STAFF FINDINGS AND CONCLUSIONS:
A. Description of Subject Property and Surrounding Area
The applicant is seeking a conditional use permit to allow
the existing grocery store, located on the.northwest corner
of SR104 and 100th Ave. W., to remain open 24 hours daily.
The store is being remodeled as part of ongoing transforma-
tion of that street corner. New retail shops have recently
been built to the north of the store.
Surrounding development is all commercially oriented. No
other business in the immediate vicinity is open all night.

DECISION: The conditional use permit is granted
subject to the conditions listed. -Cft
INTRODUCTION
Olson's Food Store, 22828 100th Avenue West, Edmonds, Washington,
98020, and hereinafter referred to as Applicant, has requested
approval of a conditional use permit for the purpose.of allowing
a grocery store to remain open 24 hours a day. The grocery store
in question is located at 22b28 100th Avenue West, Edmonds,
Washington, 98020, and more particularly described as set forth
in Exhibit 3,which is attached hereto and by this reference is
hereby incorporated as part of these findings.
A hearing on the request was held before the Hearing Examiner of
the City of Edmonds on April 5, 1984.
At the public hearing the following presented testimony:

After due consideration of the evidence presented by the Applicant;
evidence elicited during the public hearing; and, as a result of
the personal inspection of the subject property and surrounding
areas by the Hearing Examiner, the following findings of fact
and conclusions constitute the basis of the decision of the
Hearing Examiner.
FINDINGS OF FACT
1. The application is for the approval of a conditional use permit
for the purpose of allowing a grocery store to remain open 24
hours per day. The grocery store is located at 22828 100th
Avenue West, Edmonds, Washington, and is more particularly
described as set forth on Exhibit 3 attached hereto.

2. The property is located at the northwest corner of SR 104
and 100th Avenue West. This is one of the major intersections.
in the City of Edmonds and the streets carry a significant
amount of traffic.
3. The store that is located on the subject property is being
remodelled as part of an ongoing transformation of the
corner of SR 104 and 100th Avenue West. In addition to the
remodelling of the subject property, other retail stores
have been built in the area.
4. The development of the subject property and the surrounding
properties has been commercially oriented.
5. In order for a conditional use permit to be granted in the
City of Edmonds the criteria as set forth in Chapter 20.05
of the Edmonds Community Development Code must be met. These
criteria include:

a. The proposed use must be consistent with the Comprehen-
sive Plan of the City of Edmonds;
b. The proposed use in its location must be consistent with
the purposes of the zoning ordinance in which the pro-
perty is located; and,
C. The proposed use must not be significantly detrimental
to the public health, safety or welfare, nor injurious
to nearby private properties or improvements.
The subject property is zoned Neighborhood Business (BN).
The adjoining properties are also zoned BN.
It is the intent of the Applicant to design the lighting on
the site in a manner that will orient all light away from
nearby single family residences and concentrate it on the
store and the parking lot. This activity has been completed
and has been successful.
8. Because of the location of the store at the intersection
there is easy access into and out of the parking lot.
9. Section 16-45.010(C) of the. Edmonds Community Development
Code requires that all businesses open to the public between
the hours of 11 p.m. and 6 a.m. must acquire a conditional
use permit.
10. The Planning Department of the City of Edmonds has recommended
approval of the conditional use permit subject to the require-
ment that the permit not be * transferable and that it be reviewed
in six months for any adverse impacts.

11. The Applicant testified to be in support of the recommendation
of the Planning Department. In addition, the Applicant testi-
fied that the lighting as described is effective and does not
adversely impact the single-family residential areas.
12.- The Applicant's representative,testified that heS store is
owned by the Olson's Food Store chain that have operated on
a 24-hour basis and this has created no adverse impacts to
the neighborhoods where this is done.
13. No adverse testimony was received at the public hearing.
CONCLUSIONS
1. The application is for the approval of a conditional use
permit to allow a grocery store to remain open 24 hours
daily at 22828 100th Avenue West, Edmonds, Washington, and
more particularly described in Exhibit 3 attached hereto.
2. The criteria as set forth in Chapter 20.05 of the Edmonds
Community Development Code have been met by the application.
3. The proposed opening of the subject property for 24 hours
does not conflict with the zoning designation of BN. All
the immediate properties are commerciallydeveloped and the
subject property is located at a busy intersection warranting
significant commercial activity.
4. The proposed use will not be in conflict with the Comprehen-
sive Plan of the City of Edmonds. The use will not create
significant problems with transportation on the streets and
highways of the City and will not be detrimental to the land
use as proposed in the Comprehensive Plan of the City of
Edmonds.
5. Although the 24-hour operation will result in lights being
used on the site, the lighting will not adversely impact
the adjoining property or the property owners.
6. The conditional use permit should not be transferable.
7. The Planning Department of the City of Edmonds has recommended
approval of the conditional use permit subject to the con-
ditions listed.
DECISION
Based -on the preceding findings of fact and conclusions; the testi-
mony and evidence submitted at the public hearing; and, upon the
impressions of the Hearing Examiner on a site view, it is hereby
ordered that the requested conditional use permit be granted. The
specific request is for the operation of the Olson's Food Store
at 22828 100th Avenue West, Edmonds, Washington, to remain open
for 24 hours per day, and is granted subject to the following'
conditions:

1 The permit is not transferable.
2. A review is to be held in six months by the Planning Depart-'
ment of the City of Edmonds to determine if there are any
adverse impacts as a result of the 24-hour operation. If.,
in the opinion of the Planning Department, there are impacts.,
the matter is to be reviewed by the Hearing Examiner.
