

HEARING COMMENTS:
Tie following is a summary of the comments offered at the public hearing.
From the City:
Kirk Vinish, Project Planner, presented that staff report noting that other gas stations have
also been granted variances for sip height in their facias. He confkmed that the
Architectural Design Board had recommended approval and that the zoning was General
Commercial.
From the Applicant
John Sandhopp, representing the applicant, indicated the need for the additional height due
to the height of the existing canopy. He also noted that the Architectural Design Board
had recommended approval.

L FINDINGS OF FACT AND CONCLUSIONS
A. Site Description
1. Site Development and Zoning:
a) Facts:
(1) Size: The subject property is approximately 16,988 square feet in area and located
at 22324 Highway 99. The proposed sips would be located on the east and south
sides of the fascia (see Exhibit A, Attachment 4).
(2) Zoning% The zoning of the subject property is General Commercial (CG-2).
(3) Terrain and Vegetation: The subject property is flat. Vegetation is very limited
and consists of ornamental landscaping (see Exhibit A, Attachment 4).
2. Neighboring Development and Zoning:
a) Facts:
(1) North: Developed with commercial business, and zoned CG-2.
(2) South: Developed with a commercial business, and zoned CG-2.
(3) East: Developed with a commercial business, and zoned CG-2.
(4) West: Developed with a commercial business, and zoned CG-2.
b) Conclusion: The proposed development would be consistent with the surrounding
zoning and development.

Texaco stations located at 220th Street Southwest and Highway 99 and at 660
Edmonds Way).
C. Edmonds Community Development Code (ECDC) Compliance
1. Compliance with CG-2 Zoning Standards
a) Facts:
(1) The fundamental site development standards in a CG-2 zone are set forth in
Chapter 16.60.020.
(2) The existing development conforms to all CG-2 requirements.
(3) ECDC Chapter 20.60 states the standards by which signs may be developed,
including sign area and sign height. The standard from which the applicant is
requesting relief is, "Attached signs shall not exceed 14feet in height".
(4) All other requirements of ECDC Chapter 20.60 must be complied with including
sign area. The drawings submitted with this sip height variance show that the
applicant will be complying with all other requirements of ECDC Chapter 20.60.
b) Conclusion: As conditioned the proposal complies with the development standards for
CG-2 zones as set forth in Chapter 16.20 except the standard for which the applicant
is seeldng a variance.
2. Compliance with requirement for a variance
ECDC Chapter 20.85 (Variances) states an applicant may request a variance from the
standards of this Chapter pursuant to the procedures set forth in ECDC Chapter 20.85.
Chapter 20.85 of the ECDC also sets forth the mechanism whereby a provision of the
Code may be varied on a case -by -case basis if the application of the provision would result
in an unusual and unreasonable hardship (see Exhibit A, Attachment 2).
a) Facts:
(1) ECDC Section 20.85.010 establishes the decisional criteria with which a variance
request must comply in order to be granted by the Hearing Examiner. These
criteria include: a special circumstance must exist; no special privilege is granted;
the proposal is consistent with the Comprehensive Plan and the Zoning Code; the
proposal will not be detrimental and is the minimum necessary.
(2) Variances may be used to modify bulk standards. They may not be used to modify
use or procedural requirements.
b) Conclusions:
(1) Special Circumstances
Special Circumstances include the size, shape, topography, location or
surroundings of the property and public necessity for public structures.
Although typical Special Circumstances relating to topography, size and
orientation of the lot do not appear to exist in this case, Special Circumstances do
apply in that the height of the canopy is dictated by the clearance height necessary
for vehicles, and the most reasonable location of the sips on the canopy (see
Exhibit A, Attachment 2).
(2) Special Privilege
It does not appear that any special privilege will be demonstrated in granting this
variance in that the Texaco convenience store on 220th Street Southwest and
ffighway 99 and at 660 Edmonds Way, have both been granted variances for their
signs. Therefore, other properties in zones anticipating less intense commercial
development (i.e. BN zone) with similu circumstances have also been granted
variances for sip height (see Exhibit A, Attachment 2).
(3) Zoning Code and the Comprehensive Plan
Approval of the proposed variance would allow for the continued development of
the site in a manner consistent with the intent of the Zoning Code and the
Comprehensive Plan designation of the site (see Exhibit A, Attachment 2).
(4) Not detrimental
Approval of the variance would not be detrimental to the public health, safety or
welfare (see Exhibit A, Attachment 2).
(5) Minimum Required
The request is the minimum necessary for reasonable development of the subject
property (see Exhibit A, Attachments 2 and 4). The variance would allow the
applicant to enjoy the ability of most property owners to have reasonable access
to their property.
As conditioned, the requested variance would be consistent with the review criteria
for a variance.

U. DECISION
Based upon the foregoing findings and conclusions, the application for a variance is approved,
subject to the following conditions.
1. This variance is to allow the proposal in the location identified on the, proposed site plan
would have to
(see Exhibit A, Attachment 4). Any other structures, additions or remodels
conform with the typical setbacks or height requirements for the zone or obtain another
variance.
2. This application is subject to the applicable requirements contained in the Edmonds
Community Development Code. It is the responsibility of the applicant to ensure
compliance with the various provisions contained in these ordinances.

A. REQUEST FOR RECONSIDERATION:
Section 20.100.010.G allows for the Hearing Examitier to reconsider his decision or pl:

feet to 16-feet to allow the installation of a canopy fascia mounted signs for an existing gas
station (see Attachment 1).
4. ReviewPr-ocess: Variance; Hearing Examiner conducts public hearing and makes final
decision.
5. Miljor Issues:
a. Compliance with Edmonds Community Development Code (ECDC) Section
20.60.020.D (SIGN HEIGHT).
b. Compliance with Edmonds Community Development Code (ECDC) Chapter 20.85
(VARIANCES).
B. Recommendations
Based on statements of Fact, Conclusions, and Attachments in this report we recommend
Approval of this application subject to the following conditions:
I . This variance is to allow the proposal in the location identified on the proposed site plan (see
Attachment 4). Any other structures, additions or remodels would have to conform with the
typical setbacks or height requirements for the zone or obtain another variance.
2. This application is subject to the applicable requirements contained in the Edmonds
Community Development Code. It is the responsibility of the applicant to ensure compliance
with the various provisions contained in these ordinances.
3. The applicant must obtain a building permit prior to construction.
4. The permit should be transferable.
H. FINDINGS OF FACT AND CONCLUSIONS
A. Site Description
1. Site Development And Zoning:
a)
(1) Size: The subject property is approximately 30,000 square feet in area and located at
8406 Bowdoin Way. The proposed signs would be located on the east and south -
sides of the fascia (see Attachment 4).
(2) Zoning: The zoning of the subject property is Neighborhood Business (BN).
(3) Terrain and Ventation: The subject property is flat. Vegetation is very limited
and consists of ornamental landscaping (see Attachment 4).
2. Neighboring Development And Zoning:

(1) Noilh: Developed with commercial business, and zoned BN.

(4) All other requirements of ECDC Chapter 20.6U must be complied with mciuomg
sign area. The drawings submitted with this sign height variance show that the
applicant will be complying with all other requirements of ECDC Chapter 20.60.
b) Conclusion: As conditioned the proposal complies with the development standards for
BN zones as set forth in Chapter 16.20 except the standard for which the applicant is
seeking a variance.
2. Compliance with requirement for a.Variance
ECDC Chapter 20.85 (Variances) states an applicant may request a variance from the
standards of this Chapter pursuant to the procedures set forth in ECDC Chapter 20.85.,
Chapter 20.85 of the ECDC also sets forth the mechanism whereby a provision of the Code
may be varied on a case -by -case basis if the application of the provision would result in an
unusual and unreasonable hardship (see Attachment 2).

b) Conclusions:
(1) Special Circumstances
Special circumstances include the size shape, topography, location or surroundings
of the property and public necessity for public structures.
Although typical Special Circumstances relating to topography, size and orientation
of the lot do not appear to exist in this case, Special Circumstances do apply in that
the height of the canopy is dictated by the clearance height necessary for vehicles,
and the most reasonable location of the signs on the canopy (see Attachment 2).
(2) Special Privilegc
it does not appear that any special privilege will be demonstrated in granting this
variance in that the Texaco convenience store on 220th Street Southwest and
Highway 99 and at 660 Edmonds Way, have both been granted variances for their
signs. Therefore, other properties in the same zone with similar circumstances have
also been granted variances for sign height (see Attachment 2).

(3) Zoning Code and the ComprehensW
Approval of the proposed variance would allow for the continued development of
the site in a manner consistent with the intent of the Zoning Code and the
Comprehensive Plan designation of the site (see Attachment 2).
(4) Not Detrimental
Approval of the variance would not be detrimental to the public health, safety or
welfare (see Attachment 2).
(5) Minimum Required
The request is the minimum necessary for reasonable development of the subject
property (see Attachments 2 and 4). The variance would allow the applicant to
enjoy the ability of most property owners to have reasonable access to their property.
(6) As conditioned, the requested variance would be consistent with the review criteria
for a variance.

expiration date.'
