Since it my intention to work with the City of Edmonds to resolve the problem, I would like to take a combination approach to the options you have given. At present 30 units are occupied by seniors citizens who are privately paying their rents. With this being the case, I feel it best to begin the removal of the 10 additional units, while at the time working with the hearing examiner inorder to define exactly what we are. I feel that Avalon Inn's reason for being falls somewhere in between the conventional classification of senior care housing. For Example: 1. Avalon was built without cooking appliances in the units - some would say this does not make it a retirement residence. 2. Avalon's residents sign a contract deliniating that Avalon cannot be responsible for any medical care and at what point in the aging process that they will have to move - therefore it can not be considered a convalescent or nursing home. 3 Avalon fills a valuable need in the middle. It caters to seniors who's physical abilites enable them to live alone, but 1. don't want to shop cook clean 2. need interaction with others - thus avoiding the depression common to the elderly who live alone. 3. desire the peace of mind that comes with 24 hour 365 day staffing. Our residents range in age from 64-104. All of whom can dress themselves and have the mobility to get themselves to the dining room, all but two do their oun landry. Only four have drivers licenses, and only two have their own car. We encourage the use of DART , and our policy is to have families responsible for transportation to and from doctors. AIM Avalon Inn is similar to the concept of assisted living, but because it will not be involved with anything resembling supervised personal care, it is not required to be licensed by DSHS. As a point of information only, my subsequent research shows: 1. The structure was constructed in 1987 with 48 bedrooms and 48 bathrooms with 36 unit entry doors. The only difference was the addition of 10 entry doors. And prior to the existence of DSHS there were up to 55 residents at any one time, and up to four residents sharing one unit. 2. 1 was also able to discover that only one of the added entry doors was added after the annexation in 1997, and that the dividing walls are semi -permanent in design. I am hopeful that you can see that Avalon Inn fulfills a need for the elderly, who are living longer because of modern medicine, who are able and desirous to remain independent while not living alone. This letter (a Type I decision) is in response to the four questions submitted regarding the above mentioned property. 1. Can Avalon Inn resume use as a "retirement home" under the EMC without the requirement of any building or site modification? With respect to site modification, it is understood that the site was developed with a reti�ement home in Snohomish County in 1986 which was subsequently annexed by the City of Edmonds on December 15, 1997. Up until approximately one year ago, the site was used as a retirement home but that use, and all other uses at the site, ceased at that time. The subject site is zoned Multifamily Residential, RM-1.5. According to ECDC 16.30.010.A.3, I retirement home' is a permitted primary use in the RM-1.5 zone. According to ECDC 16.30.010.B.4.a, 'private parking' is also a permitted secondary use in the RM-1.5 zone. Since the uses are allowed by -right and not nonconforming, they may be re-established and do not fall under the nonconforming use requirements of ECDC 17.40.010. B. Existing Uses or Structures Not Including the Downtown Business Area. 1. Existing uses'orstructures shall not be required to comply with the requirements of this chapter except under subsection (B)(2) or (8)(3) of this section, if they have off- street parking which complied with applicable regulations at the time the use began or the structure was occupied. Thus, assuming that the number of parking stalls presently at the site were those originally permitted by the County when the building was constructed in 1986, those stalls may continue and no additional stalls are required. That said, in 2004 a building violation was noted, illegal construction removed, and the building restored back to 36 units (BLD-2004-0788). At that time, a total of 36 parking stalls were approved as shown on the enclosed site plan. While the cover letter indicated that 35 parking stalls are located on the site, 36 spaces are required to be located on the site if the 'retirement home' use is to be re-established at the site. Any change to the number of residential units would trigger re-evaluation of the parking requirements. It is not known if other site development standards currently meet code requirements or not. With respect to building modification, a compliance inspection would be required prior to occupancy which would include testing the sprinklers, the fire alarm sy ' stem, and the like. Only after inspection would it be known if any building repairs or updates are needed. 2. What uses are included in the definition of "retirement home" under the EIVIC, a`nd how are these uses distinguished from the City's interpretation of "convalescent homes, rest homes, sanitariums"? Please provide specific examples of both uses. According to ECDC 21.85.050, a "retirement home means a place of residencefor severalfamilies or individuals in apartment -like quarters, which mayfeature services such as limited n�rsing facilities, minimum maintenance living accommodations, and recreation programs andfacilities." The term 11congregate care facility" was given the same definition as "retirement home" in 1991. The code does not contain clefinitionsfor the other specific terms mentioned. Webster's Dictionary provides the following definitions: Convalescent home — an institution for the care of convalescing patients Rest home — an establishment that provides housing an d general care for the aged or the convalescent Sanitariums (sanatorium) — an establishment that provides therapy combined with a regimen (as of diet or exercise) for treatment or rehabilitation; an. institution for rest and recuperation (as of convalescents) Because this is a request for zoning compliance and not a request for code interpretation, no interpretation of "convalescent homes, rest homes, sanitariums" is provided. Generally speaking, however, the 'retirement home' use has differed from the 'convalescent homes, rest homes, sanitariums' use in that the latter indicates a higher degree of patient care and services required. Residents in a 'retirement home', on the other hand, would largely be able to care for themselves and come and go as they chose. Given the greater need for services and more intense patient care, the 'convalescent homes, rest homes, sanitariums' are treated similar to a hospital use and thus require a conditional use permit according to ECDC 16.30.010.0 3. Based on Avalon Inn's current parking lot, which includes 35 off-street parking stalls, can Avalon inn resume use as a "retirement home" without installinfz additional parking stalls? No, the site plan for BLD-2004-0788 was approved in 2004 showing 36 parking spaces. The 'retirement home' use may only be re-established with the 36 parking stalls as approved in 2004, not the 35 stalls referenced in the cover letter. 4. Can Avalon Inn be used as a "group home for the disabled" or "state -licensed group home for foster care of minors" under the EMC without requiring any building, site, or parking lot modifications? Similar building and life safety inspections would apply as in #1. Also as in #1jt is unknown about the need for other site modifications. With respect to parking and a change of use at the site, however, the off-street parking requirements in ECDC 17.50.010.13 are applicable: B. Existing Uses or Structures Not Including the Downtown Business Area. 1. Existing uses or structures shall not be required to comply with the requirements of this chapter except under subsection (B)(2) or (B)(3) of this section, if they have off- street parking which complied with applicable regulations at the time the use began or the structure was occupied. 2. if a change of use takes place, or an addition is built, which increases the number of off-street parking spaces normally required by this chapter by more than 10 percent but less than 100 percent, the number of additional off-street parking spaces required by this chapterfor the new use or addition shall be required to be provided in addition to the number of spaces previously existing. In no case shall the total requirement exceed that required by this chapter. 3. If a change of use takes place, or an addition is built, which increases the number of off-street parking spaces normally required by this chapter by 100 percent or more, the full number of spaces required by this chapterfor the new use or the entire altered building shall be provided. Since the use of the residential structure would be changing from one primary permitted use to another — a 'retirement home' to a 'group home' or'foster home' per ECDC 16.30.010.A.4, ECDC 17.50.010.13.2 or B.3 apply. Historically, the City has applied the parking requirements of ECDC 17.50.020.A.3 ( one space per three beds) to these types of residential social welfare facilities. On April 14, 2011, 1 met with Associate Planner Michael Clugston to discuss the history of permitting and use of Avalon Inn as a retirement home. We are now submitting this request for confirmation that Avalon Inn may resume use, as -built and under its existing site configuration, as a "retirement home," pursuant to definition under the Edmonds Municipal Code ("EMC"). Additionally, we are requesting confirmation that Avalon Inn may be converted for use as a "group home," as specified under the EMC. Edmonds Woodway L.L.C. is currently marketing Avalon Inn for sale and intends to share the requested Zoning Confirmation Letter with potential purchasers of the property. Avalon Inn is located on approximately 1.21 acres in the City of Edmonds' Residential Multifamily zone, or RM-1.5. Avalon Inn consists of a 36-unit, thiee-story residential structure that was used as either an assisted livin2 facility or independent living housing between 1987 and 2009. Currently, the facility is vacant. The 336 units include 6 studios, 18 one -bedroom units, and 12 two -bedroom units. The parking lot adjacent to Avalon Inn includes 35 surface stalls. The structure was permitted in 1986 as a retirement home and constructed in 1987 under Snohomish County's jurisdiction. The City of Edmonds annexed the property on December 15, 1997. First Question: 1. Can Avalon Inn resume use as a "retirement home" under the ENIC without the requirement of any building or site modification? t� Under EMC 163 0. 0 1 O.A., permitted uses in the RM- 1. 5 zone include "retirement homes." According to EMC 21.85.050: City of Edmonds -2- April 25, 2011 Retirement home means a place of residence for several families or individuals in apartment -like quarters, which may feature services such as limited nursing facilities, minimum maintenance living accommodations, and recreation programs and facilities. Avalon Inn appears to meet this definition.- Avalon Inn is a residential structure that includes the following apartment -like quarters: 6 studios (each approximately 288 square feet), 18 one-bedro om/one -bath units (each approximately 575 square feet), and 12 two -bedroom/ 1 1/4- bath units (each approximately 840 square feet). Each unit includes basic kitchen facilities, including a sink, refrigerator, and cotintertop microwave. Avalon Inn also has a central kitchen facility and a communal dining/recreation space. Second Question: 2. What uses are included in the definition of a "retirement home" under the EMC, and how are these uses distinguished from the City's interpretation of 64convalescent homes, rest homes, sanitariums"? Please provide. specific examples of both uses. Under EMC 16.30.010.B., uses in the RM-1.5 zone requiring a conditional use permit include "hospitals, convalescent homes, rest homes, sanitariums." The EMC defines "hospital.," however it does not define "convalescent homes," "rest homes," or "sanitariums." EMC distinguishes convalescent homes, rest homes, or sanitariums from retirement homes in the RM- 1.5 zone, by conditioning the former three uses while outright permitting the latter use. In order to assist potential purchasers in assessing permissible uses of Avalon Inn as a "retirement home," we would like clarification as to how a retirement home differs from convalescent homes, rest homes, sanitariums.. Under the EMC definition, retirement home implies an assisted living facility of sorts, where residents independently reside in their own apartment but may rely on the facility for some meals or limited medical assistance. In contrast, convalescent home, rest home, sanitarium perhaps implies a nursing home facility, where residents share sleeping accommodations with other residents who are not considered family and depend on facility staff for all basic needs (e.g., access to food,-�bathing, daily medical needs). Third Question: 3. Based on Avalon Inn's current parking lot, which includes 35 off-street parking stalls, can Avalon Inn resume use as a "retirement home" without installing additional parking stalls? The parking lot for Avalon Inn does not meet current parking space requirements set forth in EMC 17.50.020. Avalon Inn consists of 36 units and has 35 parking stalls, resulting in a parking stall to unit ratio that is slightly less than 1: 1. City of Edmonds -3 - April 25, 2011 We believe that Avalon Inn, along with its associated parking lot, meets the definition of a nonconforming building and/or structure under Chapter 17.40 EMC. Accordingly, we are, requesting confirmation that Avalon Inn may be continued as -developed, so long as any future use of Avalon Inn meets the definition of a retirement home under the EMC. EMC 17.40.020.A. defines nonconforming building and/or structures as follows: A nonconforming building is one which once met bulk zoning standards and the site development standards applicable to its construction, but which no longer conforms to such standards due to the enactment or amendment of the zoning ordinance of the city of Edmonds or the application of such ordinance in the case of a structure annexed to the city. Avalon Inn meets this de finition. Avalon Inn was originally developed and permitted under the jurisdiction of Snohomish County in 1987. At the time, Avalon Inn met site development standards applicable to its construction. Avalon Inn no longer conforms to current parking standards under the EMC, due to annexation by the City of Edmonds in 1997. The fact that Avalon Inn has been vacant for approximately a year does not change this conclusion. Under the EMC, nonconforming buildings and their associated parking lots may be continued regardless of whether the building remains in use. Pursuant to EMC 17.40.020.B., "a nonconforming building or structure may be maintained or continued, unless required to be abated elsewhere in this chapter And under EMC 17.50.01 OR I., existing structures or uses "shall not be required to comply with the requirements of this chapter ... if they have off-street parking which complied with applicable regulations at the time the use began or the structure was occupied." EMC 17.50.010.13.2 further states that an increase in parking spaces may be required "if a change of use takes place, or an addition is built, which increase the number of off- street parking spaces normally required by this chapter." However, there is no requirement that the number of parking spaces be increased to current parking standards in the event of a lapse in use or occupancy. Accordingly, Avalon Inn's current vacancy should not impact a future owner who wishes to resume use of the facility as a retirement home, as it has previously been used. T he "Lapse of Time" provision located in EMC 17.40.010.C. applies only to "nonconforming uses," and not to "nonconforming buildings" such as Avalon Inn. A full commercial kitchen and dining room are currently available with proposed remodeling of the kitchen to remove the commercial stoves and add 3-4 conventional residential style stoves to promote more of home atmosphere to encourage residents to prepare their meals independently and together as a community. The program design promotes individual living quarters with communal common space that encourages residents to engage with others to prepare meals, socialize in the common living areas and attend groups, classes and meetings together as they work towards the common goal of achieving a higher level of self-sufficiency. It is a structured program where residents are required to share the duties of maintaining the cleanliness of the facility and participate in comply will all house/program rules. No over night guests or visitors will be allowed without advance written approval and planning and will be on a limited basis if at all. This community would have a transitional residential recovery atmosphere with defined structure and rules including monitoring for relapse with onsitc urinalysis and breath testing, maximum length of stay at 24 months, onsite case management, resident meetings and groups, occasional community meals and events, AA/NA and other twelve - step recovery meetings available onsite, direct referrals for employment(PHS has employment and vocational specialists that would assist residents), assistance with resolving any past or current legal/court issues, GED/educational referrals, connecting with financial services including GAU/GAX, TANF, SSI/SSDI, Veterans' benefits, etc. to move the client to greater independence and self-sufficiency. This would mirror many of Pioneers current residential recovery programs. Client incomes would come from the variety of aforementioned sources and. additionally with a partnership with Snohomish County in the form of a voucher program provided for those with chemical dependency and/or mental health issues an would provide up to six months of rent for each individual. All residents' income will be at or below 50% of median income in accordance with Washington State Housing Finance Commission Guidelines for Snohomish County. However, most residents will have incomes at 30% of median income or less. Much less! The site is on a major public transit bus line that connects to many of the primary routs and the WA State ferry system. Site parking is more than adequate for staff and residents in its current state as many of our residents will be utilizing public transit clue their inability to afford a vehicle and insurance, many will also lack a valid drivers license/insurance (vehicles must have a current license and possess insurance to be oil PHS properties) and general data from our other programs predominantly indicates a lack of personal vehicles altogether (roughly I O'Vo have personal transportation). Staffing will consist of one resident manager who will live on site, and we also hope to have one staff person stationed at the front door to monitor residents who are corning an(] going from the house at all times.
