Design Review Process
As part of the City's review of the building permit referenced above, staff design review was required per
ECDC 20. 10. Because the building is located in the General Commercial "CG" zone, the design
standards in ECDC 20.11.030 apply in addition to those in ECDC 16.60.030 and the general criteria
found in the Comprehensive Plan.
Design review for a remodel is considered a Type I decision subject to the requirements of ECDC
20.01.003.
Findings & Conclusions
Scope. The existing metal
canopy (see inset) will be
removed and new fabric
awnings will be installed over
storefronts along with a new
cornice at the parapet. Stone
and brick veneers will be
added and the fagade will be
painted per the associated
rendering. Decorative sconce
lighting will be added adjacent
to all storefronts. Signage will
be under a separate permit but
will most likely be installed
above individual store
entrances.

2. Environment. The project was determined to be exempt from the State Environmental Policy Act
(SEPA) under WAC 197-11-800(3). The project was also determined to be exempt from critical
areas studies, because the proposed exterior updates are within the "developed footprint" of the site
pursuant to ECDC 23.40.220.C.3.
3. Design. The proposed updates will provide a new 'face' to the existing building. The proposed
colors are neutral and work with the fabric awnings to call out individual storefronts. The stone
wainscoting and brick veneer as well as the dark gray metal cornice will provide additional detail for
the fagade. ECDC 20.11.030 contains general design criteria for proposals going through the
"general" design review process. Elements of building design include encouraging colors that avoid
excess brilliance (20.11.030.A.2) and the use of multiple materials (20.11.030.A.4.a.v).
4. Zoning. ECDC 16.60.030 requires the Architectural Design Board (ADB) to review projects
exceeding 60 feet in height. While there is an approximately I foot addition to the height of the
building by including the new cornice work, the building is still well under 60 feet in height. There
are no other changes to the building's bulk, so the site development standards are satisfied.
The CG zone contains design standards that support this proposal, specifically encouraging variation
in types of building materials and/or elements (1 6.60.030.C. Lf) and entries shall have lighting for
safety and visibility integrated with the building/canopy (16.30.030.C.3.d). The proposal is helping
bring the existing building more in line with the design standards set forth in the zoning code.
With respect to signage, the building owner is encouraged to carefully review the sign code (ECDC
20.60) and consider applying to the ADB for a sign package which could maximize the amount of
signage available for the individual tenants while creating a unified design theme that compliments
the updated fa�ade.
5. Comprehensive Plan. The site is designated "Highway 99 Corridor" and is within the International
District focus area. The proposed remodel shows an effort towards the following Comprehensive
Plan goals:
• B.4. New development should be high -quality and varied — not generic — and include amenities
forpedestrians andpatrons.
• B. 6. New development should be allowed and encouraged to develop to thefullest extent
possible while assuring that the design quality and amenities provided contribute to the overall
character and quality of the corridor.
• B.9. Upgrade the architectural and landscape design qualities of the corridor. Establish
uniform signage regulationsfor allproperties within the corridor area which providefor
business visibility and commerce while minimizing clutter and distraction to the public.
This project will result in a more attractive building through the use of more interesting and varied
building materials while integrating pedestrian amenities like weather protection and lighting.
Decision i
Staff finds that the proposal is consistent with design criteria in the Comprehensive Plan as well as the
zoning ordinance, specifically ECDC 20.11.030, 16.60.020, and 16.60.030. Therefore, staff finds that the
design of the building remodel in permit BLD-2009-0627 is APPROVED.

Dear Mr. Holland,
I am writing with regards to the water/sewer bill referenced above
in the amount of $1,203.65.
For your information, Brentwood Associates started managing
Brentwood Plaza and paying its bills on October 1, 1994. The
previous management company, Real Property Associates, forwarded
the referenced billing to us approximately October 13, 1994. The
amount owed seemed high so I did a quick review of our 1993/1994
usage and payment history and discovered this bill was more than 3
times the normal (see attached). I immediately called the number
shown on the bill to question the unusually high amount of the
bill. I was told it most likely indicated there was a leak and
that we should have a plumber inspect the property and premises.
I then contacted RPA to question whether they recalled any
incidents or were aware of any type of water leak. They were not.
RPA then had their plumber, Don Elston, check the premises, as
well as the property, for any signs of water leakage past or
present. The plumber found none.
Since that time we have received the billing for the period from
September 7 through October 5th. This bill is once again in the
normal range for Brentwood Plaza. I called and spoke with Eileen
on December Ist and reviewed with her again our situation. She
suggested that we write to you.
We would like to see this resolved and pay what is rightfully owed
but we do not feel we owe $1,203.65 for that time period. We
would appreciate your review of our account and recommendation.

Please accept this letter as my way of apologizing for an
earilier letter (12-05-86) where I unjustly indicated that you
were somehow responsible for holding completion of the afore-
mentioned construction project. As I was soon to learn, the
order had already been given, prior to drafting that letter, to
proceed with the work in question. For this I apologize, as I
was unable to know that indeed this had taken place.
As I mentioned in our phone conversation, the letter was prompted
more from frustration and the fact that the Owner was becoming
quite upset than from anything else. It does seem that, perhaps
because of this project, you have been able to work out the
differences between the City and the State to some degree. I do
not envy you that position of being caught in the middle of
something that is not clearly defined. You were very forthright
in your dealings with our firm prior to my sending that communi-
cation and I wanted you to know that. I guess my biggest gripe
is the system that allows overlapping jurisdictions that impede
progress on what seemed to us to be a fairly easy matter.

has allowed a simple matter to become so bogged down that com-

ly impacted in -terms of the financial ramifications that the new
tax year brings. This is simply not acceptable..

several occasions that the Contractor was eager
to complete the work and yet no decision has
been made to this date.'
As I think you can plainly see, a si'mple matter has been bungled

to the point that it may impact our ability to receivethe Ci 's,
Certificate of Occupany by year end. I would like to request the
following:,
1. Certificate of Occupany be released immediately with the
Hwy. 99 revisions left as a separate matter, to be resolved
independent of the building completion.
2. Mr. Beckman be instructed to immediately resolve the traffic
revisions on Hwy. 99 and provide guidance as to an Acceptable
method of completing the work.
3. The City traffic crews complete the work on Hwy. 99 so.that
there can be no question that -the work is perfamed to City
and State specifications and the Owner (Mr. Segner) not be
further impacted by costs caused by these delays.
I realize that you personally have had nothing to do -with this
process and were not even aware of the problem until just
recently. Your efforts in assisting us in a proper resolution
will be very much appreciated.

In accordance with your request of September 10, 1986, we have
prepared our Permit for Attachments, No. R-3233. This permit allows you
to place your communications cable on a District pole as noted on the
attached map.
If this pole is jointly owned by GTE, you must also have their
permission to attach to the pole.
Although the District is granting permission for your requested
attachments, I do want to let you know in advance that we are reviewing
our present practice for allowing attachments. It is likely that the
District will continue to allow attachments but we may start charging the
county and municipalities an annual fee similar to that which we
currently charge cable TV companies.
Our permit, in duplicate, is enclosed for your signature.
Please sign and return the original and retain the duplicate for your
files.

I would appreciate a letter of clarification from you or your
Supervisor regarding the proposed changes to the center lane use at the
above address. The developer is almost finished with his site work and
lacks the ability to proceed with signage and curbing changes without
further direction.
Since my last contact with you on October 9, 1986, 1 had a general idea
that the proposed plan was to be approved. This would have been a
complete departure from the stance that Mr. Charles Gleich had taken in
a telephone call on the afternoon of September 16, 1986.
Thanks for your prompt attention to this matter. I have an idea that
similar situations will present themselves as development along state
facilities in Edmonds intensifies in the near future. Developing a
clear policy on who approves what should facilitate future development
review procedures.

Enclosed is a sketch of the proposed channelization improvements to SR
99 adjacent to the above referenced project. The changes include
removal of the existing curbed island, which will be a center -turn
lane. Along with construction of curbing and pavement markings, an
overhead sign is highly desirable. To accomplish this sign -placement
over the center lane, a span wire with a new strain pole on the project
side would be placed directly opposite the pole, No. 288.
Permission is hereby requested to contact said pole and provide a down
guy and anchor assembly approximately 6' distant from the pole base.
The signs should weigh less than 20 pounds, with mounting hardware.
The span wire should contact no lower than 24.5 feet above the center
of the roadway.
Please examine the plan sheet and the additional data for adequacy. If
you need more information prior to granting this joint use of these
overhead facilities, please call me at 771-3202, extension 281.

Thank you for meeting with Mr. Steinvall and ine on Friday, April
25, 1986, regarding the three areas in question on the above
referenced project. Your decisions regarding the installation of
catch basin at the south east corner of the property and the
relocation of the section of the sidewalk by the state two-way
turn sign deadman were equital5le solutions to the problems. Be
advised that I will have the type one catch basin with ring and
grate delivered to the south east corner of the property sometime
this week for your installation. We will commence work on the
sidewalk modifications early next week and should have them done
by the 2nd of May.
As soon as you have had a chance to review the run-off problem at
Millers' Rent, I would appreciate knowing your impression as to
the necessity for further involvement on our part. I think after
you review the circumstances you will see that the problem is by
and large -:a product of substantial amount of asphalt deverter
bern being removed sometime in the past. Had this berm not been
removed I'm sure that the water coming down Highway 99 would
easily,find its way on down the street.

Prior to issuance of the Certificate of Occupancy for the office
building located at 22921 Highway 99, the following items must be
completed and approved by the inspecting department:
ENGINEERING DEPARTMENT
1. Remove pole in the -middle of Highway 99 sidewalk to behind
the walk;
2. Provide asphalt berm across both entrances at Miller Rental
. to keep storm water in the right-of-wa3�;
3. Set catch basin and tie-in to storm on 234th to prevent water
from flowing into property to the east;
4. Repair street on-234th where it is sinking due to poor
compaction around the storm system extension. Contact Dan
Smith at 771-3202 when the work is comple and ready for

5. A two year 15% maintenance bond is required on the Engineering
items, this may be posted after the outstanding work is
approved.
FIRE DEPARTMENT
1. The Fire Department will not grant occupancy until al.1 tenant
spaces meet -the minimum standards of completion. Interior
wood frame walls must be sheetrocked and smoke detectors must
be installed. (Separate permits are required for tenant
improvements).
PLANNING DIVISION
1. The stairs on the south side of the building are incomplete.
Landscaping in this area is also incomplete;
2. The landscaping in several areas is not in conformance with
the ADB approved plans. Contact Bruce Finke at 771-3202 for a
plan which shows these locations;
3. Th e exterior of the building is not complete, there are windows
and doors that are not yet installed;
4. The dumpster area on the south side of the building is not
complete per the approved plans;
5. A two year 15% maintenance bond will be required for the
landscaping after all performance bond items are completed
and approved. Contact Bruce Finke when the work is complete
and ready for inspection.
BUILDING DIVISION
1. Provide a letter from the structural engineer as to the
adequacy of.the rockery construction to the north.
After the completion of all remaining work and provision of the
maintenance bond, a certificate of occupancy can be issued under the
terms of UBC Section 307.
Please respond in writing within 10 days date of this letter with
regard to the completion of the outstanding items.

Regarding your letter of March 21, 1986, regarding the completion
of this project be advised that the items are being addressed that
you have outlined and the moment the status is as follows:
ENGINEERING DEPARTMENT
1. Pole removal on Highway 99: There seems to be some confusion
regarding the relocation of this pole. In early January 1986,
prior to the placement of the sidewalks and the relocation of
the light standards, the relocation of this support pole was
discussed with the City of Edmonds Engineering Department. At
that time we were instructed to leave the pole where it is and
place the sidewalk around it as we have done. Please investi-.
gate this and let me know whose direction we are to follow re-
garding this. As I am sure you are aware, relocating the pole
to the back side of the sidewalk would involve substantial
costs which of course is unanticipated. I suggest that if the
present situation is not satisfactory, that we be allowed to
follow the same approach that was taken by the Developer further
to the South. In that instance they swerved the sidewalk around
the support pole.
2. We will install the asphalt berms across both entrances to
Miller Rental. I am concerned, however, the water will be
deverted into his planter area and could cause future erosion.

2. Continued:
As you will note, we have already installed a deverter berm
at the south side of his driveway that appears to be handling
the situation. I suggest that this matter be taken up with
Mr. Miller as I am sure he would prefer not to have a speed
bump type berm placed across his driveways which would incon-
venience his customers.
3. 1 have requested a price for the installation of this addi-
tional catch basin at the end of 230th Avenue S.W.
4. 1 have contacted the utility contractor responsibile for the
installation of the sewer work in the street and he is making
arrangements to contact Mr. Smith to affect the necessary
corrections.
5. A 15% maintenance bond has already been posted for the paving
as requested. Please verify this with Jeannine Graff of your
department.
FIRE DEPARTMENT
I understand the Fire Department will not grant occupancy
until the tenant spaces are completed. This of course will�
be an ongoing thing until all the spaces are rented up and we,
will address each space accordingly. Be advised that we will
of course install smoke detectors as required..
PLANNING DIVISION
1. The completion of the stairs at the south end of the building
have not been accomplished because of some revisions that were
made at the request of the Owner— Revised drawings have been
submitted by the Architect and approved for the relocation of
the dumpster pad and modificatins to the sidewalk and stairs
at the end of the building. As soon as the Owner has author-
ized the change order we will proceed with this work.
2. 1 have instructed the landscaping contractor to contact Bruce
Finke and to find out what corrections are necessary to the
Jandscaping and effect same.
3. The store fronts have all been installed -on the upper level.
The lower level doors have not been installed pending tenant
requirements. This is another item that will be ongoing until
all the tenant spaces are developed.

4. The dumpster pad area is worked in conjunction with Item No. 1
of this list and will be completed as soon as I have authoriza-
tion from the Owner to proceed.
5. A 2 year maintenance bond has been posted for the landscaping.
Here again, you can check with Jeannine Graff regarding this
item.
BUILDING DIVISION.
1. 1 have contacted the structural engineer and have requested
the required letter from him regarding the rockery on the
north end of the building.
Mr. Reeves I will keep you posted as to the progress of these items
as you have requested. -I trust that this letter will serve to.ini-
tially apprise you of the progress we are making regarding completion.

Dear Mr. Reeves:
Our business is next door to where the new retail center
called "Brentwood Plaza" is going in. It is being built
on the Northeast Corner of 230th and Hwy 99.
We have been quite concerned as for the past week truckload
after truckload of fill dirt has been brought in. The
new grade for their parking lot is now approximately .10.
feet above our parking lot and approximately 5 feet above
Hwy 99. Does this meet code? The visibility of our store
for people driving from the South to North has been blocked
by this.
Please look into this and let me know.

The City has reviewed the information provided with the permit application for La Chaquita and
will allow a grease trap (minimum 35 gallon, 70 lb retention) to be installed on the waste line
outlet of the proposed 3 compartment sink. Maintenance of the grease trap will be checked by
the City inspector on a periodic basis. If it is found that the grease trap is not being maintained
properly, a grease interceptor will be required to be installed immediately. Any changes or
additions to the cooking equipment, kitchen fixtures, or products made by the subject- business
and approved under the subject Tenant Improvement Permit, must first be approved by the City
of Edmonds Building Official to determie if the subject grease trap is still adequate for pre-
treatment purposes. Please sign the statement below with a notary public present, to
acknowledge your understanding and acceptance of this agreement.
